SUBJECT: Board of Adjustment Appointment
MEETING DATE: June 7, 1999
BACKGROUND: The Board of Adjustment is a five -member board which hears variance
requests and appeals of decisions by the Zoning Administrator. Four affirmative votes are
required to grant a variance or reverse a decision. Richard Goacher's term on the Board of
Adjustment expired in March, 1999. Since that time, the seat held by Mr. Goacher has been
vacant. With only four members presently on the Board, any favorable decision for an applicant
must be unanimous. Furthermore, four members are required for a quorum. If any member is not
available for some reason, such as an illness, the Board cannot take action and must schedule a
follow-up meeting.
We have received one letter of interest for the open position. Rob Heinecke recently
submitted a letter, which is attached. The Mayor has recommended that Mr. Heinecke be
appointed to the position.
RECOMMENDATION: Staff recommends that the Mayor's recommendation be implemented.

Dear Mayor Boharski and City Council,
This letter is to request your consideration in my serving on the Kalispell Board of
Adjustments.
I am presently serving on the City - County Planning Board. At the last Master Plan update
meeting (Tuesday 5-18-99) Jean Johnson pointed out there is an opening on the Board of
Adjustments and asked me if I was willing to serve on that board. I am very interested in being
on that board. Please allow me to give some background information.
I was born and raised in Kalispell. I am 44 years old and I have been a resident of the county
for 35 of those years. My great grandfather homesteaded in the west valley area in the late
1800s.
I started my own design -drafting business, Contract Design Drafting, 8 years ago. My business
is primarily home design but I do some commercial work as a subcontractor to an Architect or
an Engineer. This exposes me to a variety of land/ building use considerations.
I will not come to the board having all the answers. I would listen, learn and come to a
decision based on what is best for the city - county as well as the applicant.
