Ordinance repealing City electrical licenses. -SECOND READING

BACKGROUND: This is a housekeeping Ordinance requesting that the Council repeal
the City Code requiring the need for City licenses and bonds for
electricians. We have not issued any licenses to electricians in over
ten years. The state regulates and licenses electricians. It is a
duplication of licencing requirements.

ORDINANCE NO. 1377
AN ORDINANCE AMENDING CHAPTER 7, ELECTRICITY, KALISPELL MUNICIPAL
CODE; BY REPEALING § 7-1 (LICENSE TO ENGAGE IN BUSINESS AND BOND
REQUIRED; EXCEPTION), AUTHORIZING THE CITY ATTORNEY TO CODIFY THIS
ORDINANCE AND DECLARING AN EFFECTIVE DATE.
WHEREAS, Chapter 7, Electricity, Kalispell Municipal Code requires
persons engaged in the business of installing, altering
or repairing electrical wiring to secure an electrical
license, and
WHEREAS, the electrical contracting business is a trade,
occupation or profession regulated by the State of
Montana Department of Commerce and State Electrical
Board, and
WHEREAS, City regulation of electricians unnecessarily duplicates
licensing and regulation.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
KALISPELL, MONTANA AS FOLLOWS:
SECTION I. That Section 7-1, (License to Engage in
Business and Bond Required; Exceptions),
Ordinance No. 1102, is hereby repealed.
SECTION II. All parts and portions of Ordinance No. 1102,
not amended hereby, remain the same.
SECTION III. That the City Attorney is hereby authorized
and directed to codify this Ordinance, in
accordance with this Ordinance.
SECTION IV. This Ordinance shall take effect 30 days from
and after its passage by the City Council.
PASSED AND APPROVED BY THE CITY COUNCIL AND SIGNED BY THE MAYOR OF
THE CITY OF KALISPELL, THIS DAY OF / 2000.
