The property is located on the northwest corner of Liberty Street and Northern Lights Blvd. in the northwest part of Kalispell. The Kalispell City -County Planning Board met on May 23, 2000, and held a public hearing to consider this matter. At the public hearing four people spoke in favor of the application and no one spoke in opposition. The staff recommended approval of the application subject to five conditions. The planning board is forwarding a recommendation for approval of the conditional use permit subject to same conditions. The Kalispell City -County Planning Board and Zoning Commission, after due and proper notice, on May 23, 2000, held a public hearing on the application, took public comment and recommended that the application be approved subject to five conditions. After reviewing the application, the record, the FRDO report, and after duly considering the matter, the City Council of the City of Kalispell, pursuant to the Kalispell Zoning Ordinance, hereby adopts Flathead Regional Development Office, Conditional Use Report #KCU-00-03 as the Council's findings of fact, and issues and grants to the above -described real property a conditional use permit to allow the addition onto the existing Faith Free Lutheran Church, in a Two Family Residential, R-4 zoning district subject to the following conditions: SECTION I. 1. That the proposal will be developed in substantial cup\faithchurchcup.wpd 1 conformance with the approved site plan, which shall govern the location of the buildings and access. Modifications to the location of the parking lot can be anticipated, as the project is refined. 2. Johnson questioned and Sallie Walter answered that she is against using the road that serves their subdivision being used for access to the proposed subdivision. Wilson explained that there is a condition to consult with the Road Department and that any needed improvements would have to be accomplished prior to final plat. Garberg moved and Rice seconded to amend the motion to amend the conditions to delete condition 11, correct condition 14 C as per star; add a condition that the County Commissioners consider the condition of Panoramic Drive and assess it's ability to accommodate additional traffic and consider necessary improvements if needed, and that an approach permit be obtained from the Montana Department of Transportation for access onto Highway 35. FAITH FREE LUTHERAN A request by Faith Free Lutheran Church for a conditional use CHURCH CONDITIONAL permit for the expansion of their existing church on property USE PERMIT zoned R-4 at 405 Liberty Street. STAFF REPORT Narda Wilson gave a presentation on staff report KCU-00-3 in which staff recommends approval of the conditional use permit subject to five conditions. She stated that there is an existing access off of Liberty. There are drainage problems in the area and no storm drainage system; therefore, the developer will have to come up with an engineered on -site drainage retention plan. PUBLIC HEARING The public hearing was opened to those who wished to speak on the application. PROPONENTS Dan Brien, P O Box 160 Somers, technical land surveyor on the development, spoke in favor of the application. He stated that the congregation has grown and there is a need for expansion. He stated that the church had researched moving but found that they are able to obtain the adjacent property and therefore would like to expand. He stated that the church has had a good rapport with the neighbors. He stated that the applicant would appreciate approval of the conditional use permit_ Steve Snipsted [church pastor], 98 Northern Lights Boulevard, spoke in favor of the application noting that the church wants to be an asset to the community, specifically the children of the community. They have many programs for the children. As they grow they would like to expand their programs and need additional room in the facility in order to do that. Mick Diede, 2635 Airport road, spoke in favor of the application stating that one of the many goals for their congregation is that they establish a center to help unemployed and underemployed persons. They need to expand to serve more people and would appreciate a favorable recommendation. Dennis Shaw, 1575 Smith Lake Road, spoke in favor noting that the church is being directed and led to expand in order to facilitate their ministries. By allowing this expansion they will be able to offer more of these services No one else ,xished to speak and the public hearing was closed. MOTION Hines moved and Garberg seconded to adopt staff report KCU- 00-3 as findings of fact and, based on these findings, recommend that the Kalispell City- Council approve the conditional use permit subject to the conditions as listed in the report. Rice stated that he thinks this is a good project. Garberg stated that he thought it was a good thing that the church needed more room. On a roll call vote all members voted Ave. The motion to recommend approval of the conditional use permit subject to conditions passed unanimously. NORTHWEST HEALTH A request by Northwest Health Care for a conditional use CARE CONDITIONAL permit for the expansion and remodel of the Kalispell Regional USE PERMIT Medical Center in an H-1 and Buffalo Commons PUD. STAFF REPORT Narda Wilson gave a presentation on staff report KCU-00-4 in which staff recommends approval of the conditional use permit subject to ten conditions. She stated that the hospital has been working for a long time to come up with an overall plan for the medical campus. This presentation further denotes their plan for the next six to eight years of development. One of the issues that the City has had is the lack of a connection between Sunnyview Lane and Conway Road. Another issue is the one-wav access onto Meridian Road, which is a substandard use of this connection. The parcel to be obtained by the church and where the church expansion would occur contains approximately 2.215 acres while the property where the existing church is located contains approximately one acre for a total combined area of approximately 3.22 acres. The property can be described as Assessor's Tract 5AL and Olson First Addn. And Lot 6, Block 2, Olson Addition located in Section 12, Township 28 North, Range 22 West, P.M.M., Flathead County, Montana. C. Nature of Request: The applicants are requesting a conditional use permit to allow expansion of their existing church on property that adjoins it to the north. The addition would include an attached octagonal building onthe north side of the existing sanctuary. A rectangular shaped building for classrooms would be constructed on the west end of the new octagon sanctuary. The existing church would be used as a foyer and for office space after the new sanctuary is built. There is also an existing gym on the west side of the church that will not be modified. The existing church building contains approximately 2,450 square feet and the existing gym building contains approximately 3,264 square feet. The new sanctuary will have approximately 8,122 square feet with seating for up to 500 people. The new classrooms building will have approximately 2,188 square feet for a total of 10,210 square feet of new space and the combined total square footage for the new and existing buildings would be approximately 16,025 square feet. Plans for the church addition are in preliminary stages with the first step being obtaining a conditional use permit for the expansion. This will clear the way for the church to actually purchase the property. It will take several years for the project to be completed. Although the location of the new sanctuary and classroom are unlikely to change significantly, the location of the parking area to the north may be reconfigured to make more complete use of the property. D. Existing Land Use and Zoning: There is an existing church on the property which contains approximately 2,450 square feet and a seating area for a maximum of 204 people. There is also a gym on the west side of the building which has approximately 3,264 square feet. Parking areas for the church are provided on the east side of the church. There are three approaches currently used by the church. Two approaches are onto Liberty Street, with the east approach being a one way entrance and the west approach being a one way exit. There is also a one way exit approach to the east along Northern Lights Blvd. Church services are held on Sundays and Wednesday and the occasional wedding, funeral or other activities are held at the church. The zoning for this property is R-4, a Two Family Residential zoning district which lists churches as a conditionally permitted use. The existing church does not have a conditional use permit on file and was constructed in the early 1970's. E. Surrounding Zoning and Land Uses Zoning: This area can be described as residential in character with a number of apartments and multi -family dwellings in the area. North: Single family residences, County R-1 zoning South: Apartments, City RA-1 zoning East: Single family residences, City R-3 zoning West: Assisted living facility, City RA-1 zoning F. Master Plan Designation: The Kalispell City County Master Plan Map designates this area as urban residential. The plan itself anticipates the need for semi-public services such as schools and services within residential districts. This proposal can be found to be in substantial compliance with the master plan. G. Evaluation of the Request: a. Adequate Useable Snare: There is approximately 2.22 acres in the property the church plans to acquire for the expansion and approximately 1.10 acres of property within the current church property. The total combined area of the existing and proposed property would have a total of approximately 3.32 acres. The total area occupied by the buildings would be approximately 16,000 square feet that would have a total lot coverage of approximately 11 percent. There is adequate usable space on the property to accommodate the proposed expansion. b. Mate Access: Access to the site is currently by way of two driveways onto Liberty Street and one onto Northern Lights Blvd. The driveways onto Liberty Street are one way in on the east and one way out on the west. The Northern Lights exit is also one way. As stated in the application, the western one way driveway e_x`t will likely be abandoned and a new access created onto the existing private road and utility easement to the west. This roadway is a paved private road that serves the assisted living facility on the property to the west. The proposal to consolidate the accesses onto the private road will improve the traffic flow in this area by eliminating one approach onto Liberty and by consolidating traffic onto a single roadway that has been generally constructed to City standards. C. En 'ronm .n al Constraints- There are some drainage problems in northwest Kalispell and occasionally in this area, no significant environmental constraints are associated wi`h this property such as floodplain or wetlands areas, steep slopes or severe drainage problems. There is a moderate slope near the middle portion of the property that is currently planned for parking. An engineered drainage plan will need to be developed to address the stormwater that vvill be generated from the site as a result of the new construction. a. Par g Scheme: Currently there are approximately 46 paved parking spaces provided in conjunction with the existing church. This parking lies near the east side of the site and along the east side of the building. The proposed addition and expansion of the church will create a sanctuary that has a seating capacity for 500 people. The existing sanctuary will be converted to a foyer and offices. According to the Kalispell Zoning Ordinance, one space per five seats is required for churches. As such a total of 100 parking spaces will be required. The new parking is indicated on the site plan to the north of the new sanctuary and shows 60 parking spaces. This will create a total of 106 parking spaces, or six additional spaces. All of the parking and driving surfaces will be paved. The parking design may be reconfigured as the plans for the church expansion evolve. In any event, there is adequate usable space on the property to accommodate the parking needs for the church facilities. 3. b. Traffic Circulation: Traffic circulation for this property will change slightly and be improved once the new church building has been constructed. Access to and from the property can be obtained for an existing private roadway that lies to the west of this site. This roadway serves the assisted living facility to the west and has been substantially constructed to City standards with 24 feet of paving, curb and gutter. This is a private easement and the applicants will need to demonstrate that they have permission to use the easement for their new access. The new church building will have entrances on the north and east sides of the building. The existing access off of Liberty Street will be able to provide good access to the entrances at either of these locations. The existing approach onto Northern Lights Blvd. will continue to be used as a one way e.Xit. It appears that the traffic circulation for the property is generally good and may be improved by creating a new entrance / exit from the access road to the west. C. Open Space: No specific open space requirements are applicable to a church use other than those associated with the required setbacks which have been adequately observed on the site plan. Because of the large size of the parcel, there is a significant amount of space on the site that is undeveloped. There may be adequate space to provide for a play or picnic area after the parking lot has been developed. d. Fencing,/ Screening./ T.2nds .a=in g: Landscaping has been proposed to be placed near the east and north sides of the property that abut the single family residences there. Currently there is shrubbery on the lots to the east. No additional fencing or screening appears to be necessary or appropriate. e. Bignage: There is an existing sign on the property which identifies the church and no additional signage is proposed. a. Schools: This church is within the boundaries of School District #5. No impact on the school district can be anticipated as a result of the proposed expansion. No school is proposed or currently operates in conjunction with the church. b. Parks and Recreation: There is a City park almost immediately to the east of this property. It is unlikely that there will be any significant impacts to the parks or the Kalispell Parks and Recreation Department associated with the proposed expansion. C. Police: This facility is currently served by the Kalispell Police Department. No increased impacts to the police can be anticipated as a result of the proposed expansion. d. Fire Protection: Fire protection is currently provided by the Kalispell Fire Department. There are hydrants currently in the area. At the time of building plan review, the building will be reviewed for compliance with the Uniform Fire Code. Access to the site and the building are good and it does 4 not appear that any modifications to the proposed site layout would be necessary to accommodate the fire department's needs. e. Water: Cit<• water currently serves the church, and no significant impact on water services provided by the City can be anticipated as result of this expansion. f. ; we : Sewer service is currently provided by the City of Kalispell. Insignificant impacts on City sewer services can be anticipated as a result of the proposed expansion. g. Solid Waste: Solid waste pick-up is currently provided by the City. The refuse containers are stored in the courtyard and moved to the street for pick-up as necessary. No significant increased impacts can be anticipated as a result of the proposed expansion. h. Bonds: recess to the property is currently provided to the site from two approaches from Liberty Street and one exit onto Northern Lights Blvd. As previously mention in this report, the western driveway onto Liberty Street will likely be abandoned when the building has been completed a_nd a new approach onto the ems*Ln access road to the west will be deve?oped. This will actually improve the tra-'Ec flow and safety in the area. Roadways in the area are adequate to accor=odate the expansion. i. Immediate Neigbhnr-3nod Im ac : The general character of this neighborhood is residential with a significant amount of relatively high density_ residential in the immediate area to the west and south. Limited hours of operation and occupancy are asfiociated with church because it does not operate as a school, pre-school or day care. Church ser-dem are generally limited to cwo days a week plus occasional special events such as weddings and funerals. 1 c -hvr-h expansion will not have significant impacts on the neighborhood with regard to noise nf operation and will not have a negative impact on the character of the area. A notice of public hearing was mailed to property owners 'within 150 feet of the subject property approximately 15 days prior to the hearing. One property owner in the area wrote a letter in support of the church and that has been included in the packet materials. 1. The size and location of the site is adequate to accommodate the proposed expansion of the church. 2. The design of the site with regard to access, parking, location of the building, and setbacks is in compliance with the zoning and design standards of the City. 3. Existing public services and facilities are adequate to accommodate the proposed use. L 4. No significant impacts to the neighborhood can be anticipated as a result of the expansion of the church. It is recommended that the Kalispell City -County Planning Board adopt staff report #KCU- 00-3 as findings of fact and recommend to the Kalispell City Council that the conditional use permit be granted subject to the following conditions: 1. During the regularly scheduled meeting of the planning board, the board will hold public hearings and take public comments on the following agenda items. The board will make recommendations to the Kalispell City Council or the Board of County Commissioners who will take final action: 1. A request by Northwest Health Care Corp. for a conditional use permit to allow the expansion and remodel of the hospital. The Kalispell Regional Medical Center Master Site Plan outlines the plans for the expansion and remodel of the hospital to create a hospital campus. The property is located in an H-1, Hospital zone and part of the Buffalo Commons PUD. In brief, the hospital expansion and remodel includes the relocation of .Sunnyview Lane to the north, a new outpatient building, remodel of the interior space and the creation of a connection between Conway Drive and Sunnyview Lane. These would both be off of Liberty Street. The current exit on the immediate west side of the church gym will probably be closed off. The exits will be the existing one onto Northern Lights Blvd., and the new private road servicing the Senior Citizen complex on the west side of the church. b) Access to and circulation within the property: The proposed main entrance to the new sanctuary will be on the east and north end of the octagon. This will allow drop offs right at the entrances. Possibly will have a covered entrance on the north end to be out of the weather. The larger areas for parking and lanes will a:lcw better access for fire and emergency vehicles. c) Off-street parking and loading: There are no "No Parking" areas adjacent to the church property. There is 81 feet of extra parking spaces on Northern Lights and 312 feet to extra parking spaces on Liberty Street. d) Refuse and service areas: Garbage is picked up by the city at the curb once a =ek. We keep our co-tainers in the cour_ yard on the north side/middle of the church buildings.
