Kukulski, City Manager Ordinance 1326 - Parking Requirements for (a) Medical and Dental Offices; and (b) Drive Through and Fast Food Restaurants, 2nd Reading MEETING DATE: July 19, 1999 BACKGROUND: The attached ordinance amendment eliminates the distinction between medical and dental offices in the H-1 verses those in other zones. Secondly, drive -through restaurants and fast food restaurants will be placed under one parking use category. No substantive changes were discussed during the 1' reading of the ordinance amendment. RECOMMENDATION: A motion should be made and approved regarding the attached Ordinance 1326 pertaining to parking requirements for (a) medical and dental offices; and (b) drive through and fast food restaurants. Kukulski City Manager Report compiled July 16, 1999 Post Office Box 1997 • Kalispell, Montana 59903-1997 Telephone (406)g� J740 o fFA-� (406) 758-7758M ORDINANCE NO. 1326 AN ORDINANCE AMENDING SECTION 27.26.050 OF THE KALISPELL ZONING ORDINANCE, (ORDINANCE NO. 1175), BY AMENDING THE "PARKING MINIWkt STANDARDS BY USE" OF OFF-STREET PARKING, MEDICAL AND DENTAL OFFICES, CHANGING DRIVE-IN RESTAURANTS TO DRIVE -THROUGH RESTAURANTS AND COMBINING THAT WITH FAST FOOD RESTAURANTS INTO ONE CATEGORY, AND DECLARING AN EFFECTIVE DATE. _ WHEREAS, City of Kalispell has submitted a written request to amend Section 27.26.050 of the Kalispell Zoning Ordinance, by amending the parking requirements of medical and dental offices and by changing drive-in restaurants to drive -through restaurants and combining that with fast food restaurants into one category, and WHEREAS, the request was forwarded to the Kalispell City - County Planning Board and Zoning Commission by the Flathead Regional Development Office after having been evaluated under 27.14.030, Kalispell Zoning Ordinance, and WHEREAS, FRDO evaluated the requested text amendments and recommended, per Report #KZTA-99-6, that the parking requirements of medical and dental offices be amended, and that drive-in restaurants be changed to drive -through restaurants and combined with fast food restaurants into one category, and WHEREAS, the Kalispell City -County Planning Board and Zoning Commission recommended that the text of the Kalispell Zoning Ordinance, parking requirements of medical and dental offices be amended, and drive-in restaurants be changed to drive -through restaurants and combined with fast food restaurants into one category, and WHEREAS, the City Council has reviewed the FRDO Report and the transmittal from the Kalispell City -County Planning Board and Zoning Commission and hereby adopts the findings made in Report #KZTA-99-6 as the Findings of Fact applicable to this Ordinance. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KALISPELL AS FOLLOWS: SECTION I. The City of Kalispell Zoning Ordinance, Ordinance No. 1175, is hereby amended as follows: Section 27.26.050. Minimum Standards by Use (16) Drive -Through and Fast Food Restaurants: One s per 100 feet of gross floor area plus one space loyee on the largest shift and a minimum of four stacking spaces. (Amended Ordinance No. 1208) SECTION II. All parts and portions of Ordinance No. 1175 not amended hereby remain unchanged. SECTION III.
