Resolution 5545 - Preliminary Plat Extension - Silverbrook Estates Phase 2PLANNING FOR THE FUTURE REPORT TO: Kalispell Mayor and City Council FROM: Sean Conrad, Senior Planner Charles Harball, Interim City Manager Planning Department 201 1" Avenue East Kalispell, MT 59901 Phone: (406) 758-7940 Fax: (406) 758-7739 www.katispell.com/planning SUBJECT Silverbrook Estates phase 2 — Request for preliminary plat extension MEETING DATE: January 23, 2012 BACKGROUND: This is a request by F & H Land Surveying, Inc., on behalf of the owner of Silverbrook Estates phase 2, for a two-year extension of the preliminary plat of the subdivision. Phase 2 includes approximately 167 acres which constitutes the remaining acreage outside of phases 1 of the 325 acre Silverbrook Estates project site. Phase 2 lies at the southwest corner of the intersection of Highway 93 and Church Drive. The 167 acres which make up phase 2 can be described as tract 3 and a portion of tracts 4 and 5 of Certificate of Survey 15896 located within the NE % of Section 13, Township 29 North, Range 22 West, P.M.M., Flathead County, Montana. The subdivision would create 196 single-family lots, 90 townhouse lots and 13 commercial lots. The Kalispell City Council approved phase 2 in March of 2009 subject to 43 conditions. A letter from F & H Land Surveying, Inc. dated December 16, 2011 requests an extension of the preliminary plat which is set to expire in February of this year. Pursuant to section 28.2.06.E.7 of the Kalispell Subdivision Regulations, the city council may extend a preliminary plat for an additional two year period. This section of the regulations requires the developer to provide the planning department with a written request for the extension 30 days prior to the expiration date of the preliminary plat and to document the existence of an unusual hardship. The planning department received the written request prior to 30 days from the date the preliminary plat expires and the letter notes the current economic conditions facing the valley as the unusual hardship. RECOMMENDATION: A motion to adopt the resolution and grant a two-year extension to the preliminary plat approval for Silverbrook Estates phase 2 subdivision would be in order. WHEREAS, the city council of the City of Kalispell granted preliminary plat approval for Silverbrook Estates Phase 2 on March 23, 2009; and WHEREAS, F & H Land Surveying, Inc., on behalf of the owner, has requested a two-year extension to the preliminary plat for Silverbrook Estates Phase 2 due to economic conditions; and WHEREAS, good cause exists for the request for extension by F & H Land Surveying, Inc. and it is in the best interests of the city that the extension be given. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KALISPELL, MONTANA AS FOLLOWS: SECTION I. That the application of F & H Land Surveying, Inc. for a two-year extension of the preliminary plat of Silverbrook Estates Phase 2, Kalispell, Flathead County, Montana is hereby approved.
