09. Resolution 4469 - Change Order - Contract Supplement #6 - Meridian RoadRESOLUTION NO. 4469 A RESOLUTION TO ALTER AND AMEND THE CONTRACT WITH ROBERT PECCIA AND ASSOCIATES ON THE NORTH MERIDIAN ROAD RECONSTRUCTION PROJECT, STPU 6701(6). WHEREAS, the City on October 10, 1995 did enter into a contract with Robert Peccia and Associates, Helena, MT for the reconstruction of North Meridian Road and WHEREAS, certain elements in the project required additional work, as well as time to complete; and said additional work and time requirements could not have been necessarily foreseeable when the original construction contract was entered into, and said changes are contained in Exhibit "A", attached hereto and are by this reference made a part hereof; and WHEREAS, upon the advice and recommendation of Jim Hansz, Public Works Director, it appears in the best interests of the City to approve said changes and alterations. NOW THEREFORE, pursuant to the provisions of Section 7-5- 4308(1) MCA be it hereby resolved: 1. The alterations and modifications of the contract between the City of Kalispell and Robert Peccia and Associates, dated March 24, 1999, as set out in Exhibit "A" attached hereto are hereby approved, and 2. As soon as the alterations and modifications are agreed to in writing, signed by the City Manager, as hereby approved by the Council, this approval thereof shall be in effect. Boharski Mayor ATTEST: Theresa White City Clerk H:\attsect\wp\res\4469 north meridian.wpd MEMORANDUM April 5, 1999 To: Al Thelen, Interim City Manager From: Jim Hansz, Director of Public( W 7L NSP Subject: Robert Peccia Request for Contract Supp As I mentioned to the City Council during the Meridian Road Project work session, Robert Peccia and Associates has submitted a request for a contract supplement. This supplement will be to perform additional work to acquire right of way, combine phases II and III of the project, and to obtain reimbursement for costs of additional work not in the contract scope or covered by previous supplements. Acquire Right of Way: Part of this work was initially included in the Peccia contract and was then deleted at MDT request. Since that decision, MDT's workload on has increased dramatically. In addition, there is now no way the department can perform the work in a timely manner to support a 2001 construction date. The scope of the work has also been enlarged significantly to include about 60% more parcels and all the work to acquire ROW. Previously, MDT had planned to do a major portion of this supporting work. As a result of these changes in scope, and the enormous increase in the number of projects in the construction pipeline, costs for this work have increased substantially from previous figures. Peccia has submitted alternative proposals for phasing the ROW acquisition, but I do not recommend this. Costs would be higher, and the work for other phases would require starting immediately anyway. The full cost for ROW acquisition services for all three phases is now $339,014.30. This includes a new item for contingencies requested by MDT. This amount is to cover unforeseen items and would not be spent without prior authorization. I have discussed this large cost with MDT and have been assured that the funds are there to cover the cost. Also, I have been assured that the expenditure will not affect either the project schedule or the City's financial participation requirement. Added Cost of Work Not in Scope: Also attached is a complete summary of added costs to Peccia for work performed but not covered by previous supplements and for the work to combine phases II and III into a single project phase. Combining these phases will be more cost effective than issuing separate construction contracts, and is highly recommended. I have reviewed all the costs enumerated by Peccia and agree that the work was necessary and not covered by the present contract scope or previous contract supplements. The cost of these extras is $41,347.00. After reviewing all this information and thoroughly discussing the matter with MDT and Peccia at our meeting in Missoula, I am in agreement that supplement #6 should be authorized and forwarded to MDT as soon as possible. This supplement will raise the contract from its present ceiling amount of $391,928.00 to $772,289.30. Again, none of these extra cost will be paid by the City and the added cost will not affect the viability of the project. I recommend approval of Contract Supplement #6 in the amount of $380,361.30.
