Ordinance 1364 - 1st Reading - Park OrdinanceThe Kalispell Department REPORT: 11317" Honorable Mayor and City Council Frank Garner, Chief of Police Park Hours Ordinance MEETING DATE: September 18, 2000 BACKGROUND: The City Council identified, in a recent workshop with the Parks Department and the Police Department, a need to improve the city ordinance regulating park hours. Currently there is no city ordinance that permits enforcement of park hours. The Parks and Police Departments believe this ordinance is necessary to control vandalism in our city parks. RECOMMENDATIONS: The City Council should adopt Ordinance #1364, limiting park hours. FISCAL EFFECTS: None ALTERNATIVES: As recommended by Council. Chief of Police • KPD phone (406) 758-7780, FAX (406) 758-7799 300 1 st Ave. East, Kalispell, MT 59901 ORDINANCE NO. 1364 AN ORDINANCE AMENDING R. 0. 1947, SECTIONS 899-901 (SECTION 19-20 OF THE KALISPELL CITY CODE), TO PROVIDE FOR OPENING AND CLOSING HOURS OF CITY PARKS, AND ESTABLISHING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KALISPELL, MONTANA AS FOLLOWS: SECTION I. Section 19-20, Kalispell City Code is hereby amended to hereafter provide as follows: Section 19-20. Parks, Indecent Conduct, Drinking, Hours. "D. Hours. City parks shall be posted as open at 6:00 a.m. every day and closed at 11:00 P.M. every day. It shall be unlawful for any person to remain in any city park during the time when it is closed." SECTION II. All parts and portions of this Ordinance not amended hereby shall remain the same. SECTION III. This Ordinance shall take effect thirty (30) days from and after its passage by the City Council.
