The request before the planning board and city council is to expand the dance studio into the adjacent suite, 44 Bruyer Way. The property where the building is located is approximately 0.46 of an acre in size and is immediately east of Edgerton School between the school and Whitefish Stage Road. The property can be described as Lot 3 of Buffalo Stage Professional Park located in Section 31, Township 29 North, Range 21 West. The Kalispell Planning Department staff presented staff report KCU-11-5 and reviewed the proposed project. Staff recommended approval of the conditional use permit subject to two conditions. At the public hearing the applicant spoke in favor of the project. No one else spoke for or against the use permit request and the public hearing was closed. The planning board then acted on a motion to recommend the city council consider approving the conditional use permit subject to the two conditions listed in the staff report. The vote to recommend approval was unanimous. RECOMMENDATION: A motion to approve the conditional use permit with the 2 conditions as recommended by the planning board would be in order. The conditional use permit is required because the applicants would like to double the size of the existing dance studio and a dance studio is defined as a commercial school in the Kalispell Zoning Ordinance, requiring a conditional use permit in the R-5 zone. The proposed dance school expansion will included ballet classes for pre- and school -aged children as well as adult classes. Other dance styles such as jazz and modern will also be taught as the school grows. Classes will be held between the hours of 3:30 pm through 9:00 pm, Monday through Friday during the months of September through May. There will be some morning classes as well as occasional Saturday classes. Summer classes, June through August, will be held during daytime hours. Class sizes will range from 10-20 students. If the schedule provides, the space may also include classes for acting, yoga, and/or fitness classes. Existing Land Use and Zoning: The property is developed with one building broken up into three separate suites which are unimproved at this time. Each suite is a single level unit approximately 2,200 square feet in size. The building is located on lot 3 of the Buffalo Stage Professional Park and is approximately 0.46 of an acre is size. The property is zoned R-5 (Residential/Professional Office) which is a zoning district intended to accommodate single-family homes, duplexes and professional offices where it is not deemed desirable to permit a more intensive business activity of a retail nature. The district serves as a buffer between residential areas and other commercial districts and is typically associated with arterial or minor arterial streets. Commercial schools require a conditional use permit in the R-5 zoning district. D. Surrounding Zoning and Land Uses: This area along Whitefish Stage Road is a mix of uses including a public elementary school - Edgerton, professional offices, a church, small shopping area to the south of proposed dance studio and residential development to the north and east. Surrounding zoning includes a mix of residential zoning districts including R-5, RA-1 (Residential Apartment) and R-4 (Residential). The school located west of the dance studio building is zoned P-1 (Public) . Growth Policy Designation: The Kalispell Growth Policy Future Land Use Map designates the property as Urban Residential however the property is on the boundary between the Urban Residential land use designation and the Urban Mixed Use designation. The Urban Residential land use designation typically accommodates single-family, duplex and low density apartment developments. The Urban Mixed Use designation is extended to those areas undergoing a transition or which serve as buffer areas, in this case buffering the school and residential development from Whitefish Stage Road. The Urban Mixed Use designation accommodates uses including office, residential and commercial. The proposed dance studio fits under this designation. F. Utilities/Services: Sewer service: City of Kalispell 3 Water service: City of Kalispell Solid Waste: City of Kalispell Gas: Northwestern Energy Electric: Flathead Electric Cooperative Phone: CenturyLink Police: City of Kalispell Fire: Kalispell Fire Department The application has been reviewed in accordance with the conditional use review criteria in the Kalispell Zoning Ordinance. 1. Site Suitability: a. Adequate Useable Space: The property is approximately 0.46 acres in size with the existing building at approximately 2,200 square feet. The building site is level with adequate parking and an existing access off of Bruyer Way. b. Adequate Access: Access to the site is provided by a driveway, approximately 24 feet wide, off of Bruyer Way. There is no access directly onto Whitefish Stage Road. The existing driveway access will accommodate the anticipated traffic generated by the dance studio. C. Environmental Constraints: No significant environmental constraints are associated with this property such as floodplain or wetland areas, steep slopes or severe drainage problems. a. Parking Scheme: Currently there are 13 parking spaces on the north side of the building and 36 spaces east of the building. Section 27.24.050 of the Kalispell Zoning Ordinance provides the required minimum off-street parking spaces needed for individual uses. Under this section commercial schools are required to provide 1 parking space per 3 students plus 1 space per employee. Based on the maximum number of students per class (20) and maximum number of instructors (2), a total of 8 parking spaces would be required. The existing parking north and east of the building is adequate to accommodate the proposed dance school. b. Exterior Lighting_ The building proposed for the dance studio use has outdoor lighting in compliance with the city's outdoor lighting standards. C. Traffic Circulation: Traffic circulation to and from the property is not intended to change. Access is provided off of Bruyer Way by an existing driveway with internal circulation provided by parking areas to the north and east of the building. M d. Open Space: No speck open space requirements are applicable to the proposed dance studio use of the property other than those associated with the required setbacks. e. Fencing/Screening/Landscaping: There is existing landscaping around the buildings and in landscape islands adjacent to the parking lot. No additional landscaping, fencing or screening appears to be necessary or appropriate. f. Signage: The owners of the dance studio intend to place signs to the existing business park sign, located at the intersection of Bruyer Way and Whitefish Stage Road, and above the entrance of the building. a. Police: This facility is currently served by the Kalispell Police Department. No increased impacts to the police can be anticipated as a result of the proposed classroom use. b. Fire Protection: Fire protection is currently provided by the Kalispell Fire Department. There is an existing hydrant located east of the building within the parking lot. No increased impacts to the fire department can be anticipated as a result of the proposed classroom use. C. Water: City water currently serves the building and no significant impact on water services provided by the city can be anticipated as result of the proposed use. d. Sewer: Sewer service is currently provided by the City of Kalispell. Insignificant impacts on city sewer services can be anticipated as a result of the proposed use. e. Storm Water: Storm water from the buildings is directed to the landscaping surrounding the building. Parking lot storm water is directed to the city's storm water lines along Bruyer Way. f. Streets: Bruyer Way provides access to the dance studio building. Bruyer Way is a city street with curb and gutters on both sides of the street and a landscaped boulevard and sidewalk on the south side of the street. No negative impacts on the street are anticipated with the use of the building as a dance studio. g. Sidewalks: Sidewalks are located on the south side of Bruyer Way. Sidewalks are in place around each of the buildings to provide safe pedestrian access to and from the buildings and parking lot. h. Garbage Collection: Garbage collection will be handled by the city or private contractor with regular weekly pick-ups. 4. Neighborhood impacts: No neighborhood impacts are anticipated with the approval of the conditional use permit to allow the dance studio in one of the existing buildings. The property is zoned for the intended use of immediate neighbors of the dance studio including Edgerton School and other commercial buildings. 5. Consideration of historical use patterns and recent changes: The general character of this neighborhood is residential development to the north and east with a mix of commercial, residential and public school to the south and west. The use of the existing building for a dance studio will not have a significant impact on the neighborhood with regard to noise or hours of operation and will not have a negative impact on the character of the area. 6. Effects on property values: No significant negative impacts on property values are anticipated. As previously mentioned the proposal is compatible with the surrounding development and will not create any adverse impacts with regard to noise or traffic. The staff recommends that the planning board adopt the staff report #KCU-11-05 as findings of fact and recommend to the Kalispell City Council that the Conditional Use Permit be approved subject to the following conditions: 1. PLEASE NOTE: In October 2010, we received a CUP and opened our dance studio at 46 Bruyer Way. We have been teaching ballet classes to ages 4 through adult and are currently looking for an additional CUP in order to expand into the attached northern space - 44 Bruyer. We want to expand into a bigger space because our enrollment has substantially increased over the last 11 months and we need room to be able to teach different age groups in two spaces during the prime time teaching hours. I laving this additional space will make it possible for this to happen. We would 'punch out' a door in the north wall of the existing studio space into the proposed studio space - 46 Bruyer and 44 Bruyer would be our new dance space. From the north and south off of Whitefish Stage, traffic will use Bruyer Way to enter and exit the business park. Access to the property involves turning at the first left into Buffalo Stage Business Park. Clientele will drive through the north end of the business park to access 44 Bruyer Way. Ample parking is located on the north and east side of the building. Refuse and service areas are located between Charlie Mason's business and 42, 44, 46 Bruyer Way. Utilities are located on the northwest corner of the building which supplies all three addresses. The entire building perimeter is beautifully landscaped with sod and low lying shrubs and flowers. Signage will be on the in the door to the studio. This middle building of the triplex (#44) will be used as a dance school where ballet will be taught to pre- and school -aged children as well as adult classes as needed. Other dance styles such as jazz, and modern will also be taught as the school grows. Approximately 80% of the operating hours will be held between 3:30pm through 9:00pm, Mon -Fri. Sept - May. The remaining 20% of the operating hours will be in the morning, some Saturdays, and summer classes. Summer classes will be held during the daytime. No more than one class will be taught at a time in the #44 Bruyer space with a range of 10-20 students per class. We are currently renting space to two fitness groups. Music will be played inside the building. Florescent lighting will be used inside and there will be no dust, odors, fumes, or vibrations produced at this location.
