BACKGROUND: After the city and county appointments planning board
appointments are made, the planning board elects a member -at -large to fill one of the
positions. At the January 11, 2000 regular planning board meeting, the board voted to
reelect Bill Rice. This appointment requires conformation by the Kalispell City Council
and the Board of County Commissioners to become effective. The planning board is
also recommending that the member -at -large appointment be for a two year term.
Attached are the planning board transmittal recommending Bill Rice as member -at -
large, the draft minutes from the planning board meeting and the letters of interest
forwarded to the planning board for your information.
RECOMMENDATION: The city council should make a confirmation of the member -
at -large as recommended by the planning board unless otherwise determined.
FISCAL EFFECTS: None anticipated.

The Kalispell City -County Planning Board met on January 11, 2000 and from a pool of
interested applicants have reelected Bill Rice to fill the position of member -at -large on the
board. At that meeting, Garberg nominated Bill Rice for member -at -large and Heinecke
nominated Dewey Swank. Six members voted for Rice and one voted for Swank. The board
is also recommending that the member -at -large seat be changed to a two-year term. The
board is forwarding a request to you and the county commissioners for confirmation of Bill
Rice's appointment as member -at -large for a two year term. Bill has been a conscientious
member of the board who comes well prepared for meetings.
Please schedule this matter for the January 18, 2000 regular city council meeting. You may

CALL TO ORDER AND Jean Johnson called the meeting to order at approximately 7:07
ROLL CALL p.m. Members present were: Jean Johnson, Rob Heinecke, Greg
Stevens, Brian Sipe, Don Garberg, Don Mann, Don Hines,
Randy Ek and Bill Rice. Narda Wilson represented the Flathead
Regional Development Office. There were approximately 9
people in the audience.
SEATING OF NEW Randy Ek was welcomed to the board.
MEMBER
ELECTION OF Garberg nominated Jean Johnson for President. On a vote by
OFFICERS acclamation Johnson was elected President.
Sipe nominated Stevens for Vice President. On a vote by
acclamation Stevens was elected Vice President.
ELECTION OF MEMBER Garberg nominated Bill Rice for Member -at -Large and Heinecke
AT LARGE nominated Dewey Swank. On a roll call vote six members voted
for Rice and one voted for Swank. Bill Rice was elected.
Garberg moved and Hines seconded to forward the member -at -
large selection to the City Council and the County
Commissioners for confirmation, and to recommend that the
member -at -large seat be changed to a two-year term. On a vote
by acclamation the motion passed unanimously.
APPROVAL OF MINUTES On a motion by Mann and seconded by Heinecke the minutes of
the meeting of December 14, 1999 were approved unanimously,
as corrected, amend Page 16 to include names of voting
members.

At you know, each year four members are appointed to the planning board, which are
two appointments by the County Commissioners and two appointments by the City
Council. The city council has reappointed Don Garberg and Rob Heineke while the
commissioners have reappointed Greg Steven and new member Randy Ek.
The planning board also elects a member at large who can live in either the City or the
County, but must live in the planning jurisdiction. This member can be elected for
either one or two years. Because this has sometimes been problematic in filling this
position at the beginning of the year, may I suggest that this next appointment be
filled for a two year term. The current member at large on the board is Bill Rice, who
has submitted a letter of interest in continuing to serve. Letters of interest from other
people who applied for positions to the city and/ or county boards but were not
appointed, have been included with this memo for your consideration. The member -
at -large position must be confirmed by the city council and county commissioners.
Also enclosed is a copy of the statue relating to city -county planning board members
and appointments.

I would like to be considered for a position on the planning board for the City of
Kalispell. Please submit this letter to the Kalispell City Council.
My wife and I have lived at our North Main address for 18 years. We raised our two
children here and plan on retiring here. Kalispell is a nice place to live and I would
enjoy the opportunity to contribute to its future development.
I am employed as a mathematics tutor at Flathead High School by School District 5.
1 graduated from Pennsylvania State University in 1960 and have taken almost two
years of additional college courses at the University of Montana and FVCC. I read and
understand written reports of a technical nature in a short amount of time.
My concern for Kalispell's future is illustrated by my volunteering my time for over nine
months during 1998 and 1999 as a participant in the updating of the current Kalispell
City County Master Plan. I believe the other participants will agree that I was able to
share my ideas and concerns without making personal comments or getting angry at
people with different viewpoints. I work well with others in a group.
I have also been active in developing Lawrence Park as a member of Friends Of
Lawrence Park. As an officer in this group I am proud of our efforts to create a working
partnership with the city. This partnership allowed a lot of work to get done in the park
at a greatly reduced cost to the city.
I believe in planning but also recognize that no plan can cover all future situations. If
appointed I will work hard to judge each proposal on its own merit. I have both the
ability and the desire to do the work necessary to be an informed member of the

This is a request to be appointed to the Kalispell City/County Planning Board. I am very
familiar with the regulations, policies, procedures, and responsibilities of Planning Boards
and would like the opportunity to bring my experience to you through the Board.
I began working in the planning field in 1979 in Maricopa County, Arizona. I moved to
California in 1989 to work with the City of Lancaster's Planning Department. I then moved
to Kalispell in 1993 where I began working with FRDO until 1996. For the past 2-1/z years I
have been providing consulting services to the public hear in the Valley. I would like to
bring my 19 years of experience in both the public and private sectors to you.
I can bring to the Planning Board and Council my experiences and expertise on such things
as master plans, neighborhood plans, overall development plans, zoning, subdivision, and
environmental regulations. How these guidelines and regulations are used will have far
reaching impacts on the growth of the City and the Valley. These guidelines and regulations
should be practical and designed to allow for alternative locations/solutions for the growth

provided in subsection (2), a city -county planning board shall consist of not less
than nine members to be appointed as follows:
(a) two official members who reside outside the city limits but within the
jurisdictional area of the city -county planning board to be appointed by the
board of county commissioners, who may in the discretion of the board of county
commissioners be employed by or hold public office in the county;
(b) two official members who reside within the city limits to be appointed
by the city council, who may in the discretion of the city council be employed
by or hold public office in the city;
(c) two citizen members who reside within the city limits to be appointed
by the mayor of the city;
(d) two citizen members who reside within the jurisdictional area of the
city -county planning board to be appointed by the board of county
commissioners;
(e) the ninth member to be selected by the eight officers and citizen
members hereinabove provided for from the members of the board of
supervisors of a conservation district provided for in 76-15-311.
(2) Subsection (1)(e) does not apply if there is no member of the board of
supervisors of a conservation district who is able or willing to serve on the
city -county planning board. In such case, the ninth member of the city -county
planning board shall be selected by the eight officers and citizen members
hereinabove provided for with the consent and approval of the board of county
commissioners and the city council.

76-1-221. Membership of city planning board. (1) A city planning
board shall consist of not less than seven members to be appointed as follows:
(a) one member to be appointed by the city council from its membership;
(b) one member to be appointed by the city council, who may in the
discretion of the city council be an employee or hold public office in the city or
county in which the city is located;
(c) one member to be appointed by the mayor upon the designation by the
county commissioners of the county in which the city is located;
(d) four citizen members to be appointed by the mayor, two of whom shall
be resident freeholders within the urban area, if any, outside of the city limits
over which the planning board has jurisdiction under this chapter and two of
whom shall be resident freeholders within the city limits.
(2) The clerk of the city council shall certify members appointed by its
body. The certificates shall be sent to and become a part of the records of the
planning board. The mayor shall make similar certification for the appointment
of citizen members.

76-1-222. City council member of city planning board. (1) As soon
as the city council has enacted an ordinance creating a city planning board, the
city council shall select a member of its body to serve on the planning board.
The term of the appointed member shall be coextensive with the term of office
to which he has been elected or appointed unless the council, on its first regular
meeting of each year, appoints another to serve as its representative or unless
his term is terminated as hereinafter provided.
(2) The city council shall fill any vacancy occurring in its respective
membership on the planning board.

76-1-223. County representative for city planning board. As soon
as a city council has enacted an ordinance creating a city planning board, the
board of county commissioners of the county wherein the city is located shall
within 45 days designate a representative of the county to the mayor of the city
for appointment to the city planning board. This representative may be a
member of the board of county commissioners or an officeholder or employee
of the county. In the event of the failure of the county to so designate such
member, the mayor may appoint a person of his own choosing and at his sole
discretion as a representative of the county.

76-1-224. Citizen members of city planning board. (1) The citizen
members shall:
(a) be qualified by knowledge and experience in matters pertaining to the
development of the city; and
