Request for abatement of City Specials for Street Maintenance and
Storm Sewer in excess of the standard City residential lot.
December 6, 1999
Mr. Fred Wallner is requesting relief from City assessments on his
residential lot. Attached is a copy of his letter and his tax notice. He
has a small house located on approximately 3 acres. I indicated to
him that he would have to pay his taxes and apply to the City
Council for an abatement. I told to him that the Council's past
practice (i.e. the Peters) was to require payment of specials for an
average size lot-10,000 square feet. The previous Council's policy
is to review these on an individual basis. Mr. Wallner requests a
refund. The average City home owner pays $45.00 in street
assessments and $28.00 for Storm Sewer assessments based on
10,000 sq. feet. The property is at N. Meridian and 3 Mile Drive.
Past practice has been to refund 3 years and so we are requesting
refunds from 1997 to 1999. He has been paying these assessments
since 1993.
These types of requests could be handled administratively if Council
would provide a policy. Refunds would be part of the claims
approval. Each property is assessed based on square footage and so
this tax notice will appear for an abatement each year. We send the
rate to the County and cannot set different rates for different
properties. We cannot change the square footage on the notice. ( The
Peter's have subdivided which is why you have not heard from them
this year). My memo is a request to provide relief for Mr. Wallner.
Consideration of a tax relief policy would provide staff some
direction. In past years several options have been considered but
none found to work satisfactorily.
RECOMMENDATION: Adoption of a motion to abate Mr. Wallner's assessments in the
amounts listed below.
FISCAL EFFECTS: Refund $739.44 in Special Street and $211.52 in Storm assessments
annually for a total refund of $2,852.88.
ALTERNATIVES: As suggested by Council.
