BACKGROUND:
The City Council adopted the Uniform Plumbing Code on January
19th, 1999. Prior to January 1999, the Uniform Plumbing Code
regulated the installation of medical gas and vacuum systems. The
Montana Department of Commerce abandoned the UPC in favor of the
National Fire Protection Association standard (NFPA 99C, Gas and
Vacuum Systems) . City inspection for medical gas and vacuum systems
was optional under the Department of Commerce regulations.
However, the Building Department has personnel trained and
qualified to inspect medical gas and vacuum systems.
Ordinance No. 1363 adopts by reference NFPA 99C authorizing the
City to inspect such installations.
A motion and vote adopting Ordinance No. 1363 is in order.

ORDINANCE NO. 1363
AN ORDINANCE TO ADOPT, BY REFERENCE, THE NATIONAL FIRE PROTECTION
ASSOCIATION STANDARD NFPA 99C, GAS AND VACUUM SYSTEMS 1999 EDITION, AND
APPLICABLE TO THE JURISDICTIONAL AREA THEREOF; ADOPTED AND APPROVED BY
THE BUILDING CODES DIVISION, DEPARTMENT OF COMMERCE, STATE OF MONTANA;
TO PROVIDE A PENALTY FOR THE VIOLATION OF ANY LAWFUL ORDER ISSUED
PURSUANT THERETO; AND ESTABLISHING AN EFFECTIVE DATE.
PURSUANT TO THE AUTHORITY OF THE CITY OF KALISPELL UNDER THE PROVISIONS
OF SECTION 7-5-108, M.C.A., AND 7-5-4202, M.C.A., BE IT ORDAINED BY THE
CITY COUNCIL OF THE CITY OF KALISPELL, MONTANA, AS FOLLOWS:
SECTION I. There is hereby adopted by reference, National
Fire Protection Association standard NFPA 99C,
Gas and Vacuum System, 1999 Edition.
SECTION II. This standard is applicable to all buildings
within the building code enforcement area of the
City of Kalispell, including but not limited to,
residential buildings containing less than five
dwelling units or their attached -to structures,
any farm or ranch building, and any private
garage or private storage structure use only for
the owner's own use as provided by § 50-60-102
(1) (a), MCA.
SECTION III. It is unlawful for any person to knowingly,
purposely, willfully, or negligently violate any
lawful order issued pursuant to said codes; such
a violation is an offense against the City
punishable as provided in Section 1-9 of the
Kalispell City Code.
SECTION IV. This Ordinance is effective thirty days from and
after the date of its final passage and the
filing with the City Clerk of the prescribed
copies of the Codes hereby adopted by reference.
PASSED AND APPROVED BY THE CITY COUNCIL AND SIGNED BY THE MAYOR OF THE
CITY OF KALISPELL THIS DAY OF , 2000.

NOTICE IS HEREBY GIVEN, pursuant to Section 7-5-108, M.C.A.
and 7-5-4202, M.C.A. that the City Council of the City of
Kalispell, Montana, did on the 21st day of August, 2000, conduct a
First Reading of Ordinance No. 1364 which was an ordinance adopting
the "National Fire Protection Association Standard NFPA 99C, Gas
and Vacuum Systems 1999 Edition"; as said codes were adopted and
approved by the Building Codes Division, Department of Commerce,
State of Montana, in accordance with Section 23.7.301,
Administrative Rules of Montana.
Notice is further hereby given that the City Council of the
City of Kalispell, Montana, intends to finally adopt, at Second
Reading, the above referenced codes on the 18th day of September
2000, at the regular meeting of the City Council at 7:00 p.m. in
the Council Chambers, City Hall, Kalispell, Montana.
One copy of the above referenced codes to be adopted, together
with the appendices adopted and the amendments approved by the Fire
Prevention and Investigation Program, shall be filed with the City
Clerk of the City of Kalispell for public inspection, use and
examination during regular business hours.
