Prior to January 1999, the Uniform Plumbing Code regulated the installation of medical gas and vacuum systems. The Montana Department of Commerce abandoned the UPC in favor of the National Fire Protection Association standard (NFPA 99C, Gas and Vacuum Systems) . City inspection for medical gas and vacuum systems was optional under the Department of Commerce regulations. However, the Building Department has personnel trained and qualified to inspect medical gas and vacuum systems. Ordinance No. 1363 adopts by reference NFPA 99C authorizing the City to inspect such installations. Attached is a memo written by Craig Kerzman in response to the Mayor's question pertaining to training. Currently two inspectors are certified for this inspection. No changes have been made between the first and second reading. A motion and vote adopting Ordinance No. 1363 is in order. gas&vacuummemo.wpd Date: August 22, 2000 To: Chris Kukulski, City Manager From: Craig Kerzman, Building Official Ordinance 1363, Medical Gas Piping Ordinance 1363 is a housekeeping matter, which does not change what the City currently does, but simply changes the reference code that regulates the installation of medical gas systems. Chapter 13 of the Uniform Plumbing Code (UPC), which is currently adopted by the City, also covers medical gas piping. Four personnel in the department carry plumbing inspector certification and can inspect plumbing work. Until the State changed the regulating code from Chapter 13 of the UPC to NFPA 99C, the inspectors could also inspect medical gas piping. A consequence of this State inspired change was getting personnel certified under NFPA99C. Two personnel are already certified and the others will be as soon as training becomes reasonably available. A recent check with the State Building Codes Division disclosed that another training session may be offered by the State Board of Plumbing if enough interest is expressed, primarily by local governments. I have indicated to the State my wish to train two more inspectors. Hopefully, that can happen this year. PURSUANT TO THE AUTHORITY OF THE CITY OF KALISPELL UNDER THE PROVISIONS OF SECTION 7-5-108, M.C.A., AND 7-5-4202, M.C.A., BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KALISPELL, MONTANA, AS FOLLOWS: SECTION 1. There is hereby adopted by reference, National Fire Protection Association standard NFPA 99C, Gas and Vacuum System, 1999 Edition. SECTION 11. This standard is applicable to all buildings within the building code enforcement area of the City of Kalispell, including but not limited to, residential buildings containing less than five dwelling units or their attached -to structures, any farm or ranch building, and any private garage or private storage structure use only for the owner's own use as provided by § 50-60-102 (1) (a), MCA. SECTION III. It is unlawful for any person to knowingly, purposely, willfully, or negligently violate any lawful order issued pursuant to said codes; such a violation is an offense against the City punishable as provided in Section 1-9 of the Kalispell City Code. SECTION IV. This Ordinance is effective thirty days from and after the date of its final passage and the filing with the City Clerk of the prescribed copies of the Codes hereby adopted by reference.
