The applicant has applied to the City of Kalispell for a conditional use permit to expand a
existing retxrem nt home, adding 28 beds and an accessory apartment, in the -1, Healt.h Care zone.
The Kalispell City Tanning Board and Zoning Commission, after due and proper notice, on
August 9, 2005, held a public hearing on the application, took public comment and recommended
that the application licatio e approved subject to eight conditions.
After reviewing the application, the record, the Kali -spell Planning Department report, and
after duly considering the natter, the City Council of the City of Kalispell, pursuant to the Kalispell
Zoning Ordinance, hereby adopts Kalispell Planning Department Conditional Use Report KC -o -
as the C nci 's findings of fact, and issues and grants to the above -described real property a
conditional use permit t e� and an existing retirement hone in the H-1., ealt dare or�in district
subject to the following con.d.t.ons:
1. The proposal will be developed in substantial conformance with the approved site plan and
other application materials. That the conditions associ
.ated with this pennit shall be met prior to
use of the ild.n�s.
2. The applicant comply with all building and fire codes prior to occupancy of the building.

3. The sidewalk along the north side of the driveway on Commons Loop shall be connected with
the public sidewalk in the right-of-way. The sidewalkhall meet ADA standards, including
zz
slopes.
. That a five 5) foot sidewalk be constructed in the public rbt-o vay along the applicants; site
fronting Heritage Way. Said wally shall comply with the Kalispell Standards for Design and
Construction and connect the existing sidewalks on Commons Loop and Windward Way.
. The applicant shall construct curb and gutter for the site's frontage along Heritage Way. Said
work shall comply with the Kalispell Standards for Design and Construction. If the Kalispell
Public Works Department deems that it is not in the best interest of the City to install these at
this time,, they shall state so in writing; and the applicant shall waive the right to protest an SI
to construct those items.
. An additional four spaces shall be added to the overall parkin; plan to brink; the total to 8L
Several spaces may be obtained by removing the temporary storage buildings from the rear
parking lot. If all storage is removed from the parking lot, only two 2 spaces are required.
The applicant must amend or eliminate the 30-foot road and utility easement on the west side o
the lot to eliminate interference with the proposed construction.
. The conditional use permit is valid for a period of 18 months from the slate of authorization
Ater which time if the commencement of activities has not occurred the permit shall be void. ,A
continuous, good faith effort to design the building, obtain financing and other activities shall
be considered a commencement.
