MILD FENCE CO. agrees to do all the above work in a good workmanlike manner.
We do not accept American Express or credit card payment by phone.
It is further agreed that time shall be the essence of this agreement, and that in the event any default be made in the payments hereinbefore required to be made, the total
amount then due hereunder shall become due and payable forthwith without notice.
This agreement shall not be binding upon the contractor until signed by him in writing. All unused materials shall, under any conditions, remain the title and property of the
contractor. A fence permit, if required, must be obtained by the owner. Owner responsible for restrictions or covenants on property.
It is further agreed that contractor shall not be liable for delays caused by weather conditions, obtaining materials, or any other causes beyond his control.
Owner agrees that in the event of cancellation of this contract before work has started, owner shall pay to contractor on demand twenty-five (25%) percent of the contract price
as its stipulated damages for the breach. Verbal agreements other that those expressed on this contract are not binding.
Fence will be built to average general grade in disregard to unevenness of ground. Fence will be erected on lot line when stakes can be found. If no stakes can be located, it
will be the responsibility of the property owner to determine his property line. If survey is necessary, the property owner is required to pay for that service.
MILD FENCE CO. will not be responsible for damaging unmarked private underground lines such as sprinklers, power, septic, etc. Costs to locate private lines are
owners responsibility. MILD FENCE CO. will notify UDIG for underground utility locates.
ACCEPTED: TERMS: 1 1I2% PER TH FINANCE CHARGE ON ALL PAST DUE AND BALANCE ACCOUNTS.

This easement dated the day of December 2004, by and

FAMILY LDAI D PARTNERSHIP of 2 17 Ridge Trail, Bozeman, Montana 59715, as GRANTOR,
and the City of Kalispell, a municipal corporation, County of Flathead, State of Montana, as
GRANTEE.
That for good and valuable consideration, the receipt of which is hereby acknowledged, the
GRANTOR does hereby convey, grant and give in perpetuity to GRANTEE an easement over,
across, in and under the following described premises located in the W % of Section 20, Township
28 North, Range 21 west, P.M.M., also known as Lot 2 of Oretana Subdivision and more
particularly described as follows:
A Sixty (60) foot wide strip of land, which westerly boundary runs the length of and
is the westerly boundary of Lot 2 as described in the Final Plat of Gretana
Subdivision of record in the Clerk and Recorders office, Flathead County, Montana.
To have and to hold the same unto said GRANTEE,, its successors and assigns forever.
The easement herein granted for the purpose of providing the City of Kalispell the right to
erect and maintain a fence to secure access to the Kalispell City Airport and for egress and ingress to
construct, maintain, repair and remove said airport fencing upon and within said easement.
The GRANTEE hereby covenants that construction or repairs shall not proceed without prior
notice to the GRANTOR T`OR. and that following any construction activity within the easement herein
granted, whether for initial installation or for the repair, maintenance, replacement or removal of said
facilities, the site shall be restored and repaired to the same condition as said area existed prior to
GRANTEE's construction activity.
