1. Council Minutes - Regular Meeting - November 5, 2012Also present: City Manager Doug Russell, City Attorney Charles Harball, City Clerk Theresa White, Police Chief Roger Nasset, Fire Chief Dave Dedman, Public Works Director Susie Turner, Finance Director Rick Wills, Planning Director Tom Jentz, Community Development Manager Katharine Thompson, and Deputy City Clerk Judi Funk. Mayor Fisher called the meeting to order and led the Pledge of Allegiance. There was no discussion. 1. Council Minutes — Regular Meeting — October 15, 2012 2. Contract Approval — Engineering Services — SID #345 Special Improvement District #345 was created on October 15 to help fund storm water improvements in the Willows Subdivision. Staff recommended the engineering contract be awarded to Morrison-Maierle. 3. Firefighter Confirmation Brent Councilor has completed his probationary period with the Kalispell Fire Department and council confirmation was requested. 4. Proclamation — National Hospice and Palliative Care Month There was discussion regarding the engineering services contract. The motion carried unanimously upon vote. None. Kalispell City Council Minutes November 5, 2012 Page 1 The city council accepted public comments concerning the expansion of the West Side Tax Increment Financing District. Mayor Fisher opened the public hearing. Mike Kazmier, Avail-TVN, remarked his company received an allocation from the Airport TIF and that his company continues to grow because of it. He said he is very much in favor of expansion of the West Side TIF district. Kelly Danielson, Montana West Economic Development and Flathead County Economic Development organizations, commented this is an action plan for revitalization and new investment in the core area. Pam Carbonari, Kalispell Downtown Association, spoke in support of the boundary expansion, stating TIFs are some of the most significant financial tools available to local governments. Richard Kuhl, 867 North Main, detailed his concerns regarding expansion of the TIF and suggested the council agree to disburse funds back to the county and school district if the railroad tracks can not be moved. Mayor Fisher closed the public hearing. (Letters received prior to and during the public hearing are attached hereto and made a part of the official record) The city council accepted public comments concerning the development of Depot Place, an affordable multi -family rental housing complex at 249 East Center Street. Mayor Fisher opened the public hearing. Alex Burkhalter, Sparrow Group Vice President of Development, offered to answer any questions regarding the senior housing complex. Mayor Fisher closed the public hearing. Ordinance 1717 expands the boundaries of the West Side Tax Increment Financing District to coincide with the West Side Urban Renewal District to create a financing tool for possible redevelopment of the city's core area neighboring the railroad tracks. Kalispell City Council Minutes November 5, 2012 Page 2 Russell gave a report and staff answered questions. approving a proposed modification to the boundaries of the Kalispell West Side Tax Increment Financing District. The motion was seconded. Council Discussion Hafferman commented he will vote against the ordinance because the West Side TIF is complete and the money should be disbursed. Guiffrida remarked this will create good business incentives and the council always has the ability to disburse the funds in the future. Kluesner said he is in favor of the ordinance, but would like council input about the possible redistribution of funds in the future. Atkinson stated it is a matter of timing on when to disburse the funds, but for now this is a way to assist Kalispell with redevelopment. Saverud agreed, noting this is an opportunity to put our fingerprints on the city. Mayor Fisher said this is a tool to utilize private and public investment and the city will stagnate if there is no vision for the future. The motion carried upon roll call vote with Atkinson, Gabriel, Guiffrida, Kenyon, Kluesner, Saverud, Zauner and Mayor Fisher voting in favor, and Hafferman voting against. I V2. RESOLUTION 5595 — PRELIMINARY PLAT EXTENSION — GLACIER TOWN CENTER PHASE I This is a request for a two-year extension of the preliminary plat for phase I of Glacier Town Center, a 485-acre site between Highway 93 North and Whitefish Stage Road. Jentz gave a report and answered questions. None. Saverud moved Resolution 5595, a resolution approving a two-year extension to the preliminary plat of Glacier Town Center Phase 1. The motion was seconded. None. Kalispell City Council Minutes November 5, 2012 Page 3 Montana Mapping Associates has submitted an amended plat to adjust the boundary lines for two lots located off Mile High Court. Staff is recommending the council approve the amended plat which abandons a portion of the right-of-way and accept new right-of-way. Jentz gave a report and answered questions. Rick Breckenridge, project Surveyor, stated the hammerhead turnaround was accidently built backwards. way and accepting new right-of-way for Mile High Court. The motion was seconded. Ll= I Guiffrida remarked the owners are trying to fix some issues with the plat and this is just a housekeeping matter. Mayor Fisher commented her law partner owns the property and therefore she will abstain from the vote. The motion carried upon roll call vote with Atkinson, Gabriel, Guiffrida, Hafferman, Kenyon, Kluesner, Saverud, and Zauner voting in favor, and Mayor Fisher abstaining. U/4. RESOLUTION 5596 — AMENDS BUDGET RESOLUTION 5580 — MILL LEVA CORRECTION The city levy approved by council on August 20 did not include a reimbursement from the State of Montana related to the reduced business equipment tax. Russell reminded everyone to get out and vote tomorrow. Mayor Fisher also encouraged everyone to vote and "spend your vote as wisely as you do your money." The meeting was adjourned at 8:08 p.m. Theresa White City Clerk Kalispell City Council Minutes November 5, 2012 Page 5 K LISPELL Providing Economic, Community, and Workforce Development Services www.kalispellchamber.com November 5, 2012 The Honorable Mayor Tammi Fisher and Members of Kalispell City Council City of Kalispell 201 First Avenue East Kalispell, MT 59901 Re: Support for Ordinance No. 1717 — An ordinance to expand the Westside tax increment financing district to overlay the Westside urban renewal district Dear Mayor Fisher and Members of City Council: On behalf of our Board of Directors and membership, I would like to express the support of the Kalispell Chamber of Commerce for Ordinance 1717, modifying the boundaries of the Westside Tax Increment Financing District (Fund) to overlay the Westside Urban Renewal District (District). The Kalispell Chamber has long -supported the goals of the Westside Urban District and the tax increment fund that has been used to achieve those goals. In February 1997, the Chamber supported the formation of the District and the Fund citing the beneficial impacts that the planned infrastructure improvements would have on the economy and the community. Many, but not all, of the goals for the District were accomplished over the years. Consequently, in October 2011, we supported amending the District to encompass the historic railroad yard in order to achieve long -held community goals for the downtown area. Additionally, in January 2012, the Chamber supported the request of the Urban Renewal Agency for projects to amend the District. Tax increment funding has been used for good effect in the Westside District. Funds used for the acquisition and remodel of the TeleTech space and for related improvements, and transportation and storm water improvements have strengthened our community and the overall business climate. The Core Area Plans your staff presented at our August Luncheon are an exciting vision for a vibrant downtown. We appreciate your foresight in taking steps that will accelerate the growth, investment, job creation of Kalispell. We look forward to working with you to fully -achieve the goals for this important District in the City.
