SUBJECT Amendments to the Kalispell Zoning Ordinance -
Parking Standards and Definitions of Day Care Uses
MEETING DATE: June 21, 1999
BACKGROUND: The Nurturing Center has filed for amendments to the zoning
ordinance to change the parking standards for day care facilities and the definitions of
day care uses. This matter went to the Planning board for public hearing at their
June 241999 and they have made a recommendation to approve the amendments as
outlined in the attached transmittal Attachment A.
RECOMMENDATION: A motion to adopt the ordinance presented to the council
which amends the Kalispell Zoning Ordinance incorporating these amendments
would be in order.
FISCAL EFFECTS: Minor positive impacts once developed.
ALTERNATIVES: As suggested by the city. council.

AN ORDINANCE AMENDING SECTION 27.26.050(15) ( ARRING FOR
DAY CARE HOME, DAY CARE CENTER, GROUP HOME OR NURSERY SCHOOL) AND
SECTION 27.37.010(69) (DAY CARE) OF THE KALISPELL ZONING ORDINANCE,
(ORDINANCE NO. 1175) , BY CHANGING PARKING REQUIREMENTS FOR DAY CARE
HOMES AND THE DEFINITION OF "DAY CAREN AND DECLARING AN EFFECTIVE
DATE.
WHEREAS, The Nurturing Center has submitted a written request
to amend Sections 27.26.050(15) and 27.37.010(69) of the Kalispell
Zoning Ordinance, by requesting that an amendment to the parking
standards for Day Care Homes be made and that the definition of
"Day Care" be changed, and
WHEREAS, the request was forwarded to the Kalispell City -
County Planning Board and Zoning Commission by the Flathead
Regional Development Office after having been evaluated under
27.14.030, Kalispell Zoning Ordinance, and
WHEREAS, FRDO evaluated the requested text amendments and
recommended, per Report #KZTA-99-5, that the parking requirements
for day care uses be changed, and the definition of "day care" be
changed to reflect State statutes, and
WHEREAS, the Kalispell City -County Planning Board and Zoning
Commission recommended that the text of the Kalispell Zoning
Ordinance be amended to reflect these changes, and
WHEREAS, the City Council has reviewed the FRDO Report and the
transmittal from the Kalispell City -County Planning Board and
Zoning Commission and hereby adopts the findings made in Report
#KZTA-99-5 as the Findings of Fact applicable to this Ordinance.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF KALISPELL AS FOLLOWS:
SECTION I. The City of Kalispell Zoning Ordinance,
Ordinance No. 1175, is hereby amended as
follows:

CALL TO ORDER AND The meeting was called to order by Jean Johnson at approximately

Nilson. There were approximately 11 people in the audience.
APPROVAL OF On a motion by Stevens and seconded by Heinecke, the minutes of

STAFF REPORT Narda Wilson of the Flathead Regional Development Office gave a
presentation of staff report KZTA-99-5 in which staff supports the
amendment to the parking standard for family day care homes and
the amendment to the definitions of family day care homes, day
care centers, and day care facilities with the added language that
would also include adult day care as well as child day care in the
definitions. Staff recommends that the Kalispell City -County
Planning Board recommend to the Kalispell City Council that the
zoning ordinance amendments to the parking standards for day
care and definitions of day care be approved.
PUBLIC E[EARING __ The public hearing was opened to those in favor of the petition.
PROPONENTS Susan Christofferson, Executive Director of the Nurturing Center,
spoke in favor of the petition stating that the amendment request
was due to the need for the zoning ordinance to be more in sync
with the Montana State Statutes.
No one else wished to speak and the public hearing was closed.
BOARD DISCUSSION The board briefly discussed the petition and public comment.
MOTION Stevens moved and Hines seconded to adopt staff report KZTA-99-
5 as findings of fact and, based on these findings, recommend to
the Kalispell City council that the amendments, as follows, be
approved.

BERGER ANNEXATION A request by David R. and Deanne Berger for annexation and

Subdivision.
STAFF REPORT Narda Wilson gave a presentation on staff report KA-99-4 in which
staff recommends that the board recommend to the Kalispell City
Council that the initial zoning for this property should be R-4, Two
Family Residential, upon annexation. She noted that the
applicants own approximately 5 acres, most of which is in the 100
year floodplain. The area included in the request for annexation is
not in the 100 year floodplain but is in the 500 year which
provides a building site.
PUBLIC HEARING The public hearing was opened to those in favor of the petition.
PROPONENTS Dawn Marquardt, land surveyor for the applicants, spoke in favor
and made herself available to the board for questions.
OPPONENTS Doug Young, Lot 11 Belmar Addition, spoke against the petition
stating that there are 3 people already using the 12 foot easement,
that is paved, and he would like to have the initial zoning for
single family residences rather than allowing a duplex as that
would allow 5 residents using that easement. He stated that there
are children in the area and he believes something should be done
with the road in order for it to be safe.
No one else wished to speak and the public hearing was closed.

Dear Chris:
The Kalispell City -County Planning Board met on June 8, 1999 and held a public hearing
on a request by The Nurturing Center for amendments to the Kalispell Zoning Ordinance.
The request was made to make two amendments to the zoning regulations. One, an
amendment to parking requirements for day care uses and, two, an amendment to the
definition of day care uses.
Narda Wilson, with the Flathead Regional Development Office, presented staff report KZTA-
99-5 and noted some of the issues related to the request. She stated that the staff supports
amendments to the parking standards for day care and to the definitions of day care uses
as outlined in the staff report.
At the public hearing, Susan Christofferson, executive director of the Nurturing Center,
spoke in favor of the proposed amendments. She stated that the definition amendments
would put the zoning ordinance in closer alliance with Montana State Statutes. No one
spoke in opposition.
The board discussed the proposal. A motion was made to adopt staff report KZTA-99-5 and
recommend approval of the changes, as amended, to the city council. The motion passed
by unanimous vote. The board amended recommendation can be found in Attachment A.

JUNE 1, 1999
A report to the Kalispell City -County Planning Board and the Kalispell City Council
regarding a request for a text amendment to the Kalispell Zoning Ordinance. A
public hearing has been scheduled before the Kalispell City -County Planning
Board for June 8, 1999 beginning at 6:00 PM in the Kalispell City Council
Chambers. The Planning Board will forward a recommendation to the Kalispell
City Council for final action.
BACKGROUND INFORMATION
The applicants provide a family resource center to the community which includes,
among many other services, screening qualified applicants for day care subsidies,
family counseling and help in establishing and training day care providers. There
have been apparent problems with some of the standards and definitions that
apply to day care homes and facilities which would benefit from given greater
consideration and refinement.

B. Area Effected by the Proposed Changes: Any area ,within the Kalispell
zoning jurisdiction which allow day care homes, day care centers and / or
day care facility could potentially be effected by the proposed changes.
However, the allowance of day care uses themselves would not be changed,
only the definitions which apply. Generally, the proposed definitions are
more consistent with the definitions of the state statues under .Section 52-
2-703 that deal with child care definitions.
C. Proposed Amendments: The applicants are proposing basically two
amendments to the zoning regulations: (1) an amendment to Section
27.26-050(15), Off -Street Parking for Day Care Home, Day Care Center,
Group Day Care Home or Nursery School; and (2) an amendment to- Section
27.37.010(69) Definition of Day Care.
The first amendment would change the parking requirements for day care
uses. Currently this section requires "One space per teacher / employee on
the largest shift plus one off-street loading space per six students." As
proposed the amendment would be as follows: "Day Care Home and Day
care Group Home: One space per teacher / employee." "Day Care Center
and Nursery School: One space per teacher / employee plus one off street
loading space per six students."
The second amendment would refine the definitions related to day care
uses. Currently this section provides the following definition: "Day Care - A
use which provides daily care and supervision of five or more children or
handicapped, disabled or elderly adults not related by blood or marriage
and not the legal ward of the attendant adult. Family day care homes or
group day care homes (see MCA) must be registered with the appropriate
state agency. Centers (12 or more individuals) must be licensed by the

appropriate state agency. As proposed the amendment would be as follows:
Family Day Care Home means a place in which supplemental parental
care is provided to three to six children on a regular basis. Group Day Care
Home means a place in which supplemental care is provided to seven to 12
children on a regular basis. Day Care Center means a place in which
supplemental parental care is provided to 13 or more children on a regular
basis. Regular basis means providing supplemental parent care to children
of separate families for three or more consecutive weeks."
Included as an attachment to this staff report is the section out of the
Montana statutes which also have definitions for different types and levels
of child care facilities.
D. Staff Discussion: In seeking to provide clearer definitions of day care and
to work towards facilitating day care for children and adults in a home
environment, staff has encouraged the applicants to come forth with
amendment as a springboard for consideration and discussion. After
reviewing the applicant's proposal and the state statutes in relation to the
current zoning ordinance, it does appear that amendments would be of
benefit to clarify the different types of day care and to reconsider certain
elements of the parking standards.
The overall effect of the amendments would not be to allow uses where they
were otherwise not allowed, but rather to bring the definitions in closer
likeness to the state statutes. Additionally, the modest amendment to the
parking standards would not significant alter the manner in which day care
homes are operated or how they function. Essentially, the biggest change
in the regulations would be to eliminate the requirement for an off-street
loading space for family day care homes, i.e. day care providers of three to
six children which are typically operated from a residence.
EVALUATION BASED ON STATUTORY CRITERIA
The statutory basis for reviewing a change in zoning is -set forth by 76-2-205,
M.C.A. Findings of Fact for the zone change request are discussed relative to the
itemized criteria described by 76-2-203, M.C.A_
1. Does the requested zone comply with the Master Plan?
The master plan generally anticipates uses which support family and
community in a neighborhood setting which would include schools,
churches, community center and, to a great extent, day care facilities to
children in a home environment. By further defining day care uses and the
modest amendment proposed to the parking requirement, these types of use
would be encouraged and to a small extent made somewhat easier. The
proposed amendments would generally comply with the goals and objectives
of the Kalispell City -County Master Plan.
2. Is the requested zone designed to lessen congestion in the streets?
The proposed amendments would not typically have a significant impact on
traffic congestion in the streets. Some limited on -street parking during
peak hours of drop off and pick-up at day care homes may create some

minor inconveniences to neighborhood traffic, however, the impacts would
be limited and would not effect to overall traffic patterns, amount of traffic
in an area or contribute to traffic congestion.
3. Will the requested zone secure safety from fire, panic, and other dangers?
The proposed amendments would not reduce any security from fire or other
health and safety issues as has been stated by both the Kalispell fire
department and the Kalispell police department. In an emergency situation,
traffic could be rerouted, moved or otherwise handled to accommodate
these incidents. Any inconveniences associated with on -street loading
would be temporary and would not compromise the public safety.
4. Will the requested change promote the health and general welfare?
The general health and welfare of the public will be promoted by
encouraging child care facilities in a home setting, by providing different
child care and day care options within the community and by improving the
availability of these services.
5. Will the requested zone provide for adequate light and air?
Light and air between and surrounding buildings would not be altered or
impacted by the proposed changes. These issues would be addressed
through the development standards of the various districts that deal with
lot size, setbacks, building height and the types of uses allowed within the
various zoning districts.
6. Will the requested zone prevent the overcrowding of land or undue
concentration of People?
The proposed changes would not increase the intensity of uses currently
allowed within each of the zoning districts as they relate to either day care
homes, day care centers or day care facilities. The uses would basically be
the same within the districts, only the definitions would be further refined
to more closely coincide with the intention of the state and local laws that
govern and relate to day care uses. —
7. Will the requested zone facilitate the adequate provision of transportation,
water, sewerage, schools, parks, and other public requirements?
These amendments would further the facilitation of day care homes to a
minor degree but would not generally effect the delivery of services or
availability of other public requirements. The changes proposed would
promote the adequate provision of child care services generally in a day care
home setting.
8. Does the requested zone give consideration to the particular suitability of
the property for particular uses?
Child care and day care services are generally found and would be
appropriate within all areas of the community with the exception of light
industrial areas. The proposed changes give adequate consideration to the
suitability of the properties where these uses would be found and will
provide more understandable standards relating to day care uses.

9. Does the requested zone give reasonable consideration to the character of
the district?
The character of the areas which allow day care uses will not be altered
because of the proposed changes. Typically day care uses are found in
residential areas and to a lesser extent some commercial areas. These
districts already allow different types of day care as either permitted or
conditionally permitted uses. Amending the definitions to more closely
relate to the state definitions provides greater clarity and understanding of
the uses without changing the character of the district in which they are
allowed.
10. Will the proposed zone conserve the value of buildings?
The value of buildings in residential and commercial districts which allow
day care type uses would be conserved by promoting compatible and stable
uses within the community. These amendments will conserve the value of
buildings.
11. Will the requested zone encourage the most appropriate use of the land
throughout the iurisdiction?
The most appropriate land uses throughout the jurisdiction is promoted by
encouraging complementary and compatible uses which promote the
general well-being of all citizens of the community, including our younger
citizens. These changes will not only encourage appropriate land uses
through the planning jurisdiction, but will also provide greater
opportunities for home child care within a safe and healthy environment.
SUMMARY AND DISCUSSION The staff supports amendments to the parking
standards for family day care homes, a day care setting which would provide care
for three to six children. This amendment eliminates the need for an off-street
loading space. Furthermore, staff would encourage the board and council to take
this a step further and allow up to two loading spaces to be accommodated on
street for day care centers and day care facilities. The peak times at which loading
and unloading occur would not significantly impact the ability of the police or fire
department to successfully carry out their duties in an emergency situation, as
they have stated.
Staff would also support, generally, the amendments to the changes in the
definitions of family day care homes, day care centers, and day care facilities, with
the added language that would also include adult day care as well as child day
care in the definitions.

Section 27.26.050(1: a). "Family Day Care Home" means a place in which supplemental
