As part of the search for a qualified individual to fulfill the remainder of Judge Ulbricht's term, a Request for Qualifications was published in the newspaper and placed on the website. The deadline for submittals was 5:00 p.m. Wednesday, November 21. A selection committee consisting of myself, Attorney Thane Johnson, and Victim Advocate Jen Curtis met on Monday, November 26, to review the Statements of Qualifications. Only one Statement of Qualifications was received. Lori Adams is requesting appointment to the position. Adams is currently employed as a Deputy County Attorney in the Flathead County Attorney's office. She is well qualified for the position of Municipal Judge and is aware the position is up for election in November, 2013. RECOMMENDATION: City council appoint Lori Adams to the position of Kalispell Municipal Judge. If appointed, Adams would be sworn in at the city council meeting on December 17, 2013 and begin her new job on January 2. Specifically, a Municipal Court Judge must have the same qualifications as a judge of a district court, as set forth in Article VII, Section 9, of the 1972 Montana Constitution, except that a Municipal Court Judge need only be admitted to the practice of law in the State for at least three (3) years prior to the date of appointment or election. A Municipal Court Judge must be a resident and voter in Flathead County at the time of election. As a prosecutor I have accrued 4 complaints to the Office of Disciplinary Counsel from defendants I have prosecuted 04-286; A claim of prosecutorial misconduct from Ronald Glick. Mr. Glick is a defendant that I prosecuted for sexually assaulting his girlfriend's daughter. Mr. Glick was tried by jury by myself in front of the Honorable Katherine R. Curtis and convicted in 2005 and sentenced to 20 years to the Montana State Prison with 15 years suspended. Mr. Glick also sued the City of Kalispell for 5 million dollars and stated he would not drop the civil suit unless the State dismissed his case. This claim was dismissed for lack of merit on 7-15-2005 07-267; A second claim by Mr. Glick claiming that I made false statements to the Court. This case was dismissed by ODC for lack of merit on 3-20-08. 09-212; A claim that I withheld evidence by Oliver Pearson. Oliver Pearson is a defendant that I prosecuted for criminal Endangerment and Negligent Vehicular Assault. He was represented by Sean Hinchey. We reached a plea agreement and afterword he made this claim. This claim was dismissed for lack of merit on 10-19-10 11-044; A claim of Prosecutorial Misconduct by Randy Dennison. Mr. Dennison is a case I took over for prosecution of a Revocation of Probation proceeding. This claim was dismissed for lack of merit on 9-8-11. FCJC Case No. CV-11-2672.;. Due to a marital separation, there was a financial responsibility that was overlooked and in 2011, I was sued by the Dirk Larson Law firm of Great Falls for a credit card debt by Capital One Bank. Immediately upon learning of the suit, I negotiated with the Larson Law firm and came to a settlement. This debt is currently being paid pursuant to an agreement. The law suit was dismissed. e. Applicant's capacity and intent to proceed without delay if selected to this position I exhibit the qualities needed of a municipal judge; patience, fairness, and understanding. I had decided to apply for this position in June 2012. When I determined my intent, I immediately informed Ed Corrigan, the County Attorney, of my intent and we have been working to fill my child abuse prosecution vacancy and also my current felony and juvenile caseload in preparation for the possibility I may get this appointment. E Applicant's specific experience in the areas of law over which the Municipal Court has jurisdiction The Municipal Court handles misdemeanor criminal cases, search warrants, city ordinance violations, municipal infractions, Order of Protection and civil cases. The Court also operates a DUI Court. During my time as a prosecutor I have handled hundreds of misdemeanor cases. I have negotiated plea agreements in some of these cases and also have tried some of these cases. I also have worked on traffic cases as well as Fish, Wildlife and Park violations. I am the on -call Deputy for the County Attorney's Office the majority of the time. As such, I have worked with police officers on search warrants. In working with Partner Family Member Assault cases and TRO Violations, I am familiar with Orders of Protection. I also work closely with victim's advocates in my role as a prosecutor and have a very good understanding of the dynamics associated with domestic issues. Everyone involved in a case should expend the time and effort to ensure that every litigant is heard. As a judge, I will always remember that some litigants may be unfamiliar with the process. For this reason I will guide them through the system without giving them an unfair advantage. I believe I have a deep respect for the system and have the ability to see both sides of a case and come to a fair result. If all sides of a case are not heard, justice is not served. I believe that a judge should at all times exhibit appropriate judicial demeanor, that is patience and understanding. As a judge, I will conduct court proceedings in a fair and impartial manner. In addition to being fair and impartial, I will at all times give the appearance of impartiality. b. Approach to the efficient administration of the court's duties As I believe that the Municipal Court should work to serve the community, I believe that cases should be handled in the most expedient manner. Criminal Cases and Restraining Orders need to be given top priority because of the right to a speedy trial and safety issues with restraining orders. However, the civil calendar cannot be ignored. I will make sure that the Court will do what it can to make sure every matter gets heard in a timely fashion. I am keenly aware that successful administration of the Municipal Court is dependent on the Court staff, not merely edicts from the Bench. Therefore, I believe it will be very important to have a staff of people dedicated to the same philosophies of fairness, respect, and understanding, and that they are treated in the same manner. 3.3.4 Other factors a. Current work obligations and ability to proceed promptly I currently have an active felony caseload. As I only handle Felony cases out of the Kalispell Police Department, I have no conflict of interest in any case that would be brought before the Municipal Court. I informed the office of my intent to seek this position in June of this year. Mr. Corrigan has been making changes in the office to ensure that all of my cases will be covered if I am selected. b. Willingness to abide by the City's needs and requirements with few or no objections or changes I am familiar with how the Municipal Court operates. I believe that the Court as it is currently run is very efficient. If I am selected, I do not intend to make any major changes. I would plan on meeting with all of the court personnel and inquiring if they see any areas that need improvement, and if improvements can be made without disruption, I would entertain them. C. Relevant factors impacting the quality and value of service I am familiar with how the Office of the Public Defender and the City Attorney's Office operate. I have positive relationships with members of the defense bar along with the City Attorney's office and the Kalispell Police Department. I believe these relationships will facilitate a positive and professional atmosphere in the courtroom.
