According to our records, it appears that the permit granted on November 2, 2006 allowed for the crossing to be recognized as a public crossing. I have attached a copy of the approved permit for your convenience. If you have any questions, please contact me at your convenience at (406)751-8200 or biott=agfIathead-.M . -0v. Sincerely, Bailey Lott, CFM Planner 1 FLATHEAD COUNTY PLANNING & WNING OFFICE STAFF REPORT FLOODPLAIN DEVELOPMENT PERMIT #FDP-05-15 Amended MONTANA FOREST PRODUCTS, LTD NOVEMBER 2, 2006 This permit request is to remove an existing dam, install two (2) culverts and an access road for the property owners only that crosses Ashley Creek, west of Kalispell. Work will include the removal of the existing darn, installation of two (2) culverts, and the placement of fill for the private access road. The Flathead County Planning & Zoning Office is issuing this permit under the provisions of the Flathead County Floodplain and Floodway Management Regulations. Tonya Wells with WMW Engineering contacted Montana DNRC about amending Floodplain Permit #fFDP- 05 -15 to change the private access road to a public crossing. On October 19, 2006, Montana DNRC commented in an email-tharthe -data -submitted was -reasonable -enough- to -issue--apernlit-for-a public crossing. The email fiather stated that the HEC—RAS model and floodplain elevations can not be considered accurate enough for floodplain mapping purposes. Floodplain Development Permit ##FDP-05-15 is now being amended to reflect a public crossing instead of the originally proposed private access road. Time project is located at 131 Second Street West, west of Kalispell, and is 5zffier described as Tracts 11H, 11. and 111A in Section 13, Township 29 North, Range 22 Wes% P_M.M., Flathead County, Montana. BACKGROUND: A. Owner: Montana Forest Products, LTD P.O. Box d03S Kalispell, MT 59904 406.755.6432 Applicant: WMW Engineering, PC 50 West Second Street Whitefish, MT 59937 406.862.7826 B. Location: The proposed project is in Floodplain Zone A according to FIRM Panel 300023-1805 D Revised September :30, 1992. The project is located at 131 Second Street West, west of Kalispell, and is further described as Tracts 11H, 111 and 111A in Section 13, Township 29 North, Range 22 West, P.M.M., Flathead County, Montana. C. Existing Land Use: The proposal is located on the old Montana Forest Products mill site. The m 11 was an active mill from the 1940's to just a feve years ago. A portion of Ashley Creek has been rerouted and approximately 300 feet of the diverted creek has been canalized west of the existing dam. The darts was used to redirect the stream to feed the manmade log pond that was located to the northwest of the structure. The log pond in no longer in use and in past ;rears has been filled with sawdust and small pieces of wood.. ., , ?ram. '":. D. Adjacent Land Uses: Immediately to the north of this proposal is the old Montana Forest Products mill site, Apple Way and the City of Kalispell. To the immediate south of this proposal is vacant land, which is being proposed as a subdivision that will be annexed into the City of Kalispell. To the cast of this project are high -density residential homes and the City of Kalispell. E. Public Comment: This office received no comments from adjoining landowners. A joint meeting was conducted on November 4, 2005 with Wayne and Hubert Turner, the applicant's representatives, Paul Wells with WMW Engineering, Larry Van Rinsurn and Pete Woll with the Conservation District, Karl Christians and Larry Shock with DNRC, Mark Crowley and Tom 3entz with the City of Kalispell and Nicole Lopez-Stickney and Traci Sears -Tull with Flathead County Planning and Zoning Office. The purpose of -this. mcating.-was--to-address-and - discuss. concerns about -the. proj ect- andfuture. proposed projects. Karl Cluistians and Lary Shock explained the review procedure for the western culvert and road embanlanent if utilized as part of an internal subdivision road system. The proposal as submitted and approved is for a private roadway for the property oAmer to access both sides of their property. It was explained to the applicant that if this road were to be used, in the future, as part of an internal subdivision road system, then the applicant would have to reapply for a fioodplain pen -nit that would review the road as either a public or private multi-user access road. The review for a public or private road would entail a flood study of the surrounding area. The Turners stated that at this time, the applicantion is for the property owners' access only. Tonya Wells with WM-W Engineering contacted Montana DNRC about amending Floodplain Permit #I;DP--05-15 to change the private access road to a public crossing. On October 19, 2006, Montana DNRC commented in an email that the data submitted was reasonable enough to issue a permit for a public crossing. The email further stated that the HEM RAS model and floodpiain elevations can not be considered accurate enough for floodplain mapping purposes. Floodplain Development Permit #FDP-05-15 is now being amended to reflect a public crossing instead of the originally proposed private access road. RE'4U,W AND FINDINGS OF FACT The project includes the removal of an existing darn and the installation of two culverts and one public crossing on the western proposed culvert. This proposal has been reviewed pursuant to the Flathead County Floodplain and Floodway Management Regulations. A. The proposed establishment of an artificial obstruction meets the requirements of these regulations. The proposed project will add a culvert with a public crossing. The installation shall be constructed and placed so as to offer no obstruction to flood flows. No impact to the base flood elevation is expected. No impact to upstream or downstream base flood elevation is expected. The obstruction is within the parameters of Flathead County Floodplain & Fioodway Management Regulations, Section 5.02.B(2). B. Additional Factors. 2 I. The danger to life and property due to increased flood heights, increased floodwater velocities or alterations in the pattern of flood flow caused by encroachments. The project will include the removal of an existing dam structure, the installation of two (2) culverts and a public crossing in the 100-year iloodplain. The project will be located in the floodway fringe. The project does not appear to substantially increase the 100-year flood. As such, no additional impacts are expected due to this project. 2. The danger that materials may be swept onto other lands or downstream to the injury of others. All materials shall be adequately anchored so that they may not be swept downstream, Fill shall be compacted in place. Erosion control measures shall be taken to limit losses to erosion. This will reduce the likelihood of materials being swept onto other lands or downstream. 3. The proposed water supply and sanitation systems and the ability of these systems to prevent disease, contamination, and unsanitary conditions. No water or sewer lines are proposed. 4. The susceptibility of the proposed facility and its contents to flood damage and the effects of such damage on the individual owner. The proposed improvements will be constructed Lasing best management practices and are not expected to be susceptible to flood damage. S. The importance of the services provided by the facility to the community. This project will allow for improved private access to the property. No community facilities are. proposed. 6. The requirement of the facility for a waterfront location. The project is required to provide an access point to the area that is compliant with Flathead County road standards. The avaBabiiity of alternative locations not subject to flooding for the proposed use. Stream crossings require being located on a site subject to flooding. This has been determined to be the preferred location to access both sides of the property. 8. The compatibility of the proposed use with existing development and anticipated development in the foreseeable future. The area is an old mill site on the south side of the property and vacant land to the north. The dam removal and placement of a culvert in its place is compatible with existing and anticipated development. The western culvert and public crossing is compatible with the proposed use of the existing development and anticipated development. 9. The relationship of the proposed use to the Master Plan and tloodplain management program for the area. CCU rAW 'I'he proposal is in compliance with the Kalispell Area Master Plan for the area. The area has been identified as Light and Heavy Industrial use, While floodplain development should generally be avoided, the rights of owners of existing lots to develop their lands must be respected when there are no alternatives and the construction is done in conformance with the County's Regulations. 10. The safety of access to property in times of flooding for ordinary and emergency services. This project has safe access on both sides from either Second Street West or Foys Lake Road. No added risks will be created as a result of the proposal. 11. Such other factors as are in harmony with the purposes of these regulations, the Montana Floodplain and Floodway Management Act and the National Flood Insurance Program, The project provides for the orderly development of the, area. Based on the forgoing discussion, the proposal does not appear to significantly increase flood heights or velocities during the 100-year and 500-year events. Other permits including a Section 404 permit from the U.S. Army Corps -of Engineers, a 310 Permit from the Flathead Conservation District, and a SPA 124 Permit from Montana Department of Fish, Wildlife, and Parks may be required to complete the project. These determinations were for Ashley Creek - from approximately 300 feet upstream to approximately 7,500 feet upstream of Burlington Northern Railroad; and North Tributary to Ashley Creek - from just upstream to approximately 1,410 feet upstream of Ashley Creek. The 90-day appeal period that was initiated on May 8, 2009, when the Department of Homeland Security's Federal Emergency Management Agency (FEMA) published a notice of proposed Base Flood Elevations (BFEs) in the Daily Inter ,Lake, has elapsed. FEMA received no valid requests for changes to the modified BFEs. Therefore, the modified BFEs that became effective on April 21, 2009, remain valid and revise the FIRM and FIS report that were in effect prior to that date. The modifications are pursuant to Section 206 of the Flood Disaster Protection Act of 1973 (Public Law 93-234) and are in accordance with the National Flood Insurance Act of 1968, as amended (Title XIII of the Housing and Urban Development Act of 1968, Public Law 90-448), 42 G.S.C. 4001-4128, and 44 CFR Part 65. The community number(s) and suffix code(s) are unaffected by this revision. The community number and appropriate suffix code as shown above will be used by the National Flood Insurance Program (NFIP) for all flood insurance policies and renewals issued for your community. FEMA has developed criteria for floodplain management as required under the above -mentioned Acts of 1968 and 1973. To continue participation in the NFIP, your community must use the modified BFEs to carry out the floodplain management regulations for the NFIP. The modified BFEs will also be used to calculate the appropriate flood insurance premium rates for all new buildings and their contents and for the second layer of insurance on existing buildings and their contents. If you have any questions regarding the necessary floodplain management measures for your community or the NFIP in general, please call the Director, Mitigation Division of FEMA in Denver, Colorado, at (303) 235-4830. LETTER OF MAP REVISION DETERMINATION DOCUMENT (CONTINUED) COMMUNITY INFORMATION APPLICABLE NFIP REGULATIONS1COMMUNITY OBLIGATION We have made this determination pursuant to Section 206 of the Flood Disaster Protection Act of 1973 (P.L.. 93-234) and in accordance with the National Flood Insurance Act of 1968, as amended (Title XIII of the Housing and Urban development Act of 1968, P.L. 90-448), 42 U,S.C. 4001 -4128, and 44 CFR Part 65. Pursuant to Section 1361 of the National Flood Insurance Act of 1968, as amended, communities participating in the NFIP are required to adopt and enforce floodplain management regulations that meet or exceed NFIP criteria. These criteria, including adoption of the FIS report and FIRM, and the modifications made by this LOMR, are the minimum requirements for continued NFIP participation and do not supersede more stringent StatelCornrnonwealth or local requirements to which the regulations apply.. We provide the floodway designation to your community as a too] to regulate floodplain development. Therefore, the floodway revision we have described in this letter, while acceptable to us, must also be acceptable to your community and adopted by appropriate community action, as specified in Paragraph 60.3(d) of the NFIP regulations. NFIP regulations Subparagraph 603(b)(7) requires communities to ensure that the flood -;parrying capacity within the altered or relocated -lion of arty watercourse is maintained. This provision is incorporated into your community's existing floodplain management inances; therefore, responsibility for maintenance of the altered or relocated watercourse, including any related appurtenances such as bridges, culverts, and ether drainage structures, rest, with your community. We may request that your community submit a description and schedule of maintenance activities necessary to ensure this requirement. COMMUNITY REMINDERS We based t1, determination on the l-percent-annual-chance flood discharges computed in the FIS for your community without consadefing subsequent changes in watershed characteristics that could increase flood discharges. Future development of projects upstream could Cause increased flood discharges, which could cause increased flood hazards. A comprehensive restudy of your community's flood hazards would consider the cumulative effects of development on flood discharges subsequent to the publication of the FIS report for your community and could, therefore, establish greater flood hazards in this area. Your community must regulate all proposed floodplain development and ensure that permits required by Federal andior State,Cvmrnonwealth law have been obtained. State/Commonwealth or community officials, based on knowledge of local conditions and in the interest ofsafety, may set higher standards for construction or may limit development in floodplain areas. Ifyour State,'Commonwealth or community has adopted more restrictive or comprehensive floodplain management criteria, those criteria take precedence over the aninimum NFIP requirements. We wi'il nit print and distribute this LOMR to primary users, such as local insurance agents or mortgage lenders; instead, the community will serve as a repository for the new data. We encourage you to disseminate the information in this LOMR by preparing a crews release for publication in your community's newspaper that describes the revision and explains how your community will provide the data and help interpret the NFIP maps. In that way, interested persons, such as property owners, insurance agents, and mortgage lenders, can benefit from the infbrrnation. This deterninati". Is based On the flood data presently available.
