02. Authorization to Deed Storage Property to School DistrictREPORT TO: FROM: SUBJECT: MEETING DATE: The Honorable Mayor Boharski and City Council Susan Moyer, Planning, Economic and Community Development Chris A. Kukulski, City Manager School District No. 5 — School System Maintenance Warehouse 209 17th Street West, SE4 of SE4 S 18 T28 R21 May 17, 1999 BACKGROUND: Ordinance No. 3340, passed by City Council on November 20, 1989, enabled the City of Kalispell to amend the Kalispell Downtown Redevelopment Plan Ordinance No. 933, and the jurisdictional area of the Urban Renewal Plan to provide additional parking in the vicinity of Flathead High School. As a part of the parking expansion, the City acquired School District No. 5 property on Fifth Avenue West in return for which the City constructed a new maintenance warehouse at the above referenced location (adjacent to the city shops) in August of 1994. Neither the building nor the land has been deeded to the school district as the School District anticipated. RECOMMENDATION: The City Council authorize staff to contact Mr. Gary Rose, Director of Maintenance and Transportation to see if the School District would agree to a deed with a "reverter" clause. In the event that School District Five ceases to use the above referenced property for school district uses, the property will revert back to the City. FISCAL EFFECTS: None. The property owned be either entity, except for any special improvements levied, will remain off the tax rolls. ALTERNATIVES: As suggested by the Council.
