Box 1997 Kalispell, Montana 59903-1997 (406) 758-7000 Fax (406)7757 REPORT TO: Honorable Mayor and City Council FROM: Terry Mitton, Director of Human Resources SUBJECT: Adoption of revised AFSCME Pay Grade Definitions & Pay Matrix MEETING DATE: April 2, 2012 BACKGROUND: In December of 2010 the City and the represented employees of the American Federation of State, County and Municipal Employees (AFSCME), AFL-CIO reached a three (3) year agreement. In the agreement there were no scheduled cost -of -living raises with the exception of their scheduled longevity increases as in the past. Labor/Management meetings language was also added to create a more "constructive and cooperative" relationship between the Union and Management. As consideration, the contract carries the requirement that a Labor/Management Committee review the definitions within the grades and propose adjustments to the associated pay that is commensurate with the required job duties. After considerable discussion and work by the committee an agreement was tentatively reached and subsequently voted on and ratified by the membership. This agreement would become effective June 15, 2012 and extend until June 30, 2014 and will: • Create a more comprehensive set of rules and defined steps required for advancement within the various pay grades. • Separate supervisors into their own defined pay grade structure. • Establish a "newly hired" employee base pay which will be 90% of the entry level wage for the first year. • Recognize a "Lead Person" designation that will assist supervisors, on select projects. • With management approval, allow employees to receive recognized training and subsequent certification pay which will benefit both them and the City. In the event every AFSCME employee meets the criteria for a new grade the financial impact to the City would result in an estimated 2.5% increase to overall wage costs in the first year and 7% increase in the second year. RECOMMENDATION: Staff recommends approval of a motion to adopt the new AFSCME Pay Grade Definitions and Matrix with the City of Kalispell for the existing contract. vely submitted, Terry Mi on Human esources Director ChAAc59146baff Interim City Manager BETWEEN CITY OF KALISPELL AFSCME MT - Council I AFL-CIO Local 1 t; THIS AGREEMENT is entered into this day of April, 2012, by and between the City of Kalispell [hereinafter "the CITY"] and the AFSCME MT, Council 9, AFL-CIO, Local No. 256 Labor Union [hereinafter "AFSCME"]. RECITALS WHEREAS, on the 8th day of December, 2010, the CITY and AFSCME entered into a Collective Bargaining Agreement [CBA] for the term of July 1, 2010 to June 30, 2013; and WHEREAS, the above described CBA contains an Article VI, Section VI regarding additional grades and job classifications in which the parties agreed that "A. Additional grades, grade -placement and /or job classifications will be reviewed by a Management/Union Committee; and B. All requirements and/or certifications, with associated rates of pay for the upgraded job classification will be determined by the Management/Union Committee"; and WHEREAS, a Management/Union Committee has been meeting and discussing a matrix system that contains additional grades, grade placement, job classifications with requirements and/or certifications, with associated rates of pay for upgraded job classification, pursuant to the contract; and WHEREAS, the Management/Union Committee has reached a matrix proposal for the consideration of the AFSCME membership and the CITY which it has determined to be in the best interests of both parties. NOW THEREFORE, the parties agree as follows: Pursuant to the terms of the CBA and in particular Article VI, Section VI, the parties have the authority and were directed to meet, discuss and amend the CBA, during its term, for the purpose of constructing a complete pay matrix containing and defining grades, grade placement, job classifications with requirements and/or certifications, with associated rates of pay of upgraded job classification. 2. Attached hereto as "ADDENDUM A" is the AFSCME Pay Matrix as proposed by the Management/Union Committee and hereby accepted by the parties and incorporated into the CBA. MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF KALISPELL AND AFSCME MT - Council 9, AFL-CIO Page - I 3. The pay matrix shall be divided into two terms, the first beginning June 15, 2012 and running until June 14, 2013; and the second beginning June 15, 2013 and running until June 30, 2014. 4. Attached hereto as ADDENDUM B are additional job descriptions that are incorporated into the pay matrix and which add to or replace job descriptions that were in place at the time the CBA was executed. These job descriptions are accepted by the parties and hereby incorporated into the CBA. 5. For and as additional consideration for this agreement, the parties further agree that the reopener provisions set forth in Article XV Section V. shall be amended to delete Paragraph B of that section regarding economic reopener. 6. The parties further agree that, pursuant to the CBA, the City Manager has the authority, upon consultation with the City Council, and the President and Secretary of the Union has the authority, upon consultation with the membership, to execute this agreement which shall then be binding upon the parties. 7. If any section, subdivision, paragraph, sentence, clause, phrase or other part of this Memorandum of Understanding is determined or declared to be contrary to or in violation of any State or Federal Law, the remainder of this Agreement shall not thereby be affected or invalidated. Merit pay for certifications will only be paid for relevant certifications applicable to the job the employee is performing and which has been pre -approved by the Director. 5. Advancement to the next level will require the approval of the Department Head, HR Director and City Manager. 7. All pay grade advancements will require the review and approval of the City Manager. 8. Unless specifically defined, merit pay for certifications which are not specifically noted in the pay grade matrix will be paid at the rate of $.25/hr per certification. 10.
