Council Minutes - Regular Meeting - January 7, 2013A REGULAR MEETING OF THE KALISPELL CITY COUNCIL WAS HELD AT 7:00 P.M., MONDAY, JANUARY 7, 2013, IN THE COUNCIL CHAMBERS AT CITY HALL IN KALISPELL, MONTANA. MAYOR PRO TEM JIM ATKINSON PRESIDED. COUNCIL MEMBERS PHIL GUIFFRIDA, BOB HAFFERMAN, RANDY KENYON, TIM KLUESNER, WAYNE SAVERUD, AND JEFF ZAUNER WERE PRESENT. COUNCIL MEMBER KARI GABRIEL AND MAYOR TAMMI FISHER WERE ABSENT. Also present: City Manager Doug Russell, City Attorney Charles Harball, City Clerk Theresa White, Police Chief Roger Nasset, Public Works Director Susie Turner, Planning Director Tom Jentz, Planner H PJ Sorensen, and Deputy City Clerk Judi Funk. Mayor pro tem Atkinson called the meeting to order and led the Pledge of Allegiance. A. AGENDA APPROVAL Kenyon moved to approve the Agenda. The motion was seconded. There was no discussion. The motion carried unanimously upon vote with Gabriel and Mayor Fisher absent. B. CONSENT AGENDA APPROVAL Council Minutes — Regular Meeting — December 17, 2012 2. Postpone Action on Bid — Dump Trucks Only one responsive bid was received for up to two used tandem dump trucks to be used by the street department. Staff recommended council postpone action on the responsive bid from L & M Truck Sales pending further review. 3. Purchase Approval — Shooting Range Simulator Staff requested authorization to purchase a Use -of -Force training simulator from Virtra Systems at a cost of $215,000 for the shooting range. The simulator would be paid for with grant funds received in 2009. Kenyon moved to approve the Consent Agenda. The motion was seconded. There was no discussion. The motion carried unanimously upon vote with Gabriel and Mayor Fisher absent. C. PUBLIC COMMENT None. D. REPORTS/RECOMMENDATIONS AND SUBSEQUENT COUNCIL ACTION Kalispell City Council Minutes January 7, 2013 Page 1 D/1. ORDINANCE 1720 — ZONING TEXT AMENDMENT —1ST READING This amendment would allow governmental facilities such as schools, jails, fairgrounds, police and fire stations to be permitted uses in all zones. Currently these types of uses require a conditional use permit even though state law provides for a zoning exemption. Russell and Sorensen gave reports and staff answered questions. Public Comment None. Kenyon moved first reading of Ordinance 1720, an ordinance amending the Kalispell Zoning Ordinance (Ordinance No. 1677), by allowing public fairgrounds, public schools, public jail facilities, and police and fire stations to be permitted uses in all zones, and declaring an effective date. The motion was seconded. Council Discussion Hafferman commented that he is concerned about this ordinance because the CUP process is a valuable service which allows the public to express their opinion. He said government agencies should have to go through the process and should not be exempt from zoning regulations. Kluesner remarked that government agencies are already exempt and we need to "open our arms" for them to come in and talk with us. Guiffrida noted that this will give us more input than if the agencies exempt out completely. The motion carried upon roll call vote with Atkinson, Guiffrida, Kenyon, Kluesner, Saverud, and Zauner voting in favor, Hafferman voting against, and Gabriel and Mayor Fisher absent. D/2. RESOLUTION 5603 — BANK ACCOUNT AUTHORIZATION Resolution 5603 removes Judge Heidi Ulbricht as a signatory on the city's bank account and adds incoming Municipal Judge Lori Adams. Russell gave a report. Public Comment None. Kenyon moved Resolution 5603, a resolution amending Resolution 5568, authorizing the Kalispell Municipal Court Judge to execute checks, drafts or other orders withdrawing funds from the Municipal Court Bond Trust Account. APPOINTMENT — PLANNING BOARD Only one letter of interest was received following a request for applications for open seats on the Planning Board and Board of Adjustment. Matt Regier is requesting appointment to the Planning Board. Mayor pro tem Atkinson recommended Matt Regier be appointed to the Planning Board. Public Comment None. Guiffrida moved council accept the Mayor pro tem's recommendation and appoint Matt Regier to the Planning Board. The motion was seconded. Council Discussion None. The motion carried unanimously upon vote with Gabriel and Mayor Fisher absent. E. MAYOR/COUNCIL/CITY MANAGER/REPORTS (No Action) Russell informed council the January 14 work session will focus on the Kidsports MOU and the ethics policy. Russell also gave council information regarding the recent audit. Guiffrida stated he attended the recent hockey tournament and said it is great to see all four seasons of sports being covered in the city. Saverud thanked Municipal Court Judge Heidi Ulbricht for her 18 years of exemplary service to the City of Kalispell and detailed her biography. Mayor pro tem Atkinson also voiced his congratulations to Judge Ulbricht for her service and her election to District Court.
