Resolution 5564 - Preliminary Plat Extension - West View Estates Phase 4Planning Department 201 1" Avenue East Kalispell, MT 59901 Phone: (406) 758-7940 Fax: (406) 758-7739 www.katispell.com/planning REPORT TO: Kalispell Mayor and City Council FROM: Sean Conrad, Senior Planner Charlie Harball, Interim City Manager SUBJECT West View Estates Phase 4 — Request for two year preliminary plat extension MEETING DATE: June 4, 2012 BACKGROUND: This is a request by Sands Surveying, Inc. on behalf of Owl Corporation for a two- year extension for phase 4 of the preliminary plat of West View Estates, Phase 4. The West View Estates subdivision is a six phase residential subdivision approved on May 5, 2003 by the Kalispell City Council subject to 20 conditions. West View Estates is located at the northeast corner of the intersection of West Reserve Drive and Stillwater Road. The subdivision includes approximately 60 acres with a zoning designation of R-3, Residential, on 50 acres and RA-1, Residential Apartment, on 10 acres located in the southwest corner of the subdivision. The West View Estates subdivision includes 129 single-family lots and one 10-acre parcel that would later be developed most likely with duplex, townhouse or multi -family dwellings. The Kalispell City Council granted final plat approval for phases 1 and 2 on August 21, 2006 and phase 3 on July 20, 2009. Phase 4 would plat 8 single family residential lots along Lorries Road, shown on the attached preliminary plat. The Kalispell Subdivision Regulations require subsequent phases to be filed within two years of filing the final plat for the previous phase. Phase 3 was filed in July of 2009, in 2011 the developer requested a one-year extension from the city council which was granted and gave the developer until July 20, 2012 to file the final plat for phase 4. The Kalispell Subdivision Regulations, section 2.06.E.7, allows the subdivider to request a two-year extension of the preliminary plat, or a phase of the preliminary plat approval deadline from the city council. The two-year extension request would give the developer until July 20, 2014 to file the final plat for phase 4 or appeal to the city council for one final extension not to exceed two years. RECOMMENDATION: A motion to adopt the resolution and grant a two-year extension to the preliminary plat approval for phase 4 of West View Estates Subdivision would be in order. FISCAL EFFECTS: Minor positive impacts once fully developed. ALTERNATIVES: As suggested by the city council. The final plat of Phase 3 was approved by approved by Kalispell City Council on July 20, 2009. The City Council granted a one year extension in May of 2011 extending the approval to July 20, 2012. As we were working with the two year approval window between phases, we have only had three year thus far for Phase 4 and is the reason we are requesting the two year extension. The applicant has invested substantially in the West View development but at present there is still a large supply of lots available and it does not make sense to proceed with the next phase. We are hopeful that market conditions will improve over the next two years thereby reducing the supply lots so we can proceed with phasing.
