Kalispell subsequently established an impact fee committee to review and recommend the setting of fees, schedules, and classifications to be imposed upon all users creating additional demand on municipal facilities. The city also contracted with a consultant to develop this information and to work with the impact fee committee with recommendations forwarded to the Council for consideration. Resolutions 5162 and 5163 were adopted on November 20, 2006 and established the methodology to be utilized, the impact fee schedule, the calculations and data sources, for the police and fire impact fees. Montana law requires this information to be reviewed every two (2) years. In 2009, the consultant, using the authorized methodology, etc. reviewed the police and fire impact fee rates and schedule. The impact fee committee then reviewed this information and recommended the rates and schedule currently before you. ANALYSIS: Planning standards established in 2006 were maintained: for fire the City uses NFPA 1710 and for police the City uses a 1999 space needs study prepared by Architects Design Group. These standards outline the capital needs of the community which are driven by the need to service new development within the City. The allocation of these costs is based on the historical number of calls using call records, between residential and commercial development types. Credits for payment from other revenue sources are then applied to these allocations to determine the allowable impact fees by development type. The proposed impact fee rates signify the maximum allowable fee, however, as a matter of policy the City may charge any amount up to this number. RECOMMENDATION: Approve the Final Report dated June 2010 for Impact Fees for Fire/EMT and Police Service. ALTERNATIVES: As suggested by Council. MEETING DATE: Monday, August 2, 2010- Regular Meeting BACKGROUND: As required by Montana Law, the Kalispell Impact Fee Committee met to analyze the police services impact fee and has recommended an adjustment to more accurately reflect the capital needs of police services and the current costs of local construction. The Committee has recommended a decrease in impact fees in two of the three "Development Types" we assess fees for and an increase in one of the "Development Types". As listed in attached recommendation the Single Family per unit fee will decrease by $3.00, the Apartment per unit will decrease by $4.00, and Commercial per 1000 sq. ft. will increase by $ 8.00. In analyzing the recommendations by the Committee I concur with their finding as it is based on the numbers utilized, specifically with the additional impact assessed with Commercial. We are finding that calls for service associated with Commercial needs are higher and more time consuming than expected. In specific, but not reflected in the attachment is the disparate time associated with calls for service in the Commercial category such as calls for service in commercial parking lots, and associated traffic accidents. The impact fees properly reflect the needs in the major area that the Police Department can utilize impact fees; facility needs. As you know we have acquired additional space, however impact fees could be utilized to remodel the public safety building. Currently our investigations division is physically separated from all other divisions within the Police Department. RECOMMENDATION: That City Council consider and pass Resolution,SJ41l/, FISCAL EFFECTS: The Revenue produced by the collection of these impact fees should provide much of the necessary capital to construct future facility needs. HEREA.S, the City Council passed Ordinance 1587 on October 16, 2006, which authorized the imposition of impact fees for police services; and WHEREAS, subsequent to the passage of Ordinance 1587 the city established impact fees for police services; and WHEREAS, the City Council. passed Resolution 5273 on April 7, 2008, adjusting the police services impact fees; and WHEREAS, pursuant to .MCA 7-6-1602 the Impact Fee .Advisory Committee analyzed the police services impact fee and is now recommending that the currently established impact fees be adjusted to more accurately reflect the capital needs of police services and the current costs of local construction; and WHEREAS, Exhibits .A, B 1, B2, B3, B4 and B5 attached hereto sets forth the capital improvement plan and fee schedule that has been recommended by the Kalispell. Impact Fee Committee. The City Council finds that the HDRIEES report dated June, 2010, attached hereto as Exhibit C, as approved and submitted by the Kalispell Impact Fee Committee, along with the plan and schedule reasonably reflects the capital needs for police services in the City that may be reasonably charged through a police services impact fee. NOW THEREFORE, BE IT RESOLVED BY 'T'I3E CITY COUNCIL OF THE CTT'Y OF KALISPELL, MONTAN.A: SECTION I. That the Police Impact Fees be adjusted pursuant to the Schedule attached hereto as Exhibit "A" and Incorporated fully herein by this reference. SECTION II.
