City Attorney SUBJECT: Resolution No. 4560 MEETING DATE: June 19, 2000 BACKGROUND: Sgt. Rick Parker of the KPD requested this office consider a request from Buffalo Hill Terrace designating a lane which adjoins the north, west; and south sides of the building as a fire lane. We are informed that there are signs posted designating the road as a fire lane, but people have continued to park on or adjacent to the road. The KPD was requested to ticket vehicles illegally parked, but in reviewing past resolutions on the subject of fire lanes, we did not find authority officially designating the road as a fire lane. The proposed resolution would give KPD authority to issue citations to illegally parked vehicles to better ensure access to fire department equipment in the event of an emergency at Buffalo Hill Terrace. ALTERNATIVES: Pass/Do Not Pass RECOMMENDATION: This Office does not take any official position. If enforcement of the fire lane is to be effective, official action must be taken. Cit Attorney Chris Kukulski, City Manager RMH RESOLUTION NO. 4560 A RESOLUTION ESTABLISHING A FIRE ACCESS LANE SURROUNDING THE BUFFALO HILL TERRACE RETIREMENT COMMUNITY, PURSUANT TO SECTIONS 6.17(c) AND 2.01, KALISPELL ZONING ORDINANCE, AND DECLARING AN EFFECTIVE DATE. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KALISPELL AS FOLLOWS: SECTION I. That there is hereby created a fire access lane in which parking of vehicles is prohibited at the following locations at Buffalo Hill Terrace: The entire lane which circles Buffalo Hill Terrace on the north, west and south sides. SECTION II. This Resolution shall become effective immediately upon its passage by the City Council.
