I understand from your email on 3/20/08, and discussions with Ryan, that you are making progress
on the KGEZ tower relocation sites. You raised the question of the need for an FAA Preapplication
for FY08.
My understanding was that the FAA's position is that funding would not be released for any projects
until after the towers had been mitigated. Since this is not likely to be accomplished by their June
1s` deadline I had not planned on a Preapplication. However, I wanted to make sure about the
nuances and timing and what a condemnation decision would do for you. So I had a telephone
conversation with Gary Gates about it, because I know it is important for you to get cash flow
moving as soon as possible. Below is the summary of my conversation with Gary. He suggested a
telephone conference to go over these topics.
- Your Non -Primary Entitlement (NPE) funds must be used on the tower mitigation first and
foremost.
- The land for the towers must be in place, EA completed, and tower relocation bids received
prior to June 1 n for the FAA granting any funds.
- Also, you need an agreement with Mr. Stokes or a condemnation order from the judge with a
value determination.
- Once the towers are mitigated (land arranged, EA complete and towers condemned at a
minimum), the FAA will allow use of your NPE funds and some discretionary?? funding to
complete that phase.
- Then land needs to be acquired before any physical improvements can be reimbursed. The
FAA would allow you to break this land phase into two AIP projects in order be able to
participate in the land prior to it all being purchased (and give you some cash flow), but the
Sponsor would be obligated to reimburse the FAA that money if the remainder of the land
necessary was not acquired within a certain timeframe! The FAA would use State
Apportionment (SA) funding and likely any NPE funds you had available to accomplish this.
- Once the towers are mitigated and all the land is purchased, the FAA will begin funding
physical improvements. If you are required to use NPE funds all along the way, they will
surely be depleted and so SA funds would be used as they are available to fund new projects
like the runway itself. However, retroactive work (north end surfacing project) needs to be
funded with NPE funds and so that reimbursement may be a long time in coming.

we are supplying one copy 11"x17' format for your initial review. Following that, we would expect
to print five full sized copies of the set (with any changes you might have) for airspace review. We
will provide an electronic version of item #2 at that time for your use in transmitting the ALPS.
