SUBJECT: Adoption of the 1997 Uniform Fire Code
MEETING DATE: August 7, 2000
BACKGROUND: The City presently is using the 1991 edition of the Uniform
Fire Code.The Building, Plumbing, Electrical and all other codes have moved to the 1997
edition of their respective codes. Because of delays in the State Fire Marshals Office in
adopting the 1995 edition of the Uniform Fire Code, the City of Kalispell has never
adopted the 95 edition and now we are nine years behind the times. The State adopted
the 97 edition in November of 1999.
RECOMMENDATION: The City Council approves the adoption of the 1997
edition of the Uniform Fire Code.
FISCAL EFFECTS: None
ALTERNATIVES: Remain with 1991 Uniform Fire Code.

ORDAINED BY THE CITY COUNCILOF OF + •ELL, MONTANA AS

SECTION 1. There is hereby adopted, by reference, the Uniform
Fire Code and the appendices, 1997 edition (UFC),
and the Uniform Fire Code Standards, 1997 edition
(UFC STANDARDS), with the additions, amendments,
and deletions enumerated by the Fire Prevention and
Investigation Program (FPIP) in ARM 23.7.301
through 23.7.310, effective 2/9/96 and 12/17/99.
At least one copy of said document shall be kept on
file in the office of the City Clerk for inspection
by the public.
SECTION II. Said Code shall apply to all buildings within the
corporate limits of the City of Kalispell,
including but not limited to, residential buildings
containing less than five dwelling units or their
attached -to structures, any farm or ranch building,
and any private garage or private storage structure
used only for the owner's own use as provided by §
50-60-102 (1)(a), MCA.
SECTION III. It is unlawful for any person to knowingly,
purposely, willfully, or negligently violate any
lawful order issued pursuant to said codes; such a
violation is an offense against the City punishable
as provided in Section 1-9 of the Kalispell City
Code.

SECTION IV® This Ordinance is effective thirty days following
final approval by the Council and the filing with
the City Clerk of the prescribed copies of the
Codes hereby adopted by reference.
PASSED AND APPROVED BY THE CITY COUNCIL OF THE CITY OF KALISPELL,
MONTANA AND SIGNED BY THE MAYOR THIS DAY OF SEPTEMBER, 2000.
