Minutes —January 24, 2005
The meeting began at 3:00 p.m. Present were:

1. The December minutes were approved.
2. HEAR THE PUBLIC —Tip Clark indicated that he is President of the Flathead Flyers flying club. The
club is happy to be at the airport and pledge their support for the ongoing work of the airport.
3. MANAGER UPDATE
a. The lease is signed with T & L Properties. They plan to build two bays of 10 T-hangars, and a
60'x180' hangar that will be three individual 60'x60' side -by -side hangars.
b. Goose Bay has signed their lease and a developer's agreement.
c. Penco & Murdock's have signed the easements to begin fencing the east side of the airport.
Fred has contacted Mild Fence & is looking at fencing part of the west side near the new City
hangar at the same time.
d. Lease meetings and land purchases discussions are ongoing with Monk, Red Eagle, Mike
Barrett & Dan Henderson.
e. There is nothing new on KGEZ.
f. Fred has been developing a document for the Minimum Standard Requirements for Airport
Aeronautical Services and will want the Council's input.
g. Fred went into detail regarding the area of influence and the work that will be needed to work
with the County as we move forward.
h. Fred distributed the attached proposed timeline for surface improvements. Windy Ridge
Construction, Inc., Bob Johnson, P. O. Box 490, Plains, MT 59859 received the contract.
4. Fred & Scott have been working on possible funding legislation based on Montana Code. See attached
background document.
5. Three possible Council members were interviewed for the two open positions. All were extremely good
candidates and offer experience and expertise that will benefit the Council. Tom Alison & Rod Bitney
have been selected. Rod will be asked to serve on the on the architectural review committee. The third
person interviewed, Todd Worthlin, will also be asked to serve on the architectural committee and to
work with Jim on other projects on a consultant basis.
6. Pati distributed the material from Dan Snyder regarding the architectural committee.
7. A recommendation to the City Manager to change the name of the airport to "Kalispell Airpark" was
approved unanimously.
8. The web site was brought up again. Pati indicated that she had given the materials she had to Jim &
Fred.

This schedule gives us some slack time, one week before our deadline to have it
done JAW the T & L Properties Lease Agreement.

Background
Under Montana Code 67-10 and 67-11 counties and municipalities are authorized to levy
a tax on their residents to support airports or airport authorities (67-11-301 & 302) in their
jurisdictions. Those funds collected by a municipality are for the purpose of establishing,
constructing, equipping, maintaining, and operating airports, landing fields and ports ... (67-10-
402).
There are nine (9) Primary and commercial service airports in the State of Montana that
are considered part of the National Plan of Integrated Airport Systems (NPIAS) and are
supported by the Federal Aviation Administration (FAA). There are 63 reliever and general
aviation airports in the State of Montana that are considered part of the NIPIAS and are
supported by the FAA. All NPIAS approved airports should be entitled to support from taxes
levied pursuant to 67-10 and 67-11.
Problem # 1:
A county is now authorized to levy a countywide tax on property of that county for the
purpose of supporting airports or airport authorities (67-11-302). However, a municipality within
that county is not allocated any of that countywide levy for the support of its NPIAS approved
airport even though its residents are assessed the county's airport tax. While it is true that the
municipality within the county uses the airport supported by the countywide levy, it is also true
that countywide residents utilize the municipalities' airports within the county.
Solution # 1:
An equitable and efficient distribution of countywide taxes levied for airports in that
county should include all NPIAS approved airports within that county, whether owned by the
county, its airport authority, or a municipality within that county. (Even though a municipality
may be authorized to assess its residents for its airport support, such a tax would be unfair and
result in city residents paying double taxation for airport support if the county already is
assessing all residents for airport support.)
Problem #2:
How should airport tax levy finds be distributed?
Solution #2 :
The percentage of county tax levy which is assessed on property within the municipality
for airport support should be distributed back to the municipality's governing body for the
support of its NPIAS airport.
Alternate Solutions:
If a municipality that owns a NPIAS approved airport exercises its right to levy its
residents for airport support and maintenance, the county can not assess another airport tax levy
on the residents of that municipality.
