What is a CATEX?
• A listed federal action that MAY not have an environmental
impact
• Based on past experience -
No significant effect on the human environment
Do not normally require an EA or EIS
Listed CATEXs are not automatically exempted from
environmental review under NEPA.
• Extraordinary Circumstances
Cte'lOr=a■ Eaxa=aas10I1
Categorical Exclusion Form:
— NOT a CHECKLIST! - -
- Supporting documentation/justification
• Agency coordination letters (FWS, COE, etc.)
• Wetlands --
• General Conformity Analysis _
• DrawingslMaps of project areas=
— A solid CATEX form will keep you out of trouble
and avoid unnecessary project delays.
Avoiding Pitfalls — Is project ready for NEPA .
analysis
• Is it on the ALP?
• Is the Purpose and Need still valid?
• Are the justification requirements met (500ops)?
• Are the eligibility requirements met?
• Is the funding likely?

CATEX Memo/ Letter 4
-Listed CATEXs with low risk and no extraordinary
circumstances.
-Usually internal to the Airports District Office
- Planning studies
SRE/ARFF purchases
Replace existing pavement
- No new ground disturbed
No expansion
Buying RPZ and Approach land (EA)
RPZ/approach... area must have
compatible land uses. AC5300-13,
para.212.e el
Order 1050.1 E, paragraph 310e
discusses safety runway areas in
this catex.
But impacts must remain on airport.
Buying RPZ and Approach land (cont.)
-Why isn't this a catex action?
-Land not on airport is needed.
-Therefore, effects would not occur on airport land.
-That doesn't meet the last provision (on -airport impacts)
-The purchase and clearing of land are connected actions
that could cause significant environmental effects.
EA content a
• Purpose and need
— Problem/ Solution
"Heart
WK-

• Alternatives of EA'
t
— Different ways to solve problem (sadsfl — -
• Affected Environment
=
— ONLY what project will affect
=
• Environmental Consequences
— What are impacts and their consequences
(can combine).
• Mitigation
— Conceptual vs. detailed?
• List of Preparers
• Appendices
— To provide source material for Information EA summadres.
Coordinate draft chapters EA/EIS early with
FAA, especially:
• purpose and need
• alternatives analysis
• environmental consequences
• technical appendices
EA Scoping
It is wise to discuss the action and
issues before we begin preparing the EA.
Helps ensure the EA addresses concerns of...
FAA (be pro -active)
Other agencies that will review action
Public
Possible controversial issues
Special studies/analyses/methods
Help sponsor decide on time needed to do this.
Used to develop the consultant's scope of
work for and EA's content.
Readability
• Consistent message and facts
• Project consistent throughout
• Clear and logical
• Define acronyms, terminology, and concepts.
Manageably -sized EA
15 to 30-page EA
KEY: Summarize most important
findings in the attached
appendices.
Provide accurate cross-
referencing.
Write it so it easily readable.
2
Building the appendices
Do analyses and coordination
with the agencies the special
purpose law requires.
Include the documentation the
special purpose law requires.
, intita
t'I a9
Develop the mitigation the special
the special purpose law
requires.
And...
NOTE ANY HIGHLY
CONTROVERSIAL ISSUES!!
Be sure the revised EA...
. Includes Information you determine
necessary based on comments from
agencies with Jurisdiction or expertise;
- addresses your comments;
addresses public comments, If any;
• addresses Issues of high controversy;
Is clearly written (remember your
audlencel I).
Time to do this?
Meet time limits the special purpose law requires for
consultation.
To streamline NEPA/sppecial purpose law
integration...provide an EA review time that equals the
maximum Ume an applicable special purpose law
requires.
Normally, this is 30 days = the time typically provided for
EA review.
Hopefully, entire process, including external and Internal
reviews ... 9-12 months or sooner.
PLAN ACCORDINGLY I
Then...
+Place the most pertinent information and
findings in the EA.
+Accurately cross-reference the appendix and
page number where an interested reader
can find the back-up for the findings.
+Be sure EA addresses requirements of FAA
Orders.
+Issue for public review, if needed.
FONSI...
Finding supported by information in attached EA.
Lists all mitigation
Conceptual or Detailed.
Detailed mitigation... need to explain clearly
why/how the mitigation eliminated the
significant impact).
Prepared for approving FAA official's signature.

FY 2009 Appropriation — so far ....
On September 30"', the President signed a six-month
FAA bill that extended aviation excise taxes and
programs from October 1, 2008 through March 31,
2009.
This bill also authorized $1.95B in AIP funding or YZ of
the $3.96 proposed in House and Senate
reauthorization proposals.
The President also signed a Continuing Resolution on
September 30 that temporarily funded the FAA and
other Federal agencies at FY 2008 levels from October
1, 2008 through March 6, 2009. This bill also
appropriated slightly more than $1.56 in AIP funds or
43% of the $3.56 approved by Congress in FY 2008.
FY 2009 Appropriation — so far ....
The 111 half of the FY 2009 AIP program will be 5
Months and 1 week. October 1 through March 6, 2009.
The 1" half program: After prorating the CR, fully
protecting LOI's and deducting costs for running the
AIP Program, Airports Research Program, and the
Small Community Air Service Development Program,
your current year entitlements will be approximately
30% of what you normally receive and carryovers from
previous years will be approximately 50%.
State Apportionment and Discretionary percentages
are still being determined.
NEXT STEPS For FY 2009:
• Allotment from OMB
• Finalize the Calculations (entitlement, state
apportionment, NPE's, carryovers, discretionary, set
asides)
• Notify Airports (By end of month?)
• Report Carryovers by 2/2/2009
• Submit Applications by 2/18/2009
• Issue and Obligate all Grants by 2/27/2009
S
OPTIONS (Unless Congress passes an Appropriation Bill
and extends our Authorization)
• Carry over entitlements to FY 2010
• Use available entitlements in 1st half program
• Hold entitlements past 3/6/2009 (some risk if Congress
does not pass 2nd half appropriation)
• If project requires all of is' and 2nd half entitlements,
then we could:
— issue a 111 half entitlement grant based on estimates and
then issue a 21d half grant (making up the difference)
based on bids.
• 1s' half Program —Don't expect any Discretionary,
except for LOI's, Noise, LPV surveys
Cautions...
Understand the funding available for your project.
Identify potential entitlement transfers early.
Based Aircraft Data will be required for Nonprimary
Airports (discretionary or state apportionment) — or no
grant (Federal Register Notice 9/08/2008, comments
were due on 10/08/2008)
No AIP grants will be issued if you have an overdue
Part 139 discrepancy (Contact your Cert Inspector).

Developing a Competitive CIP
• Show high priority work in years when discretionary
funding is requested.
• Plan for low priority work in years when no
discretionary funding is requested.
• Use the current year entitlement amount and a
"reasonable" amount of discretionary funding to
prepare CIP.
• Consider multi -year grants where appropriate.
• Identify work done in part or wholly with PFCs.
• Provide a coded sketch.
• Identify PCI for pavement rehabilitation.
Other Items to Consider
• Work items with a national priority below 45 will
generally not leverage discretionary.
• Current fiscal year discretionary candidate list is
normally submitted to HQ on June 1 of prior
fiscal year.
• Use Standard Description, ACIP Codes, and
National Priority Ratings table found in FAA
Order 5100.39A "Airports Capital Improvement
Plan" (and on Helena ADO Guidance CD).
• New construction has a lower priority than
rehabilitation. Generally will be difficult to obtain
discretionary for new pavement.
Examples of High Priority Work
• Acquire ARFF Vehicles
• Acquire Security Equipment or Install Fencing
• Improve ARFF Building
• Construct, Extend or Improve RSA
• Rehabilitate Runway, Taxiway or Apron
• Rehabilitate Runway or Taxiway Lighting
• Conduct Airport Master Plan Study
• Construct Deicing Containment Facility
Examples of Low Priority Work
. Construct Runway or Taxiway
. Extend, Widen, or Lengthen Runway or Taxiway
. Construct, Expand, or Improve Terminal
Building (unless security related)
. Acquire Snow Removal Equipment
. Construct or Expand Apron
. Acquire Friction Measuring Equipment
. Install Weather Reporting Equipment
. Construct, Expand or Improve SRE Building
. Construct Service Road
FAA Considerations
. Is the Sponsor planning to use entitlements and/or
multi -year funds?
. What is the priority of other work being funded?
. Is the project identified in the Regional Airport
Plan?
. Is the environmental complete and any permits
obtained and issues resolved?
. What is the Bid opening status?
. Performance in managing existing grants?
Other FAA Funding Considerations
ADO's must use flag priorities established by HQ:
LOI — Letter of Intent scheduled payments
. MAP — Military Airport Program
. NOISE — Noise set -aside
. 139 (Safety) — Required by FAR Part 139
. RSA — Runway Safety Areas
. RSAT — Runway Safety Action Team
. 1542 (Security) — Projects required by 1542
. Earmarks — Projects included in annual Conf. Report
. Phased — Project receiving prior year discretionary
