REQUEST -AMEND THE OVERTIME PARKING CODE -1ST READING
BACKGROUNDICONSIDERATION: Enclosed is a letter and request for ordinance changes
submitted by the parking commission. John Harper will be at the meeting to answer any questions
that you may have regarding these changes.
RECOMMENDATION: These changes will clarify the times that are currently being enforced for
parking restrictions.
ACTION REQUIRED: Approval of ORDINANCE 1279 is required to continue to enforce the
parking restrictions.
ORDINANCE NO. 1279
AN ORDINANCE TO AMEND SECTION 17-90, KALISPELL CITY CODE,
PROHIBITING OVERTIME PARKING AND ESTABLISHING TWO HOUR PARKING
BETWEEN THE HOURS OF 8:00 A.M. AND 6:00 P.M. ON CERTAIN STREETS AND
DECLARING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KALISPELL AS
FOLLOWS:
SECTION I. Section 17-90 of the Kalispell City Code is
hereby amended to read as follows.
(c) It is unlawful and a violation of this article
for any person to permit a vehicle to remain parked
continuously on any block for more than two hours
between 8:00 a.m. and 6:00 p.m. on any day except
Sunday or a legal holiday on the following streets:
1) On Main Street Between Washington Street
and Fifth Street;
2) On First Avenue East between Center
Street and Fifth Street East;
3) On Section Avenue East between First
Street East and Third Street East;
4) On First Avenue West between Center
Street and Fifty Street West;
5) On Second Avenue West between Center
Street and Fourth Street West;
6) On Center Street and Second Street
between Second Avenue East and Third Alley
West;
7) On First Street between First Alley East
and Third Alley West;
8) On Third Street between Third Avenue East
and Third Alley West;
9) On Fourth Street between Second Alley
East and Second Alley West;
10) On Fifth Street East between First Avenue
West and Second Avenue East (R.0. 1947, §§
393, 394; Ord. No. 714, § 1; Ord. No. 1009, §
1.)
SECTION II. All other portions of Section 17-90,
Kalispell City Code, shall remain unchanged.
SECTION III. This Ordinance shall become effective 30
days following its passage by the City Council and signed
by the Mayor.

I've enclosed a proposed revision to Kalispell City Code Section 17-90 for your review
and placement on the City Council's agenda. Also enclosed is a photocopy of the current
Overtime Parking Code with the areas of change highlighted.
We feel these changes to the text of this municipal code will help clarify overtime parking
for our fellow citizens and visitors and improve parking accessibility in the Central
Business District.

provisions of this article for any person to cause, allow,
permit or suffer any vehicle registered in the name of or
operated by such person to be parked overtime or beyond the
period of legal parking time established for any parking
meter zone as herein described.
(b) It shall be unlawful and a violation of the
provisions of this article for any person to permit a
vehicle to remain or be placed in any parking space adja-
cent to any parking meter while such meter is displaying
a signal indicating that the vehicle occupying such parking
space has already been parked beyond the period prescribed
for such parking space.
(c) It is unlawful and a violation of this article for
any person to permit a vehicle to remain parked continuously
in any individual parking space for more than two hours -be-
tween 9:00 A.H. and 6:00 P.M. on any day except Sunday or a
legal holiday on the following streets:
