7. Conditional Use Permit - Harmony House Group HomeAgenda -March 2, 1998 (2304TH AVENUE WEST) BACKGROUND/CONSIDERATION: The report from FRDO and the Planning Board is enclosed in this packet. The FRDO Staff has recognized this request as compatible with this area. The recommendation for approval of the conditional use is transmitted with five conditions (see attachment A). RECOMMENDATION: Based upon the Findings of Fact, the unanimous vote in favor of the permit, and no opposition voiced at the public hearing, I concur with the recommendation to approve the conditional use permit with the five recommended conditions. The property is zoned RA-2, a Residential Apartment zoning district. The applicants are proposing to provide a home for a maximum of six seniors who do not require skilled nursing care. The residence is located at 30 Fourth Avenue West, Kalispell. Narda Wilson with the Flathead Regional Development Office described the proposal stating that it appears to be highly compatible with other uses in the area. She recommended approval of the project subject to five conditions. The applicant spoke in favor of the proposal and explained their plans. No one else spoke regarding the proposal. After some discussion, the planning board adopted staff report KCU-98-2 as findings of fact on a vote of seven in favor and none opposed. The board is recommending the City Council grant the conditional use permit subject the conditions outlined in Attachment A. A public hearing on this matter has been scheduled before the planning board for February 10, 1998, beginning at 7:00 PM, in the Kalispell City Council Chambers. The planning board will forward a recommendation to the City Council for final action. BACKGROUND INFORMATION A. Petitioner: Harmony House Peggy and Charles Junge P.O. Box 949 Columbia Falls, MT 59912 (406)892-5259 B. Size and Location: The property proposed for the group home is located on the west side of Fourth Avenue West and north of Third Street West. The use is proposed in an existing three story home at 230 Fourth Avenue West. The property can be described as Lot 4, Block 51, Kalispell Original in Section 18 Township 28 North, Range 21 West, P.M.M., Flathead County, Montana. C. Nature of Request: The applicants are requesting a conditional use permit to allow the use of an existing home to provide a group home for a maximum of six seniors who do not require skilled nursing care. There will be three live in care givers who will provide 24 hour a day care. The care givers will have individual rooms on the second floor of the house and the six seniors will each share one of the three bedrooms on the main floor. Typically, none of the residents will drive. There will be 24 hour video surveillance on the grounds to provide security for the residents. This facility will be licensed and operated in accordance with the State of Montana Public Health Department for groups homes. D. Existing Land Use and Zoning: Currently there is a three story single family residence existing on the property which will be used for the group home. There are three bedrooms on the main floor, four bedrooms on the second floor and a large living area on the third floor. There is a three car garage on the back of the lot which is accessed from the alley. There may be some modifications required to the home to comply with building code requirements for group homes. The zoning for the property is RA-2, a High Density Residential Apartment district which lists community residential facilities for eight or fewer people as a conditionally permitted use. E. Surrounding Zoning and Land Uses Zoning: Most of the properties in the immediate area are developed with single-family residences with the exception of a multi -family housing unit to the east which is owned by Flathead Industries. This complex provides independent living facilities for developmentally disabled people. A couple of blocks to the north is the Kalispell Center Mall and Elrod School is approximately one and one-half blocks to the south. North: Single family residential; RA-2 Residential Apartment zoning South: Single family residential; RA-2. Residential Apartment zoning East: Multi family residential; RA-2 Residential Apartment zoning West: Single family residential; RA-2 Residential Apartment zoning F. Master Plan Designation: The Kalispell City County Master Plan Map designates this area as high density residential which anticipates eight to 40 dwelling units per acres. The proposed project is in compliance with the land use designation of the master plan map and furthers the goals of the master plan by providing for a diversity of housing needs in the community. G. Adequate Useable Space: One standard size city lot contains the house, garage, small front and rear yards as well as modest setbacks around the building. The large house probably does not comply with the setbacks for the RA-2 zoning of ten on the sides. However, the proposed use would not be effected by any non -conformity with the zoning. Parking is proposed in the three car garage and parallel along the alley. Parking is marginally adequate to meet the requirement of the zoning ordinance. b. Adequate Access: Access to the home is off of the existing paved alley to the west. There is no driveway along Fourth Avenue West nor is one proposed. Access is adequate. C. Environmental Constraints: There are no significant environmental constraints apparent on the property. It is generally level and within an urban area of Kalispell. 2. Appropriate Design: a. Parl-drig Scheme: Four parking spaces are required by the Kalispell Zoning Ordinance, one per five persons plus one space per employee at maximum shift. As proposed, there are three parking spaces proposed to be located in the garage and one parallel along the alley. It appears that space inside the 30 by 24 foot garage is marginal and the space designated along the alley is also marginal and overgrown with weeds. Some attention needs to be given 2 to providing an acceptable parking space along the alley. It appears that the proposed parking can be provided in a manner which would be in substantial compliance with the Kalispell Zoning Ordinance requirements. b. Traffic Circulation: There is no specific traffic circulation within the site. Traffic will enter and exit primarily from the alley and short term guest parking will likely be on street. The alley behind the home is paved. Traffic circulation in the area and to the site is generally good. C. Open Space: No specific open space requirements are required under the zoning other than the required setbacks. This is a turn of the century historical home with side yard setbacks which probably do not comply with the zoning. d. Fencing/Screening/Landscaping: Landscaping is in place in the front and rear yards. There is some existing fencing to the north which is in extremely poor condition and will need to be repaired and reconstructed. There is additional fencing on the property on the south and west. No additional screening, fencing or landscaping would appear necessary. e. Sipnage: No signage has been indicated on the site plan or proposed in the application. 3. Availability of Public Services/Facilities: a. Schools: This site is within the boundaries of School District #5, however, generally speaking, this proposal should have minimal impact on the school district. b. Parks and Recreation: There is a small park associated with Elrod School within walking distance of the proposed residence. No substantial impacts to the parks and recreation facilities in the area can be anticipated as a result of this use. C. Police: No substantial impacts to the police can be anticipated as a result of the proposed residential facility. d. Fire Protection: Fire protection will be provided by the Kalispell Fire Department. It is the understanding of the staff that the group home will be upgraded to meet code requirements. Additionally, there are fire hydrants in the area as well as good access to the site in the case of a fire. C. Water: City water will continue to be used to serve the group home. No significant impact on water services can be anticipated as a result of this facility. f. Sewer: Sewer service will be provided by the City of Kalispell. No significant impacts on City sewer services can be anticipated as a result of the proposed use. g. Solid Waste: Solid waste pick-up will be provided by the City, and no significant increased impacts can be anticipated as a result of the proposed use. h. Roads: Minimal to moderate traffic generation can be anticipated as a result of this use. Access will generally be onto Fourth Avenue West, a City paved street which is in good condition and well maintained. Roads in the area are adequate to accommodate the proposed use. i. Immediate Neighborhood Impact: The general character of this area is residential. Provided the exterior of the home is upgraded, the impacts to the neighborhood will likely be positive. The area seems well suited for a group home of this nature because it is close enough to walk to the small City park or mall which are within a two or three blocks. Additionally, the independent living facility across the street provides a good element to create a mixed residential use area. REACTION OF NEARBY PROPERTY OWNERS A notice of public hearing was mailed to property owners within 150 feet of the subject property approximately 15 days prior to the hearing. At the writing of the staff report, no inquiries have been received by the Flathead Regional Development Office. SUMMARY OF FINDINGS 1. The size and location of the existing home and site is suited for the proposed use because it is an area which has a mix of single-family and multi -family uses. 2. The site design is in general compliance with the zoning and design standards of the City. 3. Existing public services and facilities are available and adequate to serve the proposed use. 4. There will be no negative impacts to the neighborhood with regard to the use of the site for the proposed use or the quality of the neighborhood. RECOMMENDATION It is recommended that the Kalispell City -County Planning Board adopt staff report #KCU- 98-2 as findings of fact and recommend to the Kalispell City Council that the Conditional Use Permit be granted subject to the following conditions: 1.
