A RESOLUTION AUTHORIZING A SPECIAL EVENT PERMIT TO BE ISSUED TO THE
FLATHEAD VALLEY HOCKEY ASSOCIATION FOR THE PURPOSES OF A ONE-TIME
EVENT TO BE HELD AT THE CITY OWNED WOODLAND ICE CENTER IN
WOODLAND PARK IN MARCH, 2013.
WHEREAS, the City of Kalispell has within its ordinances certain restrictions and requirements
on the exclusive use by organizations and entities of city owned property and
particularly a restriction on the sale and/or consumption of alcohol in city owned
parks; and
WHEREAS, the Flathead Valley Hockey Association has made a specific request to the Kalispell
City Council to allow a one-time use of the Woodland Ice Center in Woodland Park
for the purposes of holding a fundraiser in which alcohol will be served; and
WHEREAS, the City Council acknowledges that it has the authority to allow the requested use
of the city owned park on a one-time basis without otherwise changing its
ordinances and regulations; and
WHEREAS, the City Council finds that the specific request of the Flathead Valley Hockey
Association is persuasive in that the Woodland Ice Center, popular with the
public, features an ice rink purchased and owned by the Association and which is
subject to a debt that the Association hopes to reduce by means of the subject fund
raiser.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KALISPELL, MONTANA, AS
FOLLOWS:
SECTION I. The City Manager is authorized to issue a special event permit for one event
to the Flathead Valley Hockey Association upon the Association agreeing to
and showing proof of the following:
Underage persons will not obtain alcoholic beverages served at the function,
and precautions shall be put in place by the Association to secure and
supervise the area and the participants during the function;
2. The Association shall limit the consumption under the permit to the hours
between 11:00 a.m. and 11:00 p.m.;
3. The Association shall be responsible for cleaning, trash disposal or repairs
necessary as a result of the event for which the permit was issued;
4. The Association shall provide security for the permitted function
commensurate with the recommendations of the Chief of Police;
5. The Association shall agree to indemnify and hold harmless the City, its
employees and agents for all liability claims arising out of the event;
6. The Association shall show proof of liquor/host, liquor and general liability
insurance in the amount of $750,000 per occurrence and $1,500,000
aggregate, and to name the City as an additional named insured on any
policies.
7. The Association shall comply with all statutes and regulations of the Montana
Department of Revenue governing sales of beer and/or wine.
SECTION II. This Resolution shall become effective immediately upon passage by the City
Council and approval by the Mayor.

CITY OF KALISPELL THIS 4TH DAY OF FEBRUARY, 2013.
