Resolution 5461 - Annexation - Trinidad Holdings, LLPREPORT To: Kalispell Mayor and City Council FROM : Sean Conrad, Senior Planner Jane Howington, City Manager SUBJECT Trinidad Holdings, LLP -Annexation and Initial Zoning of R-4 (Residential) MEETING DATE: October 4, 2010 BACKGROUND: The Kalispell City Planning Board met on September 14, 2010 and held a public hearing to consider a request by Trinidad Holdings, LLP to annex approximately 0.90 of an acre into the City of Kalispell. The owners have requested R-4 (Residential) zoning on the property. The 0.90 of an acre project site is located on the west side of 8 b Avenue West approximately 200 feet south of the intersection of 8th Avenue West and 101h Street 'West. The property address is 1010 8#h Avenue West and spans from 8"' Avenue West to Ashley Creek. The property can be described as Lot 5 of Block 13 of High School Addition to Kalispell, records of Flathead County, Montana; excepting therefrom the northerly 12.47 feet within Section 18, Township 28 North, Range 21 West, P.M.M., Flathead County, Montana. Kalispell Planning Department staff presented staff report #KA-10-04 providing details of the proposal and the evaluation. Staff reported that the proposed R-4 zoning district was compatible with surrounding land uses and also consistent with the Kalispell Growth Policy Which designated the area as urban residential. Staff recommended the board consider recommending the council approve the annexation request and initial zoning of R-4 based on findings in the staff report. At the public hearing no one spoke in favor or against the annexation and initial zoning request and the public hearing was closed. The board briefly discussed the annexation request, cost of services analysis and the whether the R-4 zoning was appropriate for the property. The planning board then recommended the city council consider approving the request to annex and assign the R--4 zoning district on the property upon annexation. The vote was unanimous. RECOMMENDATION: A motion to approve the resolution annexing the property and a motion to approve the first reading of the ordinance for initial zoning of R-4 (Residential) would be in order. FISCAL EFFECT'S: The cost of services analysis indicates the annexation will cost the city to serve the property. However, with properties immediately adjacent to the city limits the costs to our streets, parks, etc. are already being experienced with no tax compensation. Annexing the property and the accompanying city taxes would help to pay for the services and impacts to city infrastructure. As suggested by the city council. C. E2dst .ng Land Use and, zoning: The property is currently developed with a single family residence. The current county zoning on the property is County R- 1, Suburban. Residential. This district is defined as "A district to provide estate - type development in rural areas away from concentrated urban development, typically not served by water or sewer services, or in areas where it is desirable to permit only lour -density development." Permitted uses in this district are generally limited to residential uses. The conditionally permitted uses alloy some non --residential uses but those are limited to churches, public stables, bed and breakfasts, schools and golf courses. Proposed Zoning: The proposed R-4, Two Family Residential, zone allows single- family residences and has a minimum lot size requirement of 6,000 square feet and a width of 50 feet. The proposed City R-4 district more closely reflects the existing residential density of the area and intended uses for the property. E. Size: The area proposed for annexation and zoning contains approximately 0.90 of an acre. F. Adjacent Land Uses and Zoning: The immediate neighborhood is primarily developed with single- family residences. The properties immediately north and south of the prof ect site are still in the county and are larger tracts of land developed with single family residences. Across 8thAvenue West are single family residences on city lots, approximately 7,100 square feet in size. General Land Use Character: The general land use character of this area can be described as primarily single family residential. H. Utilities and Public Services; All available public services and facilities are available to the property owner. A water main line is located directly in front of the property requesting annexation within the SthAvenue West right-of-way. A sewer main is located approximately half a block to the east along the alley between SthAvenue west and 7th Avenue west. If annexed, the owner would have to pay water and sewer impact fees prior to connecting the existing home on the property to the city's crater and sewer lines. Sewer: Septic system. (currently) with the potential to connect to a city surer main if annexed. Compliance with the gKowth Dlic : Chapter 2 of the Kalispell Growth Policy discusses the issues with cyclical growth the city has seen over the years. The chapter focuses on affordable housing, delivery of services, location of new development, redevelopment of the existing urban core and quality of life issues. As part of the review of the annexation request the following goals contained in chapter 2 are relevant to this particular annexation request. The goals are: Implement a comprehensive, effective growth management program that recognizes and upholds the general welfare of the community as well as individual rights. ® New urban and suburban development occurs in areas where public water and sewer are available. The city is currently drafting a growth management program in the form of an annexation policy document. The purpose of the annexation policy is to give the planning board, the council and the development community direction when outlying property owners are requesting municipal services and annexation. The draft document includes a potential annexation boundary map around the current city limits. The property requesting annexation falls inside the proposed boundary. A public water line is located immediately east of the property requesting annexation within the right-of-way for Sth Avenue Nest. The closest public sewer line is located in the alley between 7thand 3th Avenues 'Nest. If annexed, the property would have access to connect with the water and sewer main lines provided the appropriate impact fees and necessary permits are obtained from the city first and the sewer main line is extended in accordance with the public works departments standards. 2. Municipal services: As stated above water and sever main lines are located east of the property. These main lines are adequate to serve the existing and future homes on the property requesting annexation. Fire hydrants are located on the east side of Sth Avenue Nest. The two hydrants are located on the north and south ends of the block between 10th and 11 th Streets west. Given the close proximity to existing services and the city limits, annexation of the property will not overburden the municipal services currently in place. 3. Distance from current cily limits: The property requesting annexation is immediately adjacent to the city limits. The attached vicinity map provides an illustration of the location of the current city limits, Sth .A.venu.e west, in relation to the property requesting annexation. L9 4. Cost of services: Once annexed to the city, full city services will be made available to the property owner. Any necessary infrastructure associated with this development will be required to be constructed in accordance with the City of Kalispell's Design and Construction standards and any other development policies, regulations or ordinances that may apply. If annexed, the property owner will connect to city water and severer services as part of developing additional dwellings on the property. The attached cost of services analysis prepared for this property is used for all residential annexations. The analysis is only an estimate based on a variety of assumptions. The analysis does not take into consideration changes in methods of assessment and estimated costs associated with services. The information can only be used as a general estimate of the anticipated cost of services and revenue. A complete and accurate calculation will be completed at the time a connection to 'water and sewer is requested and/or a building permit is applied for as the necessary information would be available at that time. The attached cost of services analysis for this annexation shows approximately $1,248 will be generated from assessments and taxes. To serve the property with police and fire, roads, storm water and park services will total approximately $1,848. Based on these estimated figures the annexation will cost the city approximately $600. Please refer to Exhibit A for more specific details on the calculations. To summarize, the cost of services analysis indicates the annexation will cost the city to serve the property. However, with the property so close to existing city limits, the costs to our streets, parks, etc. are already being experienced with no tax compensation.. ZONING EVALUATION BASED ON STATUTORY CRITERIA The statutory basis for reviewing a change in zoning is set forth by 76-2--303, M.C.A. Findings of fact for the zone change request are discussed relative to the itemized criteria described by 76-2-304, M.C.A. and Section 27. 30.020, Kalispell Zoning Ordinance. 1. Does the requested zone corn-plycom-ply with the growthpohfy . The property is designated by the Kalispell Growth Policy future land use map as "Urban Residential" which anticipates residential development with a density of 5 between 3 to 12 dwelling units per acre. The proposed R-4 zoning designation permits density within the range listed in the urban residential land use designation.. 2. will the reguested zone have an effect on motorized and nonrnotorized transportation systerns? The property requesting annexation has a house on it. Once annexed and zoned R-4 no noticeable impacts to motorized or nonrn.otorized transportation systems will occur. The requested R--4 zoning would permit an increase of the density presently on the property and the additional development impacts can be accommodated by the existing street system in the area. 3. Will the requested zone secure safety from fire, panic, and other dangers? Adequate access and public facilities are available to the site in the case of an emergency. There are no features related to the property which would compromise the safety of the public. all municipal services including police and fire protection, grater and serer service are available to the area. There are existing city hydrants both north and south of the property requesting annexation. 4. will the reguested zone romote the public health safe and general welfare? The requested zoning classification will promote the health and general welfare by restricting land uses to those that would be compatible with the adjoining properties. 5. Will the requested zone'provide for ade uate light and air? Setback, height, and lot coverage standards for development occurrm* g on this site are established in. the Kalispell zoning Ordinance to insure adequate light and air is provided. 6. will the requested zonepromote compatible urbangrowth? The requested R-4 zoning district limits the property uses to either single family or duplex homes. This zoning district maintains and is compatible with the established land use pattern in this area which is primarily single family residential. 7. will the reguested zone facilitate the adequate rovision of transportation,, water, sewerage, schools parks, and other public re uirements? All public services and facilities are currently available or can be provided to the property. Development should be encouraged in areas where these services are available. 8. Does the requested zone give consideration to the particular suitability of the property.for particular uses? The proposed R-4 zoning district is consistent with the surrounding residential zoning and land uses in the area. The R-4 zone also gives due consideration of the suitability of this property for the permitted uses in the zoning district. 9. Does the requested zone give reasonable consideration to the character of the district? The general character of the area is urban scale residential development to the east with slightly less dense suburban scale development to the immediate north and south of the property. By assigning the property with the R-4 zoning district the development of this property will be consistent with the predominant residential character of the neighborhood. 10. will the proposed zone conserve the value of buildings*.;' Value of the buildings in the area will be conserved because the R-4 zoning will promote compatible and like uses on this property as are found on other properties in the area. 11. Will the requested zone encourage the most appropriate use of the land throughout the municipality? Urban scale residential development should be encouraged in areas where services and facilities are available. The proposed zoning is consistent with the growth policy future land use designation and is compatible with current county zoning in the immediate area.
