Please notify Theresa White, City Clerk at 758-7756 Kalispell Police 7/13/99 Tentative Agreement The following is a tentative agreement addressing all outstanding items for the 1998/2001 Collective Bargaining Contract between the parties. This tentative agreement has a do pass recommendation by both parties. This tentative agreement is subject to a ratification vote by the membership and the City Council. Current contract with the following changes: All signed tentative agreements. 2. Article V. Hours of Work and Overtime Section 1. Starting Times and Work Schedules Change first paragraph to read "The starting times and work schedules will be as determined by the Chief of Police," Delete 2nd paragraph Delete 3rd paragraph (32 hour training) 4th paragraph -delete 15t sentence Section 4. Change to read "Overtime shall consist of any hours worked (including vacation, sick leave and comp time used in lieu of regularly scheduled shifts) by the employee at the direction of the City in excess of 80 hours in a 14 day calendar work period. Before working any overtime, the employee must be directed to work the overtime by the authorized supervisor. Overtime pay shall be paid at the rate of one and one half (1 and 1-:�) times the employee's regular hourly rate of pay. By mutual agreement between the City and the employee, before the overtime is worked, the employee may earn compensatory time at one and one half-hours for each hour of overtime worked as prescribed by the Fair Labor Standard Act (FLSA). Section 5. Current contract Section 6. Delete last Sentence. 3. Article VI, Salaries Sections 2 & 3 Change "Years" to reflect new agreement. 5. Article VIII, Holidays Current Contract 6. Article IX, Vacancies and Promotions Section 2. Change to read "The employer shall endeavor to fill City -declared vacancies within 90 days and where relative or substantial..." 8. Article XIII, Employee Fringe Benefits Section 1, Medical Insurance A. Current contract B. Current contract C. Change "bi-annual" to "biennial" City wide committee by agreement outside contract. See attached not part of CBA, enforceable with arbitration. Same as agreed to by Fire and AFSCME Unions. Section 3, Uniform and Cleaning Allowance __Change to read as follows "The employer shall pay $300 Uniform and Cleaning Allowance upon signing this contract in 1999. The employer shall pay $300 January, 2000 and $300 each January thereafter." It is understood and agreed between the parties hereto that the Uniform and Cleaning Allowance heretofore included as a separate item of compensation under previous collective bargaining agreements, except the $300 stated above, has been, and is hereby, included in the base pay calculations of Schedule "A", "B" and "C". 12. Article XVIII. Duration Section 1 Change to read "This Agreement shall remain in full force and effect for a period commencing July 1, 1998 through June 30, 2001. If either party desires to modify or amend this agreement commencing July 1,2001, it shall at...." Current schedule "C" hourly. No CPI. Delete monthly salary title and column. All employees paid by the hour. Increase hourly rate as follows. Step movement granted. Year 1 Step pay 2% increases schedule "C" Year 2 Step pay 1.50% increases Schedule "C" Year 3 Step pay 2% increases Schedule "C" The employer shall go to a every other week payroll. Retro pay shall be paid after the signing of a completed contract to all current employees. Amnesty Clause: No employee of the City and/or elected official will discriminate, discharge, discipline, harass, coerce, slander, intimidate, non -cooperate or not work with any city employee, member of the public, City Council and/or merchant because of their participation or non -participation in the arrival of this agreement.
