The Flathead County Plarming & Zoning Office is issuing this permit under the provisions of the Flathead County Floodplain and Floodway Management Regulations. Tonya Wells with WMW Engineering contacted Montana DNRC about amending Floodplain Perrriit #FDP- 05-15 to change the private access road to a public crossing. On October 19, 2006, Montana DNRC comm-ented-in an email-tharthe -data -submitted was -reasonable -enough- to -issue--apernlit-for-a public crossing. The email firther stated that the HEC—RAS model and floodplain elevations can not be considered accurate enough for floodplain mapping purposes. Location: The proposed project is in Floodplain Zone A according to FER.M Panel 300023-1805 D Revised September 30, 1992. The project is located at 131 Second Street West, west of Kalispell, and is further described as Tracts I 1H, III and I IIA in Section 13, Township 29 North, Range 22 West, P,M.M., Flathead County, Montana. C. Existing Land Use: The propoSal I LS located on the old Montana Forest Products mill site. The mJ11 was an active inill from the 1940's to just a feve years ago. A portion of Ashley Creek has been rerouted and approximately 300 feet of the diverted creek has been canalized west of the existing dam. The darn was used to redirect the stream to feed the manmade log pond that was located to the northwest of the structure. The log pond in no longer in use and in past years has been filled with sawdust and SMall pieces of wood. �,Vq "o, D. Adjacent Land Uses: Immediately to the north of this proposal is the old Montana Forest Products mill site, ALpple Way and the City of Kalispell. To the immediate south of this proposal is vacant land, which is being proposed as a subdivision that will be annexed into the City of Kalispell. To the cast of ths project are high -density residential homes and the City of Kalispell. E. Public Comment: This office received no conunents from adjoining landowners. A joint meeting was conducted on November 4, 2005 with Wayne and Hubert Turner, the applicant's representatives, Paul Wells with WMW Engineering, Larry Van Rinsurn and Pete Woll with the Conservation District, Karl Christians and Larry Shock with DNRC, Mark Crowley and Tom Jentz with the City of Kalispell and Nicole Lopez-Stickney and Traci S ' em-Tull with Flathead County Planning and Zoning Off -ice. The .purposm of t1u.s. mcating-was--to-address -and - discuss . concerns about -the. proj ect- and future . proposed projects. Karl Cluistians and Larry Shock explained the review procedure for the western culvert and road embanlanent ifutilized as part of an internal subdivision road system. The proposal as submitted and approved is for a private roadway for the property oAmer to access both sides of their property. It was explained to the applicant that if this road were to be used, in the future, as part of an internal subdivision road system, then the applicant would have to reapply for a floodplain pen -nit that would review the road as either a public or private multi-user access road. ThC TCVle-,v far a public or private road would entail a flood study of the surrounding area. The Turners stated that at this time, the applicantion is for the property owners' access only. RiE'vU,W AND FINDINGS OF FACT The project includes the removal of an existing dam and the installation of two culverts and one public crossing on the western proposed culvert. This proposal has been reviewed pursuant to the Flathead County Floodplain and Floodway Management Regulations. A. The proposed estabbstiment of an artificial obstruction meets the requirements of these regulations. The proposed project will add a culvert with a public crossing. The installation shall be constructed and placed so as to offer no obstruction to flood flows. No impact to the .. base flood elevation is expected. No impact to upstream OT downstream base flood elevation is expected. The obstruction is within the parameters of Flathead County Floodpiain & Floodway Management Regulations, Section 5.02.B(2). B. Additional Factors. 2 7 I. The danger to life and property due to increased flood heights, increased floodwater velocities or alterations in the pattern of flood flow caused by encroachments. The project will include the removal of an existing dain strucWre, the installation of two (2) culverts and a public crossing in the 100-year floodplain. The project will be located in the floodway fringe. Tle project does not -appear to substantially increase the 100-year flood. As such, no additional impacts are expected due to this project, 2. The danger that materials may be swept onto other lands or downstream to the injury of others. AIJ materials shall be adequately anchored so that they may not be swept downstream, Fill shall be compacted in place. Erosion control measures shall be taken to iin-Lit losses to erosion. This will reduce the likelihood of materials being swept onto other lands or downstream. 3. The proposed water supply and sanitation systems and the ability of these systems to prevent disease, contamination, and unsanitary conditions. No water or sewer lines are proposed. 4. The susceptibility of the proposed facifity and its contents to flood damage and the effects of such damage on the individual owner. 'Me proposed improvements will be constructed using best management practices and are not expected to be susceptible to flood damage. S. The importance of the services provided by the facil.ity to the community. Tlus project wiH allow for improved private access to the property. No coiTimunity facilities are proposed. The requirement of the facility for a waterfront location. The project is required to provide an access point to the area that is compliant with Flathead County road standards. The avaBabWty of alternative locations not subject to flooding for the proposed use. Stream crossings require being located on a site subject to flooding. This has been determined to be the preferred location to access both sides of the property. 8. The compatibility of the proposed use with existing development and anticipated development in the foreseeable future. The arm is an old mill site on the south side of the property and vacant land to the north. The dam, removal and placement of a culvert in its place is compatible with existing and anticipated development. The western culvert and public crossing is compatible with the proposed use of the existing development and anticipated development. 0 9. The relatiODship of the proposed use to the Master Plan and floodplain management program for the area. A W W 'rhe proposal is in compliance with the Kalispell Area Master Plan for the area. The area has been identified as Light and Heavy Industrial use, While floodplain development should generally be avoided, the rights of owners of existing lots to develop their lands naust be respected when there are no alternatives and the construction is done in confon-nance with the County's Regulations. 10. The safety of access to property in times of flooding for ordinary and emergency services. This project has safe access on both sides from either Second Street West or Foys Lake Road. No added risks will be created as a result of the proposal. 11. Such other factors as are in harmony with the purposes of these regulations, the Montana Floodplain and Floodway Management Act and the National Flood Insurance Program, The project provides for the orderly development of the area, BasOd on the forgoing discussion, the proposal does not appear to significantly increase flood heights or velocities during the 100-year and 500-year events. Other permits including a Section 404 pern-0 from the U.S. Army Corps -of Engineers, a 3 10 Permit from the Flathead Conservation District, and a SPA 124 Pen -nit from Montana Department of Fish, Wildlife, and Parks may be required to complete the project. The work shaU be completed in substantial compliance with the application, except as modified by these conditions. 1. Erosion and sediment control measures shall be implemented to protect Ashley Creek. 3. Banks disturbed from this project shall be restored to pre -disturbance slopes and vegetated conditions. Temporary erosion control fabrics shall be used to stabilize banks to allow vegetation to become established. 4, Natural vegetation shall be preserved wherever possible. Clearing of vegetation will be limited to that which is absolutely necessary for construction of the project. 5. All rill material shall be placed and compacted in such a way as to prevent its introduction into the creek. 6. The applicant shall notify the Flathead County Planning & Zoning Office when the temporary diversion ditches will be constructed, prior to water flowing in ditches and prior to putting water back into the natural channel, after culverts are in place. 7. The stream channel must be dewatered prior to and during any in -channel construction work, including dam removal activities and culvert installations. 8. In -channel work will be done during low flow conditions in late summer, fall or winter. 9. The western culvert will be set on -grade with the inside culvert surface either level with, or just slightly lower than (roughly 2-3 inches) the existing streambed elevation. 10. Any excess material generated from this project must be disposed of above the ordinary high water mark and not in an area classified as a wetland. 11. Work, shall be conducted to minimize impact on the stream and the immediate vicinity. To prevent leaks of petroleum products into the waterway, no defective equipment shall be operated in areas capable of contributing surface flows to the watercourse. -47 12. All other applicable permits (including a 404 permit from the U.S. Army Corps of Engineers, 310 permit from Flathead Conservation District, a 124 permit from Montana Fish Wildlife & Parks, and a 318 Permit from the Montana Department of Environmental Quality) shall be obtained prior to the commencement of construction. 13.
