OLD BUSINESS: Spring Prairie Phase 3/Kohl's — Hwy 93 N — Their construction date has
been moved up to August, 2012.
NEW BUSINESS: Sykes — 213 3"d Ave W; 236/242 2nd Ave W; remodel of existing commercial
building and garages/Phase II of apartments. Mark Johnson, Architect, was present. The last set of
plans showed the building encroaching over the right-of-way a little bit. Those need to be corrected.
M. Johnson stated that the building is actually right at the property line. Architectural Review passed
this through. The posts in the front are 4" out. The one on the top goes out 26" to the face of the
building. They will need a Right -of -Way permit for working on the front facade of this project. The
landscaping issues are tied with the C of O for the restaurant and market building. The sidewalks in
front of this building are in good condition. Along with the barber shop, one of the other spaces will
be an art studio. This is approved through Site Review with the condition that they obtain a Right -of -
Way Permit. Regarding the proposed garages, M. Johnson asked for any further comments or
discussion. They are planning on doing only one-story for now, and possibly doing the apartment
above in the future. All the roof will be handled through the existing infrastructure that was placed in
the parking lot for the storm drain. There is an existing 3/4" water line to the old house that they will
maintain. The sewer lateral that comes out of the old house to the alley will also be maintained. It
will be connected into the ground source system for the other building. The floors will be heated so
they will put in some kind of drains. The oil/sand separator will be in the ground, probably in the
back out area between the garages. The broken sidewalk and curb along 3"d Avenue West will need
to be repaired. Crowley stated that the water meter in the basement will need to be turned off. The
meter was damaged during construction, so the City can deal with the damaged meter and if water is
needed during construction, they can work that out with us at that time. He is concerned about the
meter freezing. This is approved through Site Review with the above conditions.
Northwestern Energy — 890 North Meridian; new storage building — They are proposing a 1,700 sq.
ft. storage building on the west side of their property. This will be just a shell used for storage, and
no sewer or water. There is no access shown on Glenwood. Their zoning is B 1, but they will need
an Administrative Conditional Use Permit to do this. Public Works will view the site and this will be
on the agenda for next week.
Neighborhood Pub — 10 1 East Center Street, Suite A. Administrative Conditional Use Permit for a
bar located at the Loading Dock at the corner of I't Ave E and Center St. It will occupy the first
floor on the west side of that building, closest to I't Ave E. Their hours planned are from 4 p.m. to
11 or midnight. He has a liquor license that has to be used, so he is using it at this site for interim use.
If he decides to put a casino in there, it will take a full Conditional Use Permit that would go to the
Planning Board and the City Council for approval. The size of the casino would be constricted to just
10% of that floor area. Signage is also restricted. They may need to sprinkler for the bar, and their
handicapped ramp may be an issue.
PLANNING OFFICE ITEMS: We only have the group home, Montana Academy, going in at
527 — 2nd Avenue West between 5th and 6th Street West.
OTHER REPORTS:
Mile High Subdivision — on Denver — Violence -Free Crisis Center — We have a bond to cover
sidewalk, curb, and gutter on the east side of Denver. When they sell, they will have to put the
improvements in at that time or sign off on it. Someone has contacted Jentz about buying the entire
subdivision but not putting the shelter at the end of it. They are considering putting in an assisted
living facility or homeless shelter at the end.
Willow Creek — The Turners said they are done with Willow Creek and maybe someone else will
pick it up, but they can't make it work. They are looking at other pieces of land. The question arose
as to what will be done with the "gaping wound" out there. There is no bond. Should we be
contacting them about mitigation, seeding, closure, restoration, safety, etc.? Wargo stated that Public
Works will be contacting them regarding Ordinance 1600 that requires them to re -vegetate it. It's
too late this year, but they will have to do something in the spring.
Ashley Heights - The Turners want to do away with the sound wall. They have general estimates
that traffic was down below projection and that noise was less than anticipated. They would like to
have the sound wall mitigation removed. We have a bond over them on this. The question of them
being compensated for the sound wall by MDT was discussed.
MDT — Freyholtz noted that Doug Moller, District Administrator, is retiring this week. Shane Stack
will be the Acting District Administrator.
