6. Authorize Reduction - Subdivision Improvement Agreement
Planning Department 201 1" Avenue East Kalispell, MT 59901 Phone: (406) 758-7940 Fax: (406) 758-7739 www.kalispell.com/planning REPORT TO: Kalispell Mayor and City Council FROM: Sean Conrad, Senior Planner Charlie Harball, Interim City Manager SUBJECT Reduction of Subdivision Improvement Agreement MEETING DATE: March 19, 2012 BACKGROUND: On February 5, 2007 the Kalispell City Council gave preliminary plat approval for a 7 lot residential subdivision proposed by the Violence Free Crisis Line. The subdivision, referred to as the Resubdivision of lot 1 of the minor subdivision plat #117, is located on both the east and west sides of Denver Avenue at 60 Denver Avenue. The subdivision site is zoned R-3, Residential, with a PUD, Planned Unit Development, overlay zoning district. One of the conditions of approval the council placed on the preliminary plat was to upgrade both the east and west sides of Denver Avenue to current city street standards. This includes curb, and gutter, sidewalks and street trees. The subdivision received final plat approval in January of 2011. The majority of the improvements for the subdivision had been installed when the council approved the final plat. A Subdivision Improvement Agreement (SIA) was submitted with the final plat application for the completion of the following items: • Sidewalk on the east side of Denver Avenue • Curb and gutter on the east side of Denver Avenue • Boulevard landscaping and street trees on the east side of Denver Avenue • Fire hydrant • Mail box • Crosswalk marking The cost to complete all of the items listed in the SIA is $41,490.45. The developer requested and the city council approved a property escrow agreement covering all 7 residential lots to provide for the security of funding in the SIA. The improvements are to be completed by June 21, 2012 unless the improvements are waived by the city council or the SIA is extended. The Violence Free Crisis Line has requested the improvements to the east side of Denver Avenue and the crosswalk marking be removed as a requirement of the SIA. A letter sent to the Public Works Department from Charles Lapp dated January 30, 2012 notes that due to the slope of the land on the east side of Denver Avenue considerable manipulation of the land would be required to install curb, gutter and a sidewalk. In a memo from the Public Works Director he recommends the council consider not requiring curb, gutter and sidewalk on the east side of Denver Avenue. The memo states that for curbing (and gutters) it appears that such infrastructure is unnecessary and undesirable. For the sidewalk the director cites safety issues associated with constructing a sidewalk immediately adjacent to the steep slope. The memo notes that a guard rail and retaining wall would likely be required to install the sidewalk. A memo from the Parks Superintendent states that if curbing is not installed along the east side of Denver Avenue the Parks and Recreation Department would recommend against requiring street trees along the same stretch of road. The memo states that the Parks and Recreation Department has a policy to install street trees where there is a barrier, in this case it would be the curb, to protect or deter vehicular traffic from running over the street trees. In the absence of a curb, the street trees should not be installed. The crosswalk marking was placed as a condition of the PUD in lieu of installing sidewalks around the "T" intersection at the end of Mile High Court. The "T" intersection ends at lot 7, which was anticipated to be a future safe house and shelter. A parking lot was proposed directly west of the "T" intersection and the crosswalk marking was intended to delineate a walking path through the street and parking lot. The Violence Free Crisis Line no longer owns lot 7 and therefore city staff is recommending the city council remove the requirement for crosswalk marks. Regarding the remaining two items listed on the SIA, the fire hydrant and mail boxes, the need for an additional fire hydrant was deemed unnecessary by the Fire Chief. Therefore, this cost is no longer needed in the SIA. The developers intend to install the mail box for the subdivision in the coming months, before the June 12 expiration date. If the council decides to remove the requirements for the improvements on the east side of Denver Avenue and crosswalk marking, the new SIA amount would be $1,500. This amount reflects the financial security of 125% of the estimated cost to purchase and install the mail boxes as required in the SIA. RECOMMENDATION: A motion to waive the requirements to complete improvements to the east side of Denver Avenue, eliminate the need for crosswalk markings and reduce the amount of the SIA to $1,500 would be in order. FISCAL EFFECTS: None. ALTERNATIVES: As suggested by the city council. Over the past number of weeks, Charles has been in discussion with the Public Works Department and has come to discover that several of the items may be reduced or eliminated at this time. We have explained to Charles, to the best of our recollection, what has transpired to this point. He will be submitting a more formal and technical request along with this letter. Curbing: With respect provision of curbing along this roadway: it appears that such infrastructure is unnecessary and undesirable. The road infrastructure is free draining to the east as currently built. There is no advantage in collecting the drainage in a gutter just to dispose of it at the north end, where volume and velocity would likely be sufficient to create erosion of the Ashley Creek bank; now runoff is displaced to the immediate pavement edge and, under most storm conditions, percolates into the soils. Storm water treatment issue are inexpensively mitigated, because constituents are not collected and concentrated }Att.E t1tG Figure 3 shows the receiving area. Approximate location of east side of subdivision Sidewalk: For much of the route along Denver Ave. any sidewalk would likely have align with the east curve of the roadway and, at many locations, be close to the driving surface to avoid the steep slopes along Ashley Creek. At the location shown in Figure 3 (shown also in Figure 4) a retaining wall and guard rail would likely be necessary; also, at this location a curb would be necessary to sep, the driving surface and the sidew; Due to the safety issues associatE with a sidewalk immediately adj; to steep slope and higher than ordinary expense to mitigate the danger, it appear that a sidewalk this location is not desirable. Our department understands that Public Works, in this case of the Abigail Subdivision, is not going to require a typical street profile on the east of Denver Avenue that abuts the parkland dedication. Our policy is that if there is not a barrier, a curb in this case, to protect or deter vehicular traffic from running over trees, we generally do not plant trees there.
