SUBJECT Glacier Village Greens Subdivision Phases 19, 21 and the remainder of 22 — Request for
one-year preliminary plat extension
MEETING DATE: September 7, 2010
BACKGROUND: This is a request by Sands Surveying on behalf of the developer of Glacier Village Greens for a
one-year extension of the preliminary plat for phases 19, 21 and the remainder of phase 22. These phases would
create 25 single-family lots and 34 townhouse lots. The phases were approved in December of 2002 by the
Kalispell City Council subject to 16 conditions.
The Glacier Village Greens Subdivision is approximately 200 acres in size, includes 22 phases and is located on the
north side of West Evergreen Drive. Phases 19, 21 and the remainder of phase 22 are located on the north side of
the subdivision. Phase 19 is located north of the cul-de-sac for Palmer Drive. Phase 21 is located east of the cul-
de-sac for W. Nicklaus Avenue and the remainder of phase 22 is located at the northern end of E. Nicklaus Avenue.
The Kalispell Subdivision Regulations, section 2.06.E.7, allows the subdivider to request a one-year extension of
the preliminary plat, or a phase of the preliminary plat approval deadline from the city council. A one-year
extension would give the developer until November 3, 2011 to file the fmal plat.
RECOMMENDATION: A motion to adopt the resolution and grant a one-year extension to the preliminary plat
for phases 19, 21 and the remainder of 22 of the Glacier Village Greens Subdivision would be in order.
FISCAL EFFECTS: Minor positive impacts once fully developed.
ALTERNATIVES: As suggested by the city council.

WHEREAS, the city council of the City of Kalispell granted preliminary plat approval for Glacier
Village Greens Phases 14-22 on December 16, 2002, and
WHEREAS, Sands Surveying, on behalf of Owl Corporation, the owner, now desires a one-year
extension to the preliminary plat for Glacier Village Greens Phases 19, 21 and the
remainder of phase 22 due to economic conditions, and
WHEREAS, Section 2.06 of the Kalispell Subdivision Regulations and Montana Subdivision and
Platting Act allows the city council to grant a one-year extension to the preliminary
plat in addition to the original three year approval; and
WHEREAS, good cause exists for the request for extension by Sands Surveying and it is in the
best interests of the city that the extension be given.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
KALISPELL, MONTANA AS FOLLOWS:
SECTION I. That the application of Sands Surveying on behalf of Owl Corporation for a
one-year extension of the preliminary plat of Glacier Village Greens Phases
19, 21 and the remainder of Phase 22, Kalispell, Flathead County, Montana is
hereby approved.
PASSED AND APPROVED BY THE CITY COUNCIL AND SIGNED BY THE MAYOR OF THE

In response to your reminder letter of August 16, 2010, I would like to reply on behalf of
my client, Mark Owens, (Owl Corporation), to request a one-year extension of the
preliminary plat. As you know, due to the current economic conditions, there have been
setbacks in the market and the additional time is needed to fine tune the remaining
phases. Owl Corporation would like to utilize the years' extension to continue to work
towards completion of a final plat application for the remaining phases, thereby expiring
on November 3, 2011, should this request be granted.
