The center would be open Monday through Friday from 7:30 AM until 6:00 PM. The ages of the children would be from infant to eight years old. Small groups of age appropriate children would be created and there would be five staff members. The day care center would be licensed by the state and would be subject to all of the applicable health and safety codes relating to a child care center. A public hearing was held before the ,Kalispell City County Planning Board on October 10, 2000 and the applicant spoke in favor of the proposal, and no one spoke in opposition. A public hearing has been scheduled before the planning board for October 10, 2000 beginning at 7:00 PM in the Kalispell City Council Chambers in Kalispell. The planning board will forward a recommendation to the Kalispell City Council for final action. A. Petitioner: Wayne and Suzanne Elliott 1221 Eighth Ave. East Kalispell, MT 59901 (406) 752-2320 B. Size and Location: The property proposed for the day care center is located on the west side of Airport Road approximately 100 feet south of 18th Street West and the address is 1818 Airport Road, Kalispell. It can be described as Lot 1, Purdy Addition located in Section 19, Township 28 North, Range 21 West, P.M.M., Flathead County, Montana. C. Nature of Request: The applicants are requesting a conditional use permit to allow the operation of a cay care center for a maximum of 36 children. The center would be open Monday through Friday from 7:30 AM until 6:00 PM. The ages of the children would be from infant to eight years old. The day care center would be licensed by the state and would be subject to all of the applicable health and safety codes relating to a child care center. D. Existing Land Use and Zoning: There is an existing building on the site that has approximately 2,000 square feet. This former residence was converted to an office use and all of the necessary building code and handicapped accessibility upgrades have been made. Some additional improvements would be made to the property and building to make it safe for the children and to comply with codes related to the facility. Additional fencing would be placed around the back yard, the parking lot would be restriped, and minor modifications would be made to one of the bathrooms. The zoning for the property is RA-3, High Density Residential. This district allows single-family homes and duplexes as permitted uses and multi -family as conditionally permitted uses. Some office uses are also listed as permitted uses in the district. The day care center is listed as a conditionally permitted use. The minimum lot size requirement for the RA-3 zoning district is 7,000 square feet plus and additional 1,500 square feet for each dwelling beyond a duplex. E. Surrounding Zoning and Land Uses Zoning: This area can be described as a mix of residential, commercial and industrial uses in the area. North: Residential and undeveloped, RA-3 zoning South: Single family and multi -family dwellings, RA-3 zoning West: Mobile home park, County R-1 zoning East: City airport runway, P-1 zoning F. Master Plan Designation: This property is within the boundaries of the Kalispell City -County Master Plan. The master plan map designates this area as High Density Residential. The master plan anticipates day care centers and schools throughout the planning jurisdiction at strategic locations as the need arises. This location appears to be good with regard to its proximity to services and accessibility by the public. This proposal is in substantial compliance with the master plan. Adequate Useable Space: The site where the building is located contains slightly over one third of an acre or 14,000 square feet. There is a developed parking lot on site that will be restriped to meet the needs of the day care center. There is a rear yard area that can be well developed as a play area for the children. It appears that there is adequate useable space on the property to accommodate the proposed use, parking, access, play area and setbacks. b. Adequate Access: Access to the property is from Airport Road from two existing developed accesses. Airport Road is a paved City street in reasonably good condition. There is an established parking area that will be easily accessed by parents and a drop off / pick-up area will be established near the entrance. c. Environmental Constraints: There are no obvious environmental constraints associated with this property. The site can generally be described as level with a zero percent slope overall. There is no surface water in the immediate area. No impacts to the groundwater can be anticipated because this property is served by community water and sewer 2 systems. a. Parking Scheme: The City zoning ordinance require a minimum of one parking space per employee plus one loading space per six children. It is anticipated that there would five employees and a maximum of 36 children served by this day care center. This would generate a need for 11 parking spaces. Two of the loading and unloading spaces can be provided on the street. The site plan indicates that 11 parking spaces can be accommodated with two of the loading spaces being located on the street and the other nine spaces being located within the existing parking lot. Restriping the parking lot would need to be done to clearly delineate the parking needs for the day care center. b. Traffic Circulation: Traffic enters this site from one of two existing approaches from Airport Road. The circulation within the parking lot is good with two accesses. A pick-up and drop off area will be created near the main entrance of the building. Access to the site is generally good and so is the traffic circulation within the site. c. Open Space: There are no special setback requirements for schools other than the standard setbacks for the RA-3 zoning district. The existing building meets the RA-3 setback requirements. There is also a large grassy area in the rear of the property, which will be developed as a play area for the children and fenced. d. Fencing/Sc�ingf .ands aping: There is some landscaping on the property, which was previously developed that consists of a small island between the driveways. Additionally, there is a grassy area in the back that has some small trees and shrubs that will be used as a play area. Fencing will be extended so that the entire rear yard is enclosed and the children would be protected. No additional fencing, screening or landscaping appears to be appropriate in conjunction with this proposal. e. Signage: A existing four by six foot sign that would be changed'to the child care center. No additional signage is anticipated to be needed and none is proposed. Schools: This development is within the boundaries of School District #5 and would have no known impacts to the school district associated with this use other than to provide another educational alternatives to the public schools. b. Parks and Recreation: No park areas are in close proximity to the proposed day care center. Some occasional field trips might be made which would use the City parks. Additional impacts to the park programs will be insignificant. 3 c. Police: This property is within the jurisdiction of the Kalispell Police Department. Because of the nature of the proposed use, any additional impacts to the department would be insignificant. d. Fire Protection: Fire protection is be provided by the City of Kalispell. Fire risk appears to be low because of the topography and relatively good access to the area. The Kalispell Building Department reviews the structure for building code compliance for a use of this nature and compliance with any necessary changes. Additional improvements to the driveway and parking lot may be required in order to provide adequate emergency access. e. Water: The water system for this property is provided by the City of Kalispell. Impacts to the system will be minimal as a result of this use. f. Sewer: Sewer service is provided by the City of Kalispell. No significant impact to the sewer system can be anticipated as a result of the proposed use. g. Solid Waste: Solid waste will be collected by the City of Kalispell and taken to the Flathead County Landfill. There is sufficient capacity within the landfill to accommodate this additional solid waste generated from this use. h. Roads: According to the Institute of Transportation Engineers Trip General Manual there could be as many as 70 vehicle trips per day generated as a result of the 36 child day care center. This would be an insignificant increase in the overall traffic volumes associated with Airport Road. 4. Immediate Neighborhood Im:a t: The general character of this neighborhood is residential to the south and west with some businesses to the north. The City airport is to the east. This use appears to fit well with the neighborhood character of the area and will be an asset to the community as a whole since day care is a critical community service that is in short supply. The proximity of the property is well situated to serve the community. Airport Road is designated as a collector street and adequate to accommodate the additional traffic, which might be generated as a result of this use. This use will be an asset to the character of this area and negative impacts would be insignificant. A notice of public hearing was mailed to property owners within 150 feet of the subject property approximately 15 days prior to the hearing. At the writing of the staff report, no comments have been received by the staff from the public or adjoining landowners. 1. The site appears to provide adequate usable space for access and parking, and there are no significant environmental constraints. 0 2. The overall design of the site is in substantial compliance with the development standards and requirements of the Kalispell Zoning Ordinance. 3. Public services such as community water and sewer, schools, fire protection and adequate roadways exist in the area to accommodate the school. 4. There will be no significant negative impacts to the character of the area as a result of the proposed use. I would like to obtain a Conditional Use Permit so that I can use the property of 1818 Airport Road as a Child Care Center. I would like to license the program for 36 children - infants through 8 years old. There is a great need in this community for good, quality infant and toddler care. The program would be open Monday through Friday from 7:30 am until 6:00 pm. The children will be grouped into small classes of similar ages so that the children will get plenty of one-on-one care. The program will be a structured program with age -appropriate activities for the different groups of children. This facility is perfect for a program like this because there is plenty of room, all handicapped codes have been met, the parking lot is in place, the backyard is spacious and hidden from sight from the road, there is a bathroom at each end of the house, a sign is already in place on the outside of the building, and the location is easily accessible for parents. I have a Bachelor's Degree in elementary education with a concentration in early childhood. I was the Director of Trinity Lutheran Child Care Center for 6 years, from June 1994 to June 2000. 'Trinity's program was licensed for 2 '/2 to 12 years old. 1 now have an infant of mine own and would like to begin a child care program for infants and older. This would be my own business. I would like to open this program as soon as possible because I already have a number of people that are in need of quality care for their infants and toddlers. There is room to add three parking spaces if the lines were repainted, and we would utilize the allowable two on -street parking spaces. The back yard is not risible from the street because it is directly behind the house. Any children playing outside would not be visible from the street. The applicants were requesting a conditional use permit to allow the operation of a day care center for a maximum of 36 children. The center would be open Monday through Friday from 7:30 AM until 6:00 PM. The ages of the children would be from infant to eight years old. Small groups of age appropriate children would be created and there would be five staff members. The day care center would be licensed by the state and would be subject to all of the applicable health and safety codes relating to a child care center. PUBLIC HEARING The public hearing was opened to those who wished to speak on the application. PROPONENTS Suzanne Elliott, the applicant, spoke in favor of the day care center saying there is a critical need in the community and that she is receiving calls almost daily asking when the center would be open. She said she will primarily provide a place for infants and toddlers, where the need is most critical. OPPONENTS No one wished to speak in opposition and the public hearing was closed.
