Patrick, City Manager SUBJECT Highway 93 By -Pass Final Design Recommendation MEETING DATE: August 1, 2005 BACKGROUND: The MDT has contracted with Stelling Engineers, lnc. to develop a final design and ultimately prepare final engineering plans for the Highway 93 Bypass Plan. They have been meeting with the Kalispell Technical Advisory Committee (TAC) and City staff since June of last year. At the July 21, 2005 TAC meeting, the TAC did unanimously recommend approval of an ultimate design for the By -Pass. The purpose of the recommendation is to allow MIST to progress to final design for the overall project. The TAC serves as a planning and advisory committee with representatives of the City, County, MDT, Federal Highway Administration and 4 citizen members. Because the TAC is an advisory body, it is appropriate for both the City Council and the County Commissioners to follow up this action with a resolution of support to be forwarded to MDT. A copy of the Bypass Plan dated July 21, 2005 as well as a draft letter of recommendation from the TAC and a draft resolution are attached for your review. RECOMMENDATION: A motion to authorize signing of a resolution supporting the TAC `s recommendation for the final Bypass design. FISCAL EFFECTS: This is a federally funded project thus construction and maintenance will not be the city's responsibility. ALTERNATNES: As suggested by the city council. WHEREAS, in 1994 the Final Environmental Impact Statement (FEIS) for US Highway 93 — Somers to Whitefish West recommended the construction of the Kalispell Bypass as part of the regional improvements to US 93; and WHEREAS, the Montana Department of Transportation [MDT} has now entered into a contract with Stelling Engineers, Inc. to develop a final design for the Bypass; and WHEREAS, MDT has also entered into a contract with Carter Burgess, Inc. to re-evaluate the FEIS to assure that the environmental and design needs meet the current conditions; and WHEREAS, the Kalispell Technical Advisory Committee (TAC) met on June 21 and August 24, 2004, and April 21 and July 21, 2005 for the purpose of reviewing public comment and refined engineering designs as well as to receive updates on any associated environmental impacts involved with the passage of time and minor modifications to the alignment associated with that final design for the Highway 93 bypass; and WHEREAS, Kalispell City staff has been meeting on an ongoing basis with MDT and its consultants to further refine the final design work seeking to provide the most beneficial and appropriate design to serve the general public; and WHEREAS, the TAC met on July 21, 2005 for the purpose of reviewing a final design concept for the Kalispell 93 Bypass and issued a recommendation that the Highway 93 Bypass configuration dated July 21, 2005 be adopted; and WHEREAS, it is critical in the planning and design process that MDT and the consultants be given specific direction as to the local government wishes and expectation for the final design of the Highway 93 bypass. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KALISPELL AS FOLLOWS: SECTION I. the City of Kalispell supports the recommendation of the TAC and encourages MDT to adopt the Highway 93 Bypass configuration dated July 21, 2005 as presented by Stelling Engineers, Inc. embodying the overall design for the Highway 93 Bypass in general and incorporating the designs for 11 intersections, rail road and stream crossings and noting that this recommendation supports the overall design to this date but does not address any aspect of phasing either of the overall project or individual aspects of the overall project. Advisory Committee held on Thursday, July 21, 2005 the Committee unanimously recommended approval of the Highway 93 Bypass configuration dated July 21, 2005 as presented by Stelling Engineers. The approval incorporated the designs for 11 intersections, rail road and stream crossings. This approval embodied the overall design for the bypass and did not specifically address any aspect of phasing either of the overall project or individual aspects of the overall project. The purpose of this recommendation is to give specific direction to MDT and encourage its consultants Stelling Engineers, Inc. and Carter Burgess, Inc. in their endeavors to fully address environmental impacts and develop final construction plans for this worthy and necessary project. By this letter, I will be contacting both the City of Kalispell and the Flathead County Board of Commissioners asking them to send a formal resolution of support for the Bypass Configuration as well.
