SUBJECT Amendments to the Lighting Standards - Kalispell Zoning
Ordinance

BACKGROUND: This is a request by the City of Kalispell to amend the recently
adopted lighting regulations. These changes are being proposed by the staff as
result of working with the regulations over the past couple of months. The proposed
amendments are rather minor in nature but are intended to address some problem
areas.
The Kalispell .Manning Board held a pubhc hearing on the natter at their regular
meeting of October 11, 2005. Because of Interest expressed by certain members of the
public, the planning board held a subsequent work session on the matter on October
25, 2005. At the planning board meeting and work session the board discussed the
changes as well as other issues relating to the bighting standards.
In response to public comment and public participation at the public hearing and at
the work session, the board . thoughtfully considered the current policy regarding the
replacement of non-confornAng lighting. After significant discussion and mirror
additional amendments, the board felt the current and proposed changes to the policy
re ar .ar non-conformm'g lighting Is an appropriate and reasonable policy in
addressing the issue.
At their regular meeting of November 8, 2005, the p am ng board acted on the
amendments to the hghting standards that resulted in some cages and "fore tuning"
in addition to those recommended by the staff. The substantive changes are as
follows:
Amending the full cutoff leas from 70 degrees above the horizontal plane to 8
degrees above the horizontal plane. This is because of problems obtaining a 7
degree cutoff fixture.

Amending the maximum height of a light pole from 30 feet In height to 25 feet in
height. This is to compensate for the greater light distribution gained from an 80
degree cut-off lens.

Amending the requirement irement .for .o - on o=ing commercial lighting to allow
replacement of the lens to a full cutoff lens and not the light pole. This is primarily
because of the expense involved � replacing light poles and reconfiguration of the
light distribution pattern.
Some other changes involve clarification regarding how the light pole height and the
level of light are measured. An exemption to the height ,wit for sports and recreation
fields is also being proposed..
RECOMMENDATION: A motion to approve the first reading of the ordinance for
changes to the lighting standards would be in order.

action.

AN ORDINANCE AMENDING THE KALISPELL ZONING ORDINANCE (ORDINANCE NO.
1460), BY CREATING NEW CRAPTER 27,22A. [ I R LIGHTING STANDARDS,
DECLARING AN EFFECTIVE DATE, AND AUTHORIZING THE CITY ATTORNEY TO
CODIFY THE SAME,
WHEREAS, on August 1, 2005, the City Council of the City of Kalispell passed Ordinance 1546,
amending the Kalispell Zoning Ordinance (Ordinance to incorporate standards for
outdoor lighting that would apply to both commercial and presidential development, and
WHEREAS, the City of Kalispell has submitted a Written request to amend Section 27.22.104,
Outdoor Lighting Standards, of the Kalispell Zoning rdinanee, by creating
chapter 27.22A, removing them from the Supplemental Regulations, and .r akin �r
changes, and
WHEREAS, EAS the request was forwarded to the Kalispell City Planning Board and Zoning Commission
by the Kalispell Planning Department after having been evaluated under 27.30.020,
Kalispell Zoning Ordinance, and
WHEREAS,, E S� the Kalispell City Planning Board and Zoning Commission recommended that the text of
the Kalispell Zoning; Ordinance be amended by adding new Chapter 2 .22A., Outdoor
Lighting Standards, and making minor changes, and
WHEREAS, the City Council has reviewed the KPD Report and the transmittal from the Kalispell City
Planning Board and Zoning Commission and hereby adopts the findings made in Report
#KZTA-05-7 as the Findings ac applicable to this Ordinance.
NOW, THEREFORE, BE fT ORDAINEDY THE CITY COUNCfL OF THE CITY OF KALfSPELL
AS FOLLOWS:
SECTION I. The City of Kalispell Zoning Ordinance, Ordinance No. 1460, is hereby
amended as follows on Exhibit "A"", attached hereto and thereby madie a
part hereof.
SECTION II. All parts and portions of Ordinance No. 1460 not amended hereby
remain unchanged.
SECTION III. This Ordinance shall take effect thirty 3 days after its final passage.
SECTION IV. The City Attorney is hereby authorized and directed to reeodi y this
Ordinance.
