Kalispell Mayor and City Council FROM: Sean Conrad, Senior Planner Jane Howington, City Manager SUBJECT Ashley Square, Amended Plat of Lot 2 of the Resubdivision of Lots 1 and 3 Gibson Addition No. 41 Subdivision — Request for one-year preliminary plat extension MEETING DATE: March 1, 2010 BACKGROUND: This is a request by Aspen Ridge Architects on behalf of the owner of the property for a one- year extension of the preliminary plat of the subdivision. The subdivision would create one commercial lot (lot 2B) at the Ashley Square Mall and was approved on May 5, 2007 by the Kalispell City Council subject to S conditions. The Ashley Square Subdivision is 0.3 of an acre in size and is located on the north side of US Highway 2 approximately one half mile west of North Meridian Road. The subdivision site is zoned B-3, Community Business, which allows a wide variety of commercial, retail and office uses. The Kalispell Subdivision Regulations, Section 2.06.E.7, allows the subdivider to request a one-year extension of the preliminary plat approval deadline from the city council. A one-year extension would give the developer until May 5, 2011 to file the final plat. RECOMMENDATION: A motion to adopt the resolution and grant a one-year extension to the preliminary plat approval for the Ashley Square Subdivision would be in order. WHEREAS, the city council of the City of Kalispell granted preliminary plat approval for Lot 2B of Ashley Square Mall on May 5, 2007, and WHEREAS, Aspen Ridge Architects, on behalf of the owner, now desires a one-year extension to the preliminary plat for Lot 2B of Ashley Square Mall due to the downturn in market conditions, and WHEREAS, Section 2.06 of the Kalispell Subdivision Regulations and Montana Subdivision and Platting Act allows the city council to grant a one-year extension to the prelim nary plat in addition to the original three year approval; and WHEREAS, good cause exists for the request for extension by Aspen Ridge Architects and it is in the best interests of the city that the extension be given. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KALIS PELL, MONT.ANA AS FOLLOWS: SECTION I. That the application of Aspen Ridge Architects for a one-year extension of the preliminary plat of Lot 2B of Ashley Square Mall, Kalispell, Flathead County, Montana is hereby approved.
