AGENDA ITEM 4 - ORDINANCE 1279-KALISPELL PARKING COMMISSION
REQUEST -AMEND OVERTIME PARKING CODE-2ND READING
BACKGROUND/CONSIDERATION: It is my understanding that the Parking Commission will
be requesting a slight change in the ordinance for parking restriction. That change deletes the word
"continuously" from the parking for two hours on each "block face". It is my understanding that the
commission is currently surveying the owners/operators in the business district to determine the level
of support for this ordinance to "control" the "rock and rollers". I am not aware of the outcome of
that survey at the time of writing this report.
This ordinance change will, in my opinion, create enforcement problems for the commission as well
as continue to increase the customer's frustration/anger levels. The recording of the license and the
times of the vehicles on the streets will be a monumental task_ The additional record keeping may
be more trouble than what they are trying to correct - "rock & rolling". It is my experience, no
matter what type of enforcement a city has for parking control: meters, chalking tires, using Denver
Boots, a store owners/operators "Honor System" etc., the city wdl always have those individuals who
abuse the system.
RECOMMENDATION: The Parking Commission is semi-independent to the Council. They are
charged with the operation of the parking facilities of the City. However, the City Council has to
approve the changes in the parking ordinance. I want to stress this relationship so that every one
understands that it is the Parking Commission who enforces the regulations. I recommend that we
not approve the "block face" two hour parking ban, UNLESS the survey that the Parking
Commission is conducting supports this type of change.

ORDINANCE NO. U7-9
AN ORDINANCE TO AMEND SECTION 17-90, KALISPELL CITY CODE,
PROHIBITING OVERTIME PARKING AND ESTABLISHING TWO HOUR PARKING
BETWEEN THE HOURS OF 8:00 A.M. AND 6:00 P.M. ON CERTAIN STREETS AND
DECLARING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KALISPELL AS
FOLLOWS:
SECTION I. Section 17-90 of the Kalispell City Code is
hereb,r amended to read as follows.
(c) It is unlawful and a violation of this article
for any person to permit a vehicle to remain parked
continuously on any block face for more than two
tours between 8:00 a.m. and 6:00 p.m. on any day
except Sunday or a legal holiday on the following
streets:
1) On Main Street Between Washington Street
and Fifth Street;
2) On First Avenue East between Center
Street and Fifth Street East;
3) On Second Avenue East between First
Street East and Third Street East;
4) On First Avenue West between Center
Street and Fifth Street West;
5) On Second Avenue West between Center
Street and Fourth Street West;
6) On Center Street and Second Street
between Second Avenue East and Third Alley
West;
7) On First Street between First Alley East
and Third Alley West;
8) On Third Street between Third Avenue East
and Third Alley West;
9) On Fourth Street between Second Alley
East and Second Alley West;
10) On Fifth Street East between First Avenue
West and Second Avenue East (R.O. 1947, §§
393, 394; Ord. No. 714, § 1; Ord. No. 1009, §
1.)
SECTION IT. Block Face as used in this ordinance shall be
defined as that area adjacent to and facing a street or avenue
on a single side of a block in which motor vehicles may be
legally parked.
GF'C aN III. All other portions of Section 17-90,
Kalispell City Code, shall remain unchanged.
SECTION Iit. This Ordinance shall become effective 30
days _-following its passage by the City Council and signed
by the Mayor.
