SUBJECT: Bid Award -- 2010 Sidewalk and Curbing Project
MEETING DATE: 17 May 2010
BACKGROUND: Each year the City prepares a project for construction of sidewalks and curbing
throughout the City. This project provides the contractual baseline for the many individual replacement
projects that are completed by the City and residents under the City's 50/50 sidewalk replacement
program. The 2010 project bids were opened on April 20''. Of the four bidders there were two bidders not
familiar to the City and the Project Manager. In addition, one of these bidders submitted a bid
substantially lower than all other bidders. In accordance with Montana Public Works Standard
Specifications, Article 19, referenced in the bid documents, additional information was requested from all
bidders documenting their experience and qualifications to perform the work anticipated for this project.
Three of the four bidders responded as requested. The fourth bidder, TM Contracting, the apparent low
bidder, failed to respond as required. The Project Manager and City Attorney have concluded that the bid
submitted by TM Contracting is not responsive. The Project Manager's report is attached for reference.
RECOMMENDATION: Award the 2010 Sidewalk and Curbing Project to the Sandon Construction
Company, Inc.

SIDEWALK AND CURBING PROJECT TO SANDON CONSTRUCTION COMPANY OF
KALISPELL.
FISCAL EFFECTS: Potential expenditure of 50/50 sidewalk and curbing replacement program funds

Re: 2010 Sidewalk & Curbing Bid Analysis and Recommendation
This contract is designed to assist property owners wishing to replace existing sidewalks or construct
new infill sidewalks adjacent to their property utilizing the 50150 cost sharing program. The 50150 cost
sharing program was established by the City Council to encourage sidewalk replacement and infill
sidewalk construction by equally dividing the cost between the City and the property owner. The City
has $16,215 remaining in the current budget for 50150 sidewalk work. A $25,000 appropriation is
requested for the 2010/2011fiscal year.
Bids for Sidewalk and Curbing Construction for the year ending December 31, 2010 were opened on
Tuesday, April 20, 2010. Bids were received from TM Contracting, Sandon Construction, Winkler
Concrete, and Knife River. All bids were in order and contained the required Bid Bond.
The Bid Price from each bidder to replace an average 250 SF residential sidewalk is as follows:

The Bid Price from each bidder to install an average 250 SF infill residential sidewalk is as follows:
TM Contracting $1315.00

Knife River $2112.50
The cost to install infill sidewalks is less as existing sidewalks do not need to be removed.
TM Contracting and Winkler Concrete are contractors that were unfamiliar to me. In order to help me
fairly evaluate the bids, I requested all of the bidders to provide me with additional experience and
references for work they had previously accomplished of a similar nature. Sandon Construction,
Winkler Concrete, and Knife River provided the additional information required to properly evaluate
their bid. TM Contracting did not provide the additional information. TM Contracting cannot
demonstrate that they have any hands on experience installing concrete sidewalks and curbing.
Therefore, I cannot recommend awarding the bid to a contractor with no experience in the trade they
have bid on.
The next lowest bidder, Sandon Construction, has more than 50 years of experience installing concrete
locally. A review of performance during the period 2005 through 2009 indicates that 90% of the work
completed under this contract is residential type 50150 sidewalk replacement. Therefore, the final bid
analysis is residential oriented. I recommend the bid for Sidewalk and Curbing Construction for the
Year ending December 31, 2010 be awarded to S andon Construction Company Inc.
