AN ORDINANCE AMENDING ORDINANCE NO. 1094, BY REVISING THE FEE
SCHEDULE FOR MONITORING BURGLAR AND FIRE ALARMS BY THE POLICE AND
FIRE DEPARTMENTS AND IMPOSING A PENALTY FOR FALSE ALARMS, AND
ESTABLISHING AN EFFECTIVE DATE.
WHEREAS, the City of Kalispell established the fees for monitoring
burglar and fire alarms by the police and fire
departments and imposed a penalty for false alarms
through Ordinance No. 1094 on March 2, 1987; and
WHEREAS, the police and fire departments have determined that the
rates established in Ordinance No. 1094 are in need of
updating.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KALISPELL,
MONTANA AS FOLLOWS:
SECTION I. That the fees charged by the City of Kalispell
police and fire department for responding to a
false alarm as set forth in §III, Ordinance
No. 1094 are hereby amended as follows:
(A) The first false alarm in the calendar
year is free;
(B)
The second
false alarm in
the same
calendar year
is $20.00;
(C)
The third false alarm in
the same
calendar year
is $30.00;
(D)
The fourth
false alarm in
the same
calendar year
is $40.00; and
(E)
The fifth and
any subsequent
false alarm
in the same calendar
year is
$50.00.
SECTION II. All parts and portions of this Ordinance not
amended hereby shall remain the same.
SECTION III. This Ordinance shall take effect thirty (30)
days from and after its passage by the City
Council.

After reviewing available alarm policies I would make the following recommendation:
1) The City Attorney construct a resolution for the adoption of an alarm policy that includes
the following fees for any "Police" alarm:

A) First alarm in the calendar year is free:
E) Second alarm in the same calendar year is $20.00
C) Third alarm in the same calendar year is $30.00
D) Fourth alarm in the same calendar year is $40.00
E) The fifth and any subsequent alarm in the same calendar year is $50.00
ORDINANCE NO. 1094
AN ORDINANCE ESTABLISHING FEES FOR MONITORING BURGLARY & FIRE ALARMS
BY THE POLICE & FIRE DEPARTMENT AND IMPOSING A PENALTY FOR FALSE
ALARMS.
WHEREAS, the City of Kalispell
monitored fire and burglary alarm
Departments, and
has for a period of several years
systems through the Police and Fire
WHEREAS, there are currently approximately thirty individuals,
businesses and organizations utilizing City facilities for monitoring
alarms, and
WHEREAS, the City responds to, but does not monitor, other alarms
throughout the City, that are operated by private answering services,
and
WHEREAS, City Police and Fire Officers must respond to alarms and
often respond to false alarms, and
WHEREAS, the City Council of the City of Kalispell desires that
the City must be compensated for monitoring alarms, and responding to
false alarms.
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
KALISPELL AS FOLLOWS:
SECTION I. That there is established a monthly monitoring
fee to imposed on individuals utilizing City facilities
for monitoring robbery, burglary and fire alarms of Eight
Dollars ($8.00) per month.
SECTION II. The Police Chief, Fire Chief and City Clerk -
Treasurer shall be responsible to establish the administrative
procedure necessary to collect said fee.
SECTION III. There is further hereby established a fee for
responding to alarms which prove to be false, of $25.00, to
be imposed at the direction of the PoLiae Chief and .Fire
Chief, provided that there shall be no charge for responding
to the first three false alarms in any calendar year beginning
January 1, 1987.
SECTION IV. Governmental offices utilizing City monitoring
and responding services shall be excluded from the fees
established by the City under this Ordinance.
SECTION V. This Ordinance shall take effect 30 days from
and after its passage by the City Council and approval by
the Mayor.
