Plat Amendment - Mile High CourtPLANNING FOR THE FUTURE M01VTA1VA JLJ REPORT TO: Doug Russell, City Manag r 1 FROM: Sean Conrad, Senior Planner Planning Department 201 1" Avenue East Kalispell, MT 59901 Phone: (406) 758-7940 Fax: (406) 758-7739 www.katispell.com/planning SUBJECT Mile High Court right-of-way abandonment and dedication MEETING DATE: November 5, 2012 BACKGROUND: Montana Mapping Associates, Inc. has submitted an amended plat to adjust the boundary lines for two lots located off of Mile High Court. A boundary line adjustment is typically an administrative process however this boundary line adjustment requires the city council to abandon an approximately 519 square feet area of city right-of-way for Mile High Court and accept 1242.99 square feet of new right-of-way for Mile High Court. The physical street, Mile High Court, will not be impacted by this amended plat. In January of 2010 the city council approved the final plat for the 7 lot residential subdivision off of Denver Avenue. As part of the fmal plat approval the city council accepted the street and street right-of- way for Mile High Court. The requested boundary line adjustment is between lots 4 and 7 of the subdivision and will correct the following two issues related to the street right-of-way: 1. Area to be abandoned (Shown in yellow on the attached mQ). The owners of lot 4 inadvertently placed a shed, constructed on a concrete slab, and six-foot privacy fence within the Mile High Court right-of-way. The difficulty in moving the shed and fence has prompted the owners of lot 4 to request an approximately 519 square foot portion of the Mile High Court right-of-way to be abandoned. Abandoning the right-of-way will permit the shed and fence to remain in place. The existing edge of pavement, curb and sidewalk will still be within the right-of- way. 2. Area of proposed right-of-way dedication (shown in green on the attached map,) The amended plat would expand the Mile High Court right-of-way to include an area of 1242.99 square feet which will correct an error in the location that Mile High Court was actually constructed. The land for new right-of-way would come from lot 7. After the council approved the final plat and accepted the street right-of-way for Mile High Court it was determined the physical location of the street did not match up to the right-of-way shown on the final plat. Therefore, the amended plat will correct the error in the street location as it relates to the right-of-way. No physical changes will be done to the street. RECOMMENDATION: A motion to approve the amended plat thereby abandoning a portion of the right-of-way and accepting new right-of-way for Mile High Court. FISCAL EFFECTS: None. ALTERNATIVES: As suggested by the city council.
