This letter serves as notice of intent, that I will be presenting the attached last, best and final
offer to the City Council for their consideration and action at the March 3,1999, noon meeting.
I will be requesting the City Council to authorize the full implementation of all signed tentative
agreements and all items contained in this last, best, and final offer, effective March 21,1999
at 7:00 a.m..
The parties have had numerous bargaining sessions and three days of mediation. I find that
the City of Kalispell and the Kalispell Police Association are at an impasse. Schedule of hours
worked, Article V, Section 1, overtime, Article V, Section 4, and other ancillary issues.
If you have any additional proposals or offers you wish to explore, please feel free to call either
me or Mr. D'Hooge and arrange for a bargaining meeting.

The following is one total package offer. If any part of this
package offer is rejected all parts of this package offer is
rejected.
Current contract with the following changes:
All signed tentative agreements.
2. -Article V. Hours of Work and Overtime
Section 1. Starting Times and Work Schedules
Change first paragraph to read "The starting times
and work schedules will be as determined by the Chief
of Police,"
Delete 2nd paragraph
Delete 3rd paragraph
4th paragraph -delete 13t sentence
Section 4. Change to read "Overtime shall consist of
any hours worked by the employee at the direction of
the City in excess of 120 hours in a 21 day calendar
work period. Before working any overtime, the
employee must be directed to work the overtime by the
authorized supervisor. Overtime pay shall be paid at
the rate of one and one half (1 and I) times the
employee's regular hourly rate of pay. By mutual
agreement between the City and the employee, before
the overtime is worked, the employee may earn
compensatory time at one and one half-hours for each
hour of overtime worked as prescribed by the Fair
Labor Standard Act (FLSA).

City wide committee by agreement outside contract. See
attached not part of CBA, enforceable with arbitration.
Same as agreed to by Fire and AFSCME Unions.
Section 3, Uniform and Cleaning Allowance

9, Article XIV. Grievance Procedure.
Add: D. Election of remedies.
The association and/or the employee instituting any action,
proceeding, or complaint in a federal or state court or before
an administrative tribunal, federal agency, state agency, or
seeking relief through any statutory process for which relief
may be granted, the subject matter of which may constitute a
grievance under this agreement, shall immediately thereupon
waive any.and all rights to pursue a grievance under this
agreement. Upon instituting any proceedings in another form
as outlined herein, the employee and/or the association shall
waive his/her or their right to initiate a grievance pursuant
to this agreement, or of a grievance pending in the grievance
procedure, the right to pursue the grievance further shall be
immediately waived. This section does not apply to actions
compelling arbitration as provided under this agreement or to
enforce the award of the arbiter.
12. Article XVIII. Duration
Section 1 Change to read "This Agreement shall remain in
full force and effect for a period beginning the date of
ratification by both parties or upon the date of
implementation, whichever is first, through June 30,2001.
If either party desires to modify or amend this agreement
commencing July 1,2001, it shall at...."
Current schedule "C" hourly. No CPI. Delete monthly salary
title and column. All employees paid by the hour. Increase
hourly rate as follows. Step movement granted.

hours, or "X" amount of benefits, the City is not guaranteeing
the above employment, amount of days, hours, rates or benefits,
The above list of expenditures is an example. If any conflict
exists between the above and the final collective bargaining
agreement, the signed agreement controls.
