4. Resolution 4548 - Authorizing Budget TransferREPORT TO: Honorable Mayor and City Council FROM: Judge Heidi Ulbricht SUBJECT: Resolution No. 4549; regarding the transfer among appropriations to fund expenditures for legal fees in the Municipal Court MEETING DATE: April 3, 2000 BACKGROUND: At the time the fiscal year 2000 budget was prepared, the City of Kalispell and the Kalispell Police Association were involved in wage negotiations. Understandably, it would have been difficult to anticipate revenue and expenditures until these negotiations were resolved. It is important to remember the underestimated expenses are related to the City of Kalispell's obligation to provide legal counsel to indigent defendants if the possibility of jail time exists, as required by law. While the Court makes every effort to expedite the resolution of cases, the City Attorney's office is typical of the trend to more actively prosecute defendants and by taking them to trial. RECOMMENDATION: The Council approves the resolution funding the Court's legal fees. The amount designated in the Resolution will adjust the legal fee line item to meet anticipated costs. FISCAL EFFECTS: $18,000 budget transfer from unallocated contingency (general government) to Court's legal fees. ALTERNATIVES: None Re ectively sub i ed ei Abri t Municipal Judge Report compiled April 3, 2000 RESOLUTION NO. 4549 A RESOLUTION TO APPROVE A TRANSFER AMONG APPROPRIATIONS WITHIN A GENERAL CLASSIFICATION OF EXPENDITURES AS ADOPTED BY THE CITY OF KALISPELL BUDGET FOR 2000 FISCAL YEAR. WHEREAS, in the budget adopted by the City of Kalispell for the 2000 fiscal year, certain detailed and itemized estimates of expenditures for legal fees in the office of the Municipal Judge of the City have proven inaccurate in the operation of the Judge's office for the 2000 fiscal year, and WHEREAS, the overall expenditures of the Municipal Judge are currently not in excess of the total of such estimates of expenditures adopted in the City's budget for the 2000 fiscal year, however, it does appear that the total of the budgeted appropriations in said classification will exceed such estimate for the balance of the 2000 fiscal year, and WHEREAS, further, other General Fund classifications will have appropriations in excess of expenditures and said excess appropriations may be utilized so that, the Municipal Judge's Budget appropriation is not exceeded by expenditures, and WHEREAS, under the authority granted the Council by law to make transfers or revisions within a general budgetary classification. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KALISPELL, AS FOLLOWS: SECTION I. That the following transfers within the classification set forth in the City budget for the 2000 fiscal year should be made as set forth in Exhibit "A", attached hereto and by this reference made a part hereof. so PASSED AND APPROVED BY THE CITY COUNCIL AND SIGNED BY THE MAYOR OF THE CITY OF KALISPELL, THIS 3RD DAY OF APRIL, 2000.
