This is the second reading of an ordinance on amendments to the Kalispell Zoning Ordinance based on a request by The Nurturing Center for two amendments to the zoning regulations. One, an amendment to parking requirements for day care uses and, two, an amendment to the definition of day care uses. RECOMMENDATION: A motion to adopt the second reading of the ordinance amending the Kalispell Zoning Ordinance for this request would be in order. FISCAL Undetermined. Kukulski Senior Planner City Manager Report compiled: July 1, 1999 Providing Community Planning Assistance To: • Flathead County • City of Columbia Falls • City of Kalispell • City of Whitefnh • ORDINANCE NO. 1319 AN ORDINANCE AMENDING SECTION 27.26.050(15) (PARKING FOR DAY CARE FACILITIES OR NURSERY SCHOOL) AND SECTION 27.37.010(69) (DAY CARE) OF THE KALISPELL ZONING ORDINANCE, (ORDINANCE NO. 1175), BY CHANGING PARKING REQUIREMENTS FOR DAY CARE FACILITIES AND THE DEFINITION OF "DAY CARE" AND DECLARING AN EFFECTIVE DATE. WHEREAS, The Nurturing Center has submitted a written request to amend Sections 27.26.050(15) and 27.37.010(69) of the Kalispell Zoning Ordinance, by requesting that an amendment to the parking standards for Day Care Facilities be made and that the definition of "Day Care" be changed, and WHEREAS, the request was forwarded to the Kalispell City -County Planning Board and Zoning Commission by the Flathead Regional Development Office after having been evaluated under 27.14.030, Kalispell Zoning Ordinance, and WHEREAS, FRDO evaluated the requested text amendments and recommended, per Report #KZTA-99-5, that the parking requirements for day care uses be changed, and the definition of "day care" be changed to reflect State statutes, and WHEREAS, the Kalispell City -County Planning Board and Zoning Commission recommended that the text of the Kalispell Zoning Ordinance be amended to reflect these changes, and WHEREAS, the City Council has reviewed the FRDO Report and the transmittal from the Kalispell City -County Planning Board and Zoning Commission and hereby adopts the findings made in Report #KZTA-99-5 as the Findings of Fact applicable to this Ordinance. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KALISPELL AS FOLLOWS: SECTION I. The City of Kalispell Zoning Ordinance, Ordinance No. 1175, is hereby amended as follows: Section 27.26.050(15): Parking for Day Care Facilities or Nursery School: teaehe-r4empleyee—en the largess shift -t.•d..n ., . One s ace per teacher/employee plus one loading space per six students with a maximum of two loading spaces to be provided on the street adjacemt to the property where the facilities are located. H:\attsect\wp\ord\1310nuturfn9 ta.wpd Section 27.37.010(69): Day Care, A use which means care for children or adults other than the parent or other person living with the individual on a regular basis for daily periods of less than 24 hours, whether that care is for daytime or nighttime hours. Regular basis means providing supplemental care to separate families for three or more consecutive weeks. Family day care home means a place in which supplemental care is provided to three to six children or adults on a regular basis. Group day care home means a place in which supplemental care is provided to seven to 12 children or adults on a regular basis. Day care center means a place in which care is provided to 13 or more children or adults on a regular basis. 1' SECTION II. All parts and portions of Ordinance No. 1175 not amended hereby remain unchanged. SECTION III. This Ordinance shall take effect thirty (30) days after its final passage.
