A RESOLUTION TO ESTABLISH A FEE SCHEDULE FOR ELECTRONIC COPIES OF
ENGINEERING DATA SUPPLIED TO THE PUBLIC FROM THE PUBLIC WORKS
DEPARTMENT.
WHEREAS, the Department of Public Works has received a number of
requests for electronic copies of engineering survey data
developed over the years, and
WHEREAS, in order to recover the public cost of this data, a fee
schedule should be implemented for this information.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
KALISPELL FOLLOWS:
SECTION I. The fee schedule for providing electronic
copies of survey data is as follows:
Topographic base mapping or other related information
utilizing the same base mapping information:
$25.00 per section
Entire City (14 sections):
$150.00
SECTION II. This Resolution shall become effective
immediately upon its passage by the City
Council.
PASSED AND APPROVED BY THE CITY COUNCIL AND SIGNED BY THE MAYOR OF
THE CITY OF KALISPELL, THIS 19th DAY OF APRIL, 1999.

Subject: Fees for Engineering Data Supplied to the Public
We have recently received a number of requests for survey data developed by the
Department over the last few years. This has been primarily from the local engineering
community. The requests are for electronic copies of the information. By law we are required to
provide information but the City Attorney's office has researched this for us and advises that we
should also be charging a reasonable fee to recover the public cost. At the present time we have
no established fee schedule for this information.
The City Surveyor has researched the costs of this. He has also researched the fees
charged by other public agencies for similar electronic mapping information. Based on his
research the Public Works Department recommends the City of Kalispell charge the following
fees for electronic mapping information supplied by the City.
• Topographic base mapping or other related information utilizing the same base
mapping information... $25.00 per section
• Above information for entire City (14 sections)... $150.00
The Department recommends supplying the information with the following disclaimer, or
one that is similar in intent: "The City of Kalispell believes the information to be accurate to the
best of the City's ability to determine. Any incorrect or erroneous use of the information by the
recipient or other party to whom the information might subsequently be disseminated, is the sole
responsibility of the recipient."

In addition, the Department recommends that information that we might have but
originated from a private sector source, and /or is readily available from the private sector, that
source rather than the City should supply the information. In these situations we propose to refer
such requests to the original source rather than to compete with that source.
Prior to collecting any fee for this information, the City Council will need to authorize a
fee schedule. Please refer this item to the City Attorney's office for preparation of the
appropriate resolution or ordinance.
