04. Authorize Advertisement for Bid - Central School North Parking LotThe City of Kalispell, Montana will receive seated bids for `Central School - North
Parking Lot", to meet or exceed the minimum specifications on file in the office of
the Department of Public Works. The bid items shall consist of: renovation of
existing parking lot including removal of old paving and replacement of base and
new paving, curb work, and landscaping with irrigation.

Bids will be received by the Clerk of the City Council, until 2:30 p.m., local time, on
April 9, 1999, Bids will be publicly opened and read aloud at 2:30 p.m. on the date
of April 9, 1999, in the Council Chambers of the City Hail, Kalispell, Montana.
Proposals shall be addressed to the Clerk of City Council, PO Box 1997, Kalispell,
Montana, 59903-1997, and entitled Bid for `Central School - North Parking Lot'.
The successful bidder will be assessed the Montana Contractor's withholding tax.
All bidders shall, as bid security, accompany the bid with lawful money of the United
States, a Cashier's check, certified check, bank money order or bank draft, drawn
and issued by a national bank located in Montana or by a banking corporation
incorporated in Montana or a bid bond or bonds executed by a surety corporation
authorized to do business in Montana, in the amount of ten per cent (10%) of the
amount bid. Any such bank instrument shall be payable to the City of Kalispell. If
a contract is awarded, the bidder whose bond is accepted and who shall thereafter
refuse to enter into and execute the proposed contract, or provide sufficient
peirfoirmance security, as stated in the covenant, shall absolutely forfeit such moneys
or bank instrument to the City, and become immediately liable on said bid bond in
said sum. The money, bank instrument, or bid bond shall be returned to the
unsuccessful bidders.
All bids mast expressly covenant that if the bidder shall be awarded the contract,
the bidder shall within ten (10) days of the acceptance a of said bid by the City
Council, enter into a contract and give good and sufficient bond to secure the
pedbrimance of the terms and conditions of the contract. In the event the successful
bidder does not enter into a formal contraot within ten (10) days or give sufficient
band to secure performance, the bidder shall pay unto the City the difference
between the amount of the bid of said bidder and the amount for which the City

legally contracts with another party to perform said work if the latter amount is more
than the former.
No bid may be withdrawn after the scheduled time for the public opening of bids,
which is 230 p.m.. local time, on A rp i► 9"' . 1999, without the consent of the City
Council for a period of sixty (60) days after the scheduled time of receiving bids.
The City will accept the lowest responsible bid, but the Council reserves the right
to reject any or all bids received, to waive any technicality or informalities, and to
accept any bid which may be deemed in the best interests of the City. The City in
consideration of all bids shall observe Section 18-1-102, etseq., MCA.
The successful bidder will be required to abide by Federal and State laws,
particularly Section 18-2-401 et seq., MICA.
The successful bidder will be required for furnish an acceptable security for the full
amount of the contract for faithful performance thereof and payment of labor,
material and subcontractor claims.
The successful bidder shall be required to furnish to the City evidence of public
liability and property damage Insurance in ft minimum amount of $750,000 for each
claim and $1.5 million per occurrence, and shall for the purpose of this contract with
the City name and the City of Kalispell as an additional named insured on said policy
while performing work under City contract.
