A RESOLUTION AMENDING SECTION 20-5, PERSONNEL POLICIES HANDBOOK, BY
CLASSIFYING ADDITIONAL EMPLOYEES AS EXEMPT UNDER THE FAIR LABOR
STANDARDS ACT.
WHEREAS, the City Council of the City of Kalispell by
Resolution No. 4150 adopted the Personnel Policies
Handbook containing a list of employees deemed
exempt pursuant to the Fair Labor Standards Act,
and
WHEREAS, the City has reviewed the Job Descriptions and
duties of certain salaried positions not included
in said list to determine the eligibility for
exempt status, and
WHEREAS, under FLSA guidelines certain salaried positions
may be properly classified as exempt under FLSA.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
KALISPELL, AS FOLLOWS:
SECTION I. That Section 20-5, Personnel Policies Handbook
is hereby amended by classifying the following
positions as exempt from the overtime
provisions of the Fair Labor Standards Act:

SECTION II. This Resolution shall take effect immediately
upon passage by the City Council.

LIMITATIONS:
This policy sha11 not apply to employees whose labor agreement provides for a different work
period, specifically police officers and firefighters.
This policy does not apply to executive, professional, administrative, and all other employees
who are exempt from the FLSA, unless otherwise provided by labor agreement. The following
employee classifications are currently considered exempt from FLSA:

The Finance Department reviews what an employee does and compares the duties and
responsibilities to the test provided by the Fair Labor Standards Act (FLSA) to determine the
"exempt" or "non-exempt' status of all employees.
